Abstract
งานวิจัยฉบับนี้มีวัตถุประสงค์ในการศึกษา กฎหมายเกี่ยวกับการส่งเสริมการลดและการนำของเสียมาใช้ประโยชน์ เรื่องการแก้ไขปัญหาขยะมูลฝอยซึ่งปริมาณเพิ่มขึ้นอย่างรวดเร็ว สืบเนื่องจากการพัฒนาของเศรษฐกิจและสังคมของไทย ทำให้มีพื้นที่ในการรองรับขยะมูลฝอยหรือของเสียที่เกิดขึ้นนั้นมีไม่เพียงพอต่อการกำจัดของเสียที่เกิดขึ้น อีกทั้งบุคคลากรทางภาครัฐไม่มีความเชี่ยวชาญในการกำจัดขยะมูลฝอยหรือของเสียได้อย่างถูกหลักสุขาภิบาล ทำให้ขยะมูลฝอยหรือของเสียมีปริมาณเพิ่มมากขึ้นอย่างรวดเร็ว ทั้งยังส่งกลิ่นเหม็นรบกวนประชาชนที่อยู่ใกล้เคียงสถานที่ทิ้งขยะทำให้ประชาชนได้รับความเดือดร้อน การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร โดยการวิเคราะห์ ค้นคว้า และรวบรวมข้อมูลจากเอกสารทั่วไป ได้แก่ หนังสือ บทความทางวิชาการ งานวิจัย วิทยานิพนธ์ จากการศึกษาร่างพระราชบัญญัติว่าด้วยการส่งเสริมการลดและนำของเสียมาใช้ประโยชน์ พ.ศ. .... ยังมีข้อบกพร่องหลายประการ อาทิเช่น เรื่องอำนาจหน้าที่ของรัฐมนตรีรักษาตามพระราชบัญญัตินี้ เนื่องจากมีรัฐมนตรีรักษาการหลายท่าน นิยามของคำว่า สังคมรีไซเคิล ควรเพิ่มเติม คำว่า การให้ความรู้แก่สังคม และบทลงโทษซึ่งเป็นการใช้มาตรการการลงโทษทางอาญามาใช้บังคับมากเกินไปเห็นควรมีการนำมาตรการทางปกครองมาใช้บังคับ โดยมีการศึกษากฎหมายเกี่ยวกับการส่งเสริมการลดและการนำของเสียมาใช้ประโยชน์ ของประเทศสหรัฐอเมริกาและประเทศญี่ปุ่น มาเป็นแนวทางในการยกร่างและแก้ไขกฎหมายเกี่ยวกับการส่งเสริมการลดและการนำของเสียมาใช้ประโยชน์ของไทยเพื่อให้มีประสิทธิภาพในการบริหารจัดการขยะมากยิ่งขึ้น
