บทบาทของผู้ตรวจการแผ่นดินกับการพัฒนาการเมืองไทย

Abstract

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษา (1) บทบาทของผู้ตรวจการแผ่นดินที่มีต่อการ พัฒนาการทางการเมืองไทย (2) ปัญหาอุปสรรคของการปฏิบัติหน้าที่ตามบทบาทของผู้ตรวจการ แผ่นดินที่มีต่อการพัฒนาการทางการเมืองไทย และ 3) หาแนวทางการส่งเสริมบทบาทของผู้ตรวจการ แผ่นดินในการพัฒนาการทางการเมืองไทย การวิจัยนี้เป็นการวิจัยเชิงคุณภาพโดยการศึกษาเอกสารที่เกี่ยวข้องและสัมภาษณ์แบบ เจาะลึกกลุ่มตัวอย่างเลือกแบบเจาะจงจำนวน 12 คน ประกอบด้วย นักวิชาการทางรัฐศาสตร์ 2 คน นักวิชาการทางกฎหมายมหาชน 2 คน นักการเมือง 2 คน ข้าราชการ 2 คน ผู้ตรวจการแผ่นดินและ เลขาธิการ 4 คน โดยทำการวิเคราะห์ข้อมูลเชิงพรรณนา ผลการวิจัย (1) บทบาทผู้ตรวจการแผ่นดินที่มีต่อการพัฒนาการทางการเมืองไทย พบว่า ผู้ตรวจการแผ่นดินเปิดโอกาสให้ประชาชนผู้เดือดร้อนมีช่องทางในการเรียกร้องความเป็นธรรมจากภาครัฐ ช่วยสร้างเสริมให้นักการเมือง เจ้าหน้าที่ของรัฐ มีจิตสำนึกในด้านจริยธรรม และมีส่วนสำคัญในการ พัฒนาการระบบการเมืองตามโครงสร้างทางการเมืองของไทย (2) ปัญหาอุปสรรคชองการปฏิบัติหน้าที่ ตามบทบาทของผู้ตรวจการแผ่นดิน พบว่า ผู้ตรวจการแผ่นดินเป็นเพียงผู้รับเรื่องร้องเรียนแล้วส่งให้ หน่วยงานที่รับผิดชอบดำเนินการไม่มีอำนาจบังคับหน่วยงานที่ได้รับผลกระทบหรือเสียผลประโยชน์ให้ ปฏิบัติตามได้ การที่ผู้ตรวจการแผ่นดินมีอยู่สามคนไม่เพียงพอต่อการปฏิบัติงาน (3) ข้อเสนอแนะแนวทาง การส่งเสริมบทบาทของผู้ตรวจการแผ่นดิน พบว่า ควรปรับปรุงบทบาทผู้ตรวจการแผ่นดินที่มีผลต่อการ พัฒนาการทางเมืองไทย โดยเน้นบทบาทหลักในการรับเรื่องร้องทุกข์ของผู้เดือดร้อนจากนโยบายภาครัฐ ควรปฏิบัติงานในรูปแบบคณะกรรมการและขยายงานออกไปสู่ส่วนภูมิภาคมากขึ้น ควรปรับปรุงพัฒนา ศักยภาพชองเจ้าหน้าที่ให้มีความพร้อมมากกว่าที่เป็นอยู่

The objectives of this research were to study (1) the role of the ombudsman in the development of Thai politics; (2) problems and difficulties faced by the ombudsmen in fulfilling their duties; and (3) approaches for promoting the role of the ombudsman in developing Thai politics. This was a qualitative research based on documentary research and in-depth interviews with 12 key informants, chosen through purposive sampling, consisting of 2 academics in the field of political science, 2 academics in the field of public law; 2 politicians, 2 bureaucrats, and 4 ombudsmen/secretaries to ombudsmen. The data were analyzed through descriptive analysis. The results showed that (1) The roles of the ombudsman in developing Thai politics were to give citizens the opportunity and channel for voicing their grievances and demanding justice, to promote ethical conscience among government officials and politicians, and especially to develop the political system in accordance with the political structure of the country. (2) The major obstacles to the ombudsman’s fulfillment of these roles were first, that the ombudsman is only an apparatus to receive complaints and forward them to the responsible agencies for action, but does not have the power to force any units or individuals to follow the ombudsman’s recommendations, and secondly, that there are only 3 ombudsmen for the country, which is not enough. (3) Recommended approaches for promoting the role of the ombudsman in developing Thai politics are to emphasize the ombudsman’s primary role in receiving grievances from citizens who feel they are suffering in some way from the government’s policies, to have the ombudsmen work together with others as a committee, to expand the work in other regions of the country beyond Bangkok, and to develop the capacities of the personnel at the Ombudsman’s Office.
