Abstract
การศึกษาปัญหากฎหมายเรื่อง การกำหนดประเภทสิ่งของต้องห้ามในเรือนจำตามกฎหมายว่า ด้วยราชทัณฑ์มีวัตถุประสงค์เพื่อ ศึกษาวิเคราะห์วรรณกรรมเกี่ยวข้อง และกฎหมายที่เกี่ยวกับสิ่งของต้องห้ามในเรือนจำทั้งในประเทศไทยและต่างประเทศ เป็นการสังเคราะห์ให้ได้ข้อสรุป เพื่อเป็นแนวทางในการแก้ไขเพี่มเติมประเภทสิ่งของต้องห้ามตาม ข้อ 127 ของกฎกระทรวงมหาดไทย ออกตามความในมาตรา 58 แห่งพระราชบัญญัติราชทัณฑ์พุทธศักราชการ 2479 การศึกษาค้นคว้าอิสระในครั้งนี้เป็นงานวิจัยเชิงคุณภาพ โดยศึกษาจากเอกสารที่เกี่ยวข้อง อาทิ ตำรา วิทยานิพนธ์ งานวิจัย และการสืบค้นข้อมูลจากอินเตอร์เน็ต เพื่อให้เกิดความรู้ความเข้าใจ ในเรื่องสิ่งของต้องห้ามนำเข้ามาหรือเก็บรักษาไว้ในเรือนจำ ความรับผิดของผู้ต้องขังเมื่อกระทำผิดวินัย ฐานมีสิ่งของต้องห้ามผลการศึกษาพบว่า การกระทำผิดเกี่ยวกับสิ่งของต้องห้ามในเรือนจำ นอกจากจะเป็นความผิดทางอาญาแล้ว ผู้ต้องขังต้องรับโทษทางวินัยด้วย ความผิดทางวินัยของเรือนจำแบ่งออกเป็น 2 ประเภท คือ ความผิดที่อยู่ในกรอบหมวด 5 แห่งกฎกระทรวงมหาดไทยฯ สามารถลงโทษผู้ต้องขังได้เติมตามอำนาจ 3 สถาน ตามข้อ 116 แห่งกฎกระทรวงมหาดไทยฯ ส่วนความผิดนอก กรอบหมวด 5 สามารถลงโทษผู้กระทำผิดได้เพียง 1 สถานเท่านั้น ดังนั้น สิ่งของที่ไม่ได้กำหนดไว้ ในข้อ127ได้แก่อุปกรณ์เสพยาเสพติดอุปกรณ์สักร่างกายเงิน และกล้องถ่ายรูปจึงเป็นเพียงสิ่งของไม่อนุญาตและเป็นความผิดนอกกรอบ ทำให้เรือนจำเกิดความสับสนและลงโทษผู้ต้องขังไม่ถูกต้อง และการลงโทษผู้ต้องขังได้สถานเดียวทำให้ผู้ต้องขังไม่เกรงกลัวต่อโทษที่จะได้รับ เกิดการกระทำผิดเกิดบ่อยครั้ง และในผู้ต้องขังบางรายเรือนจำไม่สามารถใช้บทลงโทษ ให้เหมาะสมกับผู้ต้องขังแต่ละรายได้ดังนั้น จึงสมควรเพิ่มเดิมสิ่งของทั้ง 4 ประเภทเป็นสิ่งของต้องห้ามตามข้อ 127 ส่วนมาตรา 37 แห่งพระราชบัญญัติราชทัณฑ์ฯ ควรกำหนดขอบเขตการใช้ดุลพินิจของผู้บัญชาการเรือนจำ เช่น หากผู้ต้องขังกระทำผิดเกี่ยวกับสิ่งของต้องห้าม ตามมาตรา 45 ติดต่อกัน 3 ครั้ง ต้องแจ้งความดำเนินคดีอาญาแก่ผู้ต้องขัง
The objective of this research was to study related literature and laws in Thailand and other countries about items that are prohibited in prisons, in order to synthesize the data and reach conclusions that would be useful to provide guidelines for making revisions to Ministry of the Interior Ministerial Order Number 127, issued under Clause 58 of the Department of Corrections Act, B. E. 2479. This was a qualitative research based on documentary research of sources including textbooks, theses, research reports, and data from the Internet to create a greater understanding of items that are prohibited to be brought into prisons or kept in the possession of prisoners, as well as the punishment for having such prohibited articles, and the prisoners’ responsibility in such cases. The study found that not only is it a criminal offense to bring in or possess a prohibited article in a prison, but prisoners who violate the law are liable to disciplinary action as well. There are 2 kinds of disciplinary action that prisons may take for this offense. First, for offenses that fall within the framework of Section 5 of the Ministry of the Interior Ministerial Regulation, the prison can punish the prisoner for 3 counts under Item 116 of the ministerial regulation. However, for offenses that do not fall within the framework of Section 5, the prisoner is punishable by only one count. Therefore, items that are not specified in Item 127, such as drug paraphernalia, tattooing equipment, money and cameras, are simply unauthorized items and possessing them is not an offense that falls under the framework of Section 5. This causes some confusion among prison officers and may lead to incorrect disciplinary action. In cases where prisoners are charged with only one count of offense, they often do not fear punishment and are likely to repeat the offense. In some cases, prisons lack effective measures for keeping the prisoners under discipline. The 4 articles mentioned above should be added as prohibited articles under Item 127. Also, Clause 37 of the Department of Corrections Act should be rewritten to set boundaries for allowing the prison commander to use his or her discretion, such as starting a legal case against a prisoner if a prisoner violates Clause 45 three times.
