Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาป็ญหาการดำเนินคดีกับผู้ต้องหาเด็กหรือเยาวชนโดยพนักงาน ตำรวจ โดยศึกษาถึงป้ญหาการจับกุมระยะเวลาควบคุมตัวและการนำผู้ต้องหาเด็กหรือเยาวชนไปศาลเพื่อตรวจสอบการจับ การนับอายุเด็กหรือเยาวชนและอำนาจศาลที่จะพิจารณาคดี การเปรียบเทียบปรับผู้ต้องหาเด็กหรือเยาวชน การแจ้งข้อกล่าวหา และสอบสวนผู้ต้องหาเด็กหรือเยาวชน การนำผู้ต้องหาเด็กหรือเยาวชนมาแถลงข่าวและนำชี้ที่เกิดเหตุประกอบคำรับสารภาพ ซึ่งอาจมีผลกระทบสิทธิเสรีภาพเด็กหรือเยาวชน ตามพระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและ ครอบครัว พ.ศ.2553 ประมวลกฎหมายวิธีพิจารณาความอาญา ประมวลกฎหมายอาญา และกฎหมายอื่นๆ ที่เกี่ยวข้อง ซึ่งมีการแก้ไขปรับปรุงเพื่อให้การคุ้มครองสิทธิผู้ต้องหาเด็กหรือเยาวชนให้สอดคล้องกับกฎหมายของต่างประเทศและอนุสัญญาว่าด้วยสิทธิ เด็ก ค.ศ.1989 เพื่อให้การปฏิบัติต่อผู้ต้องหาเด็กหรือเยาวชนไม่ละเมิดสิทธิผู้ต้องหาเด็กหรือเยาวชนตามหลักสิทธิมนุษยชน จึงเห็น ควรศึกษาวิเคราะห์ปัญหาในการดำเนินคดีผู้ต้องหาเด็กหรือเยาวชนโดยพนักงานตำรวจที่เกิดขึ้นเปรียบเทียบกับกฎหมายต่างประเทศ เพื่อนำมาแก้ไขปรับปรุงระบบการดำเนินคดีผู้ต้องหาเด็กหรือเยาวชนในชั้นตำรวจของประเทศไทยในป็จจุบัน การศึกษาค้นคว้าอิสระเป็นการวิจัยเชิงคุณภาพ (Qualitative Research) โดยการวิจัยเอกสาร Documentary Research) ด้วยวิธีการศึกษาจากรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2550 ประมวลกฎหมายอาญา ประมวลกฎหมายวิธีพิจารณา ความอาญา พระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัว พ.ศ.2553 พระราชบัญญัติคุ้มครองเด็ก พ.ศ. 2546 และกฎหมายอื่นๆ ที่เกี่ยวข้อง ประกอบกับวิทยานิพนธ์ สารนิพนธ์ บทความทางวิชาการต่าง ๆ และข้อมูลทางอินเตอร์เน็ต ตลอดจนแนวคำพิพากษาของศาลที่ได้วินิจฉัยคดีเกี่ยวข้องกับเด็กหรือเยาวชน โดยศึกษาถึงปัญหาในการดำเนินคดี ผู้ต้องหาเด็กหรือเยาวชนโดยพนักงานตำรวจ ตามที่กฎหมายบัญญัติไว้ไม่ชัดเจนทำให้ต้องมีการดีความและมีขั้นตอนที่เกินความจำเป็นไม่สอดคล้องในทางปฏิบัติซึ่งทำให้มีการละเมิดสิทธิผู้ต้องหาเด็กหรือเยาวชน ผลการศึกษาพบว่ามีป็ญหาในการดำเนินคดีผู้ต้องหาเด็กหรือเยาวชนโดยพนักงานตำรวจ (1) การจับกุมและ ระยะเวลาการควบคุมตัวและการนำสัวผู้ต้องหาเด็กหรือเยาวชนไปตรวจสอบการจับ การจับกุมเด็กหรือเยาวชนนั้นมีกฎหมายบัญญัติ ให้การคุ้มครองสิทธิเด็กหรือเยาวชนมากขึ้น การจับกุมยากขึ้นทำให้บางครั้งเจ้าพนักงานตำรวจไม่กล้าจับเพราะกลัวการจับนั้น เป็นไปโดยมิชอบด้วยกฎหมายซึ่งอาจนำมาสู่การละเมิดสิทธิเด็กหรือเยาวชนได้ การกำหนดให้พนักงานสอบสวนนำตัวผู้ต้องหา เด็กหรือเยาวชนไปตรวจสอบการจับภายใน 24 ชั่วโมง ซึ่งเป็นระยะเวลาที่น้อยเกินไป ในบางสถานีตำรวจมีสภาพทางภูมิศาสตร์ที่ตั้ง สถานีตำรวจซึ่งอยู่ห่างไกลจากศาล เห็นควรให้มีการปล่อยชั่วคราวได้ในชั้นพนักงานสอบสวนโดยไม่ต้องนำผู้ต้องหาเด็กหรือ เยาวชนไปศาลเพื่อตรวจสอบการจับ (2) การนับอายุเด็กหรือเยาวชนและเขตอำนาจศาลที่จะดำเนินคดี บางครั้งการนับอายุเด็กหรือ เยาวชนผิดพลาดอาจนำไปสู่การที่ไม่ได้นำตัวผู้ต้องหาเด็กหรือเยาวชนไปดำเนินคดีที่เขตศาลที่มีอำนาจพิจารณาคดีเป็นการละเมิด สิทธิผู้ต้องหาเด็กหรือเยาวชน (3)การเปรียบเทียบปรับผู้ต้องหาเด็กหรือเยาวชน กฎหมายไม่ได้บัญญัติไว้ชัดเจนว่าเด็กหรือเยาวชน อายุเท่าใดสามารถเปรียบเทียบปรับได้ อาจทำให้ขัดกับประมวลกฎหมายอาญาซึ่งบัญญัติกำหนดอายุของเด็กหรือเยาวชนไว่ไนการ รับโทษทางอาญา การเปรียบเทียบปรับเด็กหรือเยาวชนจะต้องมีสหวิชาชีพร่วมหรือไม่ ต้องบัญญัติไว้ชัดเจนเพื่อไม่ให้เกิดป็ญหา ในทางปฏิบัติซึ่งอาจนำไปสู่การละเมิดสิทธิเด็กหรือเยาวชน (4) การแจ้งข้อกล่าวหาและการสอบสวนผู้ต้องหาเด็กหรือเยาวชนมีขั้นตอนที่เกินความจำเป็นในบางฐานความผิด ตั้งมีปัญหด้าานสถานที่สอบสวนปากคำ สหวิชาชีพมีไม่เพียงพอ เวลาว่างไม่ตรงกัน งบประมาณมีไม่เพียงพอ ซึ่งอาจทำให้การดำเนินคดีส่าช้าเป็นการละเมิดสิทธิเด็กหรือเยาวชนได้ (5) การแถลงข่าวและการนำ ผู้ต้องหาเด็กหรือเยาวชนนำชี้ที่เกิดเหตุประกอบคำรับสารภาพ ซึ่งอาจทำให้เป็นการประจานเด็กหรือเยาวชน เป็นการละเมิดสิทธิ ผู้ต้องหาเด็กหรือเยาวชน ควรบัญญัติไว้ในกฎหมายให้มีการนำชี้ที่สถานที่เกิดเหตุจำลองแทนการนำสัวผู้ต้องหานำชี้ที่เกิดเหตุ ประกอบคำรับสารภาพในสถานที่จริง
