การศึกษาค้นคว้าอิสระ เรื่อง การขอรับการชดใช้ค่าสินไหมทดแทนเพื่อละเมิดตามกฎหมายเกี่ยวกับความรับผิดทางละเมิดของเจ้าหน้าที่ มีวัตถุประสงค์เพื่อหาแนวทางในการแก้ไขวิธีการเกี่ยวกับการขอรับการชดใช้ค่าสินไหมทดแทนจากรัฐตามพระราชบัญญัติความรับผิดทางละเมิดของเจ้าหน้าที่ พ.ศ.2539 มาตรา 11 และกฎ ระเบียบ ที่เกี่ยวข้องในทางปฏิบัติของหน่วยงานของรัฐเกี่ยวกับการชดใช้ค่าสินไหมทดแทนเพื่อให้ผู้เสียหายได้รับการคุ้มครอง เยียวยาความเสียหาย ด้วยความรวดเร็ว และเป็นธรรม การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาเชิงคุณภาพ โดยใช้วิธีการศึกษาจากเอกสาร ประกอบด้วยเอกสารที่เกี่ยวข้องทางวิชาการ ตำรา บทความ รายงานการวิจัย รายงานวิชาการต่าง ๆ สื่ออิเล็กทรอนิกส์ บทบัญญัติกฎหมายที่เกี่ยวข้อง ไม่ว่าจะเป็นตัวบทกฎหมายของประเทศไทย และต่างประเทศ เพื่อนำมาวิเคราะห์สังเคราะห์ข้อมูล ผลการศึกษาพบว่า การยื่นคำขอรับค่าสินไหมทดแทนจากหน่วยงานรัฐในกรณีที่ผู้เสียหายเห็นว่าหน่วยงานของรัฐต้องรับผิดชอบต่อการละเมิดของเจ้าหน้าที่ ตามพระราชบัญญัติความรับผิดทางละเมิดของเจ้าหน้าที่ พ.ศ.2539 มีขั้นตอนกระบวนการและระยะเวลาในการพิจารณาตามปกติ 180 วัน และหากเรื่องใดไม่อาจพิจารณาได้ทันในกำหนดขออนุมัติขยายระยะเวลาต่อรัฐมนตรีเจ้าสังกัดออกไปได้อีกไม่เกิน 180 วัน รวมระยะเวลาการพิจารณาของรัฐสูงสุด 360 วัน และเมื่อผู้เสียหายไม่พอใจในผลคำวินิจฉัยกฎหมายให้ยื่นฟ้องต่อศาลปกครอง ภายใน 90 วัน นับว่าเป็นระยะเวลาที่ใช้ในการพิจารณาค่อนข้างยาวนานและอำนาจในการพิจารณาเป็นอำนาจศาลปกครองและในระหว่างยื่นคำขอดังกล่าวอายุความละเมิดมิได้สะดุดหยุดลงแต่อย่างใด เห็นควรแก้ไขพระราชบัญญัติความรับผิดทางละเมิดของเจ้าหน้าที่ พ.ศ.2539 โดยบัญญัติ “ให้หน่วยงานของรัฐพิจารณาคำขอที่ได้รับให้แล้วเสร็จภายใน 90 วันนับแต่วันได้รับคำขอ หากเรื่องใดไม่อาจพิจารณาได้ทันในกำหนด ให้หัวหน้าหน่วยงานของรัฐขยายระยะเวลาออกไปได้อีกไม่เกิน 60 วันก่อนวันครบกำหนดดังกล่าว คำสั่งเรื่องการชดใช้ค่าสินไหมทดแทนให้ถือว่าไม่ใช่คำสั่งทางปกครอง หากผู้เสียหายไม่พอใจในผลคำวินิจฉัยให้ศาลยุติธรรมมีอำนาจในการพิจารณา โดยให้ฟ้องต่อศาลยุติธรรม ภายใน อายุความละเมิด และในระหว่างที่หน่วยงานของรัฐพิจารณาคำขอก็ให้อายุความละเมิดสะดุดหยุดลง เพื่อให้การชดใช้ค่าสินไหมทดแทนแก่ผู้เสียหายเป็นไปด้วยความรวดเร็วและเป็นธรรม
The purpose of this independent study is to find the ways to resolve how to obtain compensation from section 11 of the Act on Liability for Wrongful Act of Official, B.E. 2539 and related regulations. In practice, state to reimburse the victim claims should be protected to get damage remedy fast and fair. This independent study is the qualitative study by studying from the documents, consisting of the academic documents, textbooks, the articles, the research reports, the academic researches, the electronic media and the relevant provisions of law both Thai language and foreign language in order to analyze and synthesize the data. The study found that applying for a claim from a government agency when the victim considered that a government agency has to responsible for a violation of the authorities. According to the Act, there are 180 days of procedure and time for the normal consideration, and if any matter cannot be considered in time, the extension of the period of time allowed to the minister not more than 180 days, including the maximum period of 360 days, and when the victim is dissatisfied with the result of the ruling, the case must be filed with the Administrative Court within 90 days. The court proceedings will take up too much time in the Administrative Court and during the filing of this request the age of the violation did not stumble. It is recommended that the Act should be amended: "the government agency shall consider the request received within 90 days from the date of receipt of the request”. If any matter cannot be determined in time, the head of state agency may extend the validity period not exceeding 60 days prior to such due date. The indemnity order shall be deemed not to be an administrative order. If the victim is dissatisfied with the decision, the court of justice will have the power to consider. The lawsuit to the court should be made within the age of violation and while the state agency considers the request, the age of the violation stumbles. This resulted in the indemnity payment to the victim is fast and fair.
