Abstract
การวิจัยครั้งนี้มีวัตถุประสงค์ (1) เพื่อค้นคว้ารูปแบบวิธีการของระบบการตรวจสอบการใช้อํานาจหน้าที่ของผู้พิพากษา ศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมือง (2) เพื่อหาความคิดเห็นของผู้พิพากษาศาลยุติธรรมต่อการตรวจสอบการใช้ อํานาจหน้าที่ ของผู้พิพากษาศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมือง (3) เพื่อวิเคราะห์ผลกระทบของการตรวจสอบการใช้อํานาจหน้าที่ ที่มีต่อการปฏิบัติงานของผู้พิพากษาศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมืองและ (4) เพื่อเสนอแนวทางในการปรับปรุงวิธีการในการตรวจสอบเพื่อความเป็นธรรมในการดำเนินการตรวจสอบการใช้อํานาจหน้าที่ของผู้พิพากษาศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมือง
วิธีการวิจัยเป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเอกสารจากการเก็บรวบรวมข้อมูลโดยการค้นคว้าเอกสารวิชาการต่างๆ ที่เกี่ยวข้องและการสัมภาษณ์เชิงลึกผู้พิพากษาศาลฎีกา จํานวน 8 คน และผู้ทรงคุณวุฒิจากภายนอก จานวน 6 คน ผลการศึกษาพบว่า มีระบบหรือกระบวนการในการตรวจสอบการใช้อํานาจหน้าที่ ของผู้พิพากษาศาลฎีกาแผนก คดีอาญาของผู้ดํารงตำแหน่งทางการเมืองรวมทั้งสิ้น 5 ลักษณะ 7 กระบวนการได้แก่การตรวจสอบโดยการถอดถอนออกจากตำแหน่ง จากภายในองค์กรศาลยุติธรรม กระบวนการยุติธรรมทางอาญากฎหมายวิธีพิจารณาความและองค์กรตามรัฐธรรมนูญ ซึ่งปัจจุบันทุกกระบวนการได้ทําหน้าที่ตามที่่ได้รับมอบหมายจากสังคม โดยพบว่า ผู้พิพากษาศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมืองก็ถูกตรวจสอบการใช้อํานาจหน้าที่ เช่นเดียวกับผู้พิพากษาศาลยุติธรรมที่ดํารงตำแหน่งอื่นๆ ในความเห็นของผู้พิพากษา และผู้ทรงคุณวุฒิภายนอก การตรวจสอบการใช้อํานาจหน้าที่่โดยคณะกรรมการตุลาการศาลยุติธรรม (ก.ต.) ได้รับการยอมรับว่าเป็นกลไกที่ดีมีความเหมาะสมและมีประสิทธิภาพในการตรวจสอบผู้พิพากษาศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่ง ทางการเมืองมากที่สุด แต่โดยหลักของการตรวจสอบแล้วต้องมีการตรวจสอบจากองค์กรภายนอกที่่เป็นอิสระควบคู่กันไป เพื่อเพิ่มประสิทธิภาพให้มากยิ่งขึ้นโดยเฉพาะกระบวนการถอดถอนออกจากตำแหน่งและโดยคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ แต่หากจะให้เป็นที่ยอมรับมากกว่านี้ ควรจะมีกระบวนการตรวจสอบในทางตุลาการ (Judicial Review) โดยศาล หรือองค์กรที่สูงกว่าหรือสร้างกระบวนการมีส่วนร่วมของประชาชนให้มากกว่านี้ ขณะเดียวกันต้องไม่ละเลยการตรวจสอบที่ไม่เป็นทางการ (Informal Check) ด้วย เช่น การตรวจสอบจากนักวิชาการ สื่อมวลชน องค์กรพัฒนาเอกชน (NGOs) เป็นต้น โดยมีผลการศึกษาวิจัย นํามาเป็นข้อเสนอคือให้มีศาลที่ทําหน้าที่พิจารณาคดีอาญาของผู้ดํารงตำแหน่งทางการเมืองอย่างน้อยสองศาล โดยอาจจะเริ่มที่ศาลอาญา (ในส่วนของคดีอาญา) หรือศาลแพ่ง (ในส่วนของคดีแพ่ง) หรืออาจจะเริ่มต้นจากศาลอุทธรณ์แผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมือง โดยให้มีการอุทธรณ์คําพิพากษาหรือคำสั่งไปยังศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมืองซึ่งเป็นศาลสุดท้าย และเพื่่อให้การพิจารณาพิพากษาคดีประกอบไปด้วยบุคคลผู้มีความรู้ความสามารถ ความเชี่ยวชาญ ทั้งในแง่ปฏิบัติ ทฤษฎีและมิติทางการเมืองรวมทั้งผนวกการเชื่อมโยงกับประชาชน ศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมืองจึงควรประกอบด้วย ผู้พิพากษาศาลฎีกา จํานวน 9 คน ผู้พิพากษาสมทบจากนักวิชาการหรืออาจารย์ในระดับมหาวิทยาลัยที่มีความเชี่ยวชาญทางกฎหมายมหาชน หรือรัฐศาสตร์ จํานวน 3คน และนักการเมือง เช่น สมาชิกสภาผู้แทนราษฎรหรือสมาชิกวุฒิสภา จํานวน 3 คน รวมทั้งสิ้น 15 คน ก็จะทำให้การพิจารณาคดีในศาลฎีกาแผนกคดีอาญาของผู้ดํารงตำแหน่งทางการเมืองมีความเหมาะสม
The purposes of this research were (1) to seek for an appropriated inspecting system for the use of the judicial authorities in the Supreme Court of Criminal Division for Political Position Holders, (2) survey the opinion of the judge in Thai judiciary toward such inspection, (3) analyze the impact of the inspecting on the performance of the such Supreme Court for justice end and (4) propose the guideline to improve any methods for inspecting as of to be an efficiency as such. Qualitative approach was the core of this research method through the documentary collecting. Eight judges in the Supreme Court and six experts from the Supreme General Attorney, university professors, scholars, and the representatives and lawyer were the sample for in dept interview. The results had revealed that the Inspecting system or process to monitor the use of the judicial such Supreme Court were constituted obviously as five methods and seven processes as the removal process from the official position, the internal audition, monitoring through any individual Judge by Judicial council Commission, monitoring the performance of the authority by the tribunal, The criminal justice system, the Case Procedural law, the organizations under the Constitution. As for both judge and outside scholar opinions, it is acceptable that the Inspecting of such judge have to conduct throughout the judicial review only by the Commission on Judicial Council is the best way. To perform as such, it recognized as a good and effective mechanism to monitor the judges of the Supreme Court of Criminal Division for most part. Apart from this, there must be audited by an external organization as to be parallel to the more enhanced by the process of being removed from position through the Chairman of the National Commission of Prevention and Suppression for Corruption. Moreover, the Informal Check system such as throughout the scholar –media-NGOs forum should be conducting as much as possible. Research result from this study can be implied as recommendations as to set up at least two levels of court both the criminal and the civil court (in the civil case).The case may origin at the first instant court and then life up to the Court of Appeal of Criminal Division for the Political Positions Holders. The Supreme Court's of Criminal Division for Political Position holder, then, has to audit through the judicial review system as the last stage. The assemblies are constituted with nine professional judges from the Supreme Court, three associated judges or university professors of public law or political sciences and three politicians as totally as fifteen persons. This will be the appropriated mechanism on the inspecting process.
