การศึกษาค้นคว้าอิสระเรื่องปัญหาการกำหนดระยะเวลาที่เหมาะสมในการบอกกล่าวบังคับจำนองกับผลกระทบทางกฎหมายต่อการดำเนินคดีมีวัตถุประสงค์เพื่อศึกษากฎหมายแนวคิดทฤษฎีวิธีการกำหนดระยะเวลาบอกกล่าวที่ชอบด้วยกฎหมายเพื่อหาข้อยุติของการบอกกล่าวบังคับจำนองตามประมวลกฎหมายแพ่งและพาณิชย์มาตรา 728 ที่กำหนดให้ผู้รับจำนองมีหน้าที่ส่งจดหมายบอกกล่าวบังคับจำนองแก่ผู้จำนองหรือผู้รับโอนทรัพย์ซึ่งจำนอง โดยกำหนดระยะเวลาให้ชำระหนี้ภายในระยะเวลาตามที่กำหนด หากผู้รับจำนองมิได้ดำเนินการตามขั้นตอนที่กฎหมายกำหนดหรือดำเนินการแต่ไม่มีผลเป็นการบอกกล่าวตามกฎหมาย ผู้รับจำนองไม่สามารถยื่นฟ้องบังคับจำนองเป็นคดีต่อศาลได้ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสารจากการศึกษาถึงความเป็นมา แนวคิด ความเห็นของนักกฎหมายและแนวคำพิพากษาศาลฎีกาเกี่ยวกับการกำหนดระยะเวลาในการบอกกล่าวบังคับจำนองตามประมวลกฎหมายแพ่งและพาณิชย์มาตรา 728 ที่เป็นปัญหาต่อการดำเนินคดี เพื่อหาข้อยุติของปัญหาในการกำหนดระยะเวลาบอกกล่าวบังคับจำนองเห็นสมควรทำการแก้ไขบทบัญญัติของกฎหมายในมาตราดังกล่าว เพื่อให้เกิดความชัดเจนแน่นอนและมีผลสมบูรณ์ในการบังคับใช้ผลการศึกษาพบว่าปัญหาอันเป็นสาเหตุที่ทำให้ต้องทำการแก้ไขเปลี่ยนแปลงบทบัญญัติ ในประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 728 เนื่องจากบทบัญญัติดังกล่าวขาดความชัดเจนในเรื่องของตัวบุคคลที่จะต้องส่งจดหมายบอกกล่าวบังคับจำนอง ระยะเวลาที่กำหนดให้ชำระหนี้ ที่ผ่านมาได้นำหลักของคำพิพากษาศาลฎีกามาเป็นแนวทางในการปฏิบัตินับเป็นปัญหาที่มีมาเป็นเวลาช้านานการแก้ไขบทบัญญัติของกฎหมายดังกล่าวจะก่อประโยชน์ต่อกระบวนการฟ้องคดีบังคับจำนองโดยเฉพาะขั้นตอนการบอกกล่าวบังคับจำนองจะส่งผลให้การพิจารณาและพิพากษาคดีของศาลเป็นไปด้วยความสะดวกรวดเร็วโดยไม่จำต้องพิจาณาจากข้อเท็จจริงเป็นกรณี ๆ
As prescribed in Section 728 of the Civil and Commercial Code, the enforcement of mortgage requires the mortgagee to notify the debtor in writing to perform his obligation within a reasonable time period fixed in the notice. If the mortgagee fails to comply to this law, the mortgagee will not be entitled to file a court case against his debtor. This Independent Study is based on the qualitative research methodology which examines the development, academic and legal opinions, and Supreme Court judgment concerning the debtor's notification period prior to the enforcement of mortgage as specified in Section 728 of the Civil and Commercial Code, which this Study finds creates a problem in filing the case to the court of justice. The objective of this Study is to find a solution to the problem of reasonable notification time prior to mortgage enforcement and propose amendments to the abovementioned Section in order for the notification period to be well-defined and legally-enforceable. This Study seeks to amend the provision of the law in Section 728 of the Civil and Commercial Code because, firstly, it does not clearly specify whom the mortgage enforcement notice should be sent to and, secondly, it does not state exactly the fixed time the debtor has to perform his obligation. Until now,the legal proceedings have complied accordingly with the Supreme Court's judgment which has caused a long-term problem in the unclear procedural practice of the notification of mortgage enforcement. This Study proposes that the amendment of the above Section will be beneficial since it will increase convenience and shorten the time of the court's consideration which is currently on a case by case basis
