Abstract
การวิจัยเรื่องปัญหาทางกฎหมายของการให้ผู้ป่วยที่สิ้นหวังตายอย่างสงบนี้ มีวัตถุประสงค์เพื่อ (1) ศึกษารูปแบบ และวิธีการให้ผู้ป่วยที่สิ้นหวังตายอย่างสงบทั้งของไทยและต่างประเทศ (2) ศึกษาผลทางกฎหมายและรูปแบบที่เหมาะสม ในการนําวิธีการให้ผู้ป่วยที่สิ้นหวังตายอย่างสงบมาใช้กับประเทศไทย และ (3) ให้ข้อสังเกตและข้อเสนอแนะในการปรับปรุงแก้ไขพระราชบัญญัติสุขภาพแห่งชาติ พ.ศ. 2550 ในส่วนของการให้ผู้ป่วยที่สิ้นหวังตายอย่างสงบ การวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยวิจัยจากเอกสารทําการศึกษาเปรียบเทียบและวิเคราะห์บทบัญญัติที่คุ้มครองให้ผู้ป่วยที่สิ้นหวังตายอย่างสงบในประเทศไทยและต่างประเทศ เช่น ประเทศสหรัฐอเมริกา ประเทศออสเตรเลีย ประเทศสิงคโปร์ ประเทศเดนมาร์ก ประเทศอังกฤษ ประเทศฝรั่งเศส ประเทศเนเธอร์แลนด์ ประเทศแคนาดา และประเทศเยอรมันนี โดยการค้นคว้าและรวบรวมข้อมูลจากแหล่งต่างๆ เช่น กฎหมาย หนังสือวิชาการ บทความวารสาร วิทยานิพนธ์ รวมถึงข้อมูลบนเว็บไซต์ทั้งไทยและต่างประเทศ โดยใช้วิธีวิเคราะห์ให้สอดคล้องกับประเด็นที่ตั้งสมมุติฐานไว้ภายใต้หลักการทฤษฎีและหลักกฎหมาย จากการศึกษาพบว่ารูปแบบและวิธีการให้ผู้ป่วยที่สิ้นหวังตายอย่างสงบอาจแบ่งได้เป็น 3 กรณี คือ (1) การทําให้ผู้ป่วยถึงแก่ความตาย (2) การช่วยให้ผู้ป่วยฆ่าตัวตาย และ (3) การไม่ขอรับบริการสาธารณสุขในระยะสุดท้ายของ ชีวิตที่เป็นไปเพียงเพื่อยืดการตายหรือยุติการทรมานจากการเจ็บป่วยให้ผู้ป่วย ตามที่ผู้ป่วยได้แสดงเจตนาไว้ กรณีแรกทุกประเทศถือว่าการกระทําดังกล่าวเป็นความผิดตามกฎหมาย มีเพียงประเทศเนเธอร์แลนด์ ที่มีกฎหมายยอมให้แพทย์กระทําได้ภายใต้เงื่อนไขที่เข้มงวด กรณีที่สองทุกประเทศถือวาเป็นความผิดตามกฎหมาย ส่วนกรณีที่สามทั้งไทยและต่างประเทศ ยอมรับให้กระทําได้ ซึ่งประเทศไทยกำหนดให้ต้องทําเป็นหนังสือแสดงเจตนาไว้ล่วงหน้า ทั้งนี้เป็นไปตาม มาตรา 12 แห่ง พระราชบัญญัติสุขภาพแห่งชาติ พ.ศ. 2550 สําหรับผลทางกฎหมายและรูปแบบที่เหมาะสมในการนํามาใช้กับประเทศไทย พบว่าการทําให้ผู้ป่วยถึงแก่ความตายและการช่วยให้ผู้อื่นฆ่าตัวตายยังถือเป็นความผิดตามกฎหมายและไม่สมควรนํามาใช้ กับประเทศไทย ส่วนกรณีผู้ป่วยทําหนังสือแสดงเจตนาไว้ล่วงหน้าที่จะไม่ขอรับบริการสาธารณสุขในวาระสุดท้ายของชีวิตที่เป็นไปเพียงเพื่อยืดการตายหรือเพื่อยุติการทรมานจากการเจ็บป่วยนั้น สามารถนํามาใช้กับประเทศไทยได้ภายใต้ หลักเกณฑ์ วิธีการและเงื่อนไขที่รัดกุม ได้แก่ ขั้นตอนการแสดงเจตนา ผู้แสดงเจตนาจะต้องได้รับการชี้แจงและตอบข้อซักถามจนเข้าใจดีแล้วและสามารถเปลี่ยนการแสดงเจตนาได้ตลอดเวลา แบบของหนังสือแสดงเจตนา จะต้องระบุ รายละเอียดสิ่งที่ต้องกำหนดไว้อย่างชัดเจน เงื่อนไขและความสมบูรณ์ของหนังสือแสดงเจตนา การทําหนังสือแสดงเจตนา ผู้ทําหนังสือจะต้องมีสติสัมปชัญญะสมบูรณ์มีพยานรู้เห็น การปฏิบัติก่อนและหลังการดําเนินการตามหนังสือแสดงเจตนา จะต้องมีการสรุปขั้นตอนและวิธีการดําเนินการตลอดทั้งมีการสอบทานกระบวนการทํางานนั้นด้วย แม้จะมีการออกกฎกระทรวงกำหนดแนวทางไว้ในข้อเสนอแนะบางประเด็นแล้ว แต่ผู้วิจัยเห็นว่าประเด็นดังกล่าวเป็นเรื่องสําคัญที่ควร กำหนดไว้ในพระราชบัญญัติสุขภาพแห่งชาติ จึงเห็นควรให้มีการแก้ไขเพิ่มเติมพระราชบัญญัติสุขภาพแห่งชาติ พ.ศ. 2550 ในส่วนดังกล่าว แทนที่จะกำหนดไว้ในกฎกระทรวงหรือกฎหมายในระดับรอง
This study regarding the legal problem of euthanasia has three objectives: (1) to study the types and methods of euthanasia in Thailand and in other countries, (2) to study the legal effects and an appropriate system for euthanasia in Thailand, and (3) to give observations and suggestions for updating the National Health Act of 2550 regarding euthanasia.This study is a qualitative research based on documentary research, conducted by collecting data from various sources such as laws, academic books, academic journals and theses, as well as Thai and foreign websites for making a comparison and analysis of the protective measures for people who wish to be euthanized in Thailand and in other countries, such as the United States of America,ustralia, Singapore, Denmark, the United Kingdom, France, the Netherlands, Canada and Germany. The methods to analyze the laws and regulations are compliance with the underlying assumptions of the main theories and legal principles on the subject.The research has found that the types and methods of euthanasia may be divided into three different cases: (1) helping sick people to die, (2) helping sick people to kill themselves, and (3) opting not to provide medical care in order to prolong the final stages of life, and to put an end to the pain and suffering of patients, according to their declared intentions. In the first case, every country holds that the action is illegal. Only the Netherlands has a law that allows doctors to do it under strict conditions. The second case is also illegal in every country. Considering the third case, Thailand and other countries allow the described actions. Thailand requires that the patient’s intentions must be declared in writing in advance. This is following Section 12 of the National Health Act of 2550.Regarding the legal effects and the appropriate system for euthanasia in Thailand, this study found that helping sick people to die and helping people to kill themselves remain illegal and are inappropriate to introduce in Thailand. In the case that the patient has made a declaration of intent in advance that they do not wish to receive medical assistance to prolong their life, in order to end their pain and suffering, this method can be used in Thailand under guidelines and conditions, including procedures for the patient to declare their intentions. The person who would like to declare their intentions must give clarification and answer some questions so that they understand clearly, and they must be able to change their declaration at any time. Regarding the style of their written declaration, it must clearly specify the details and the information that must be defined, the conditions and ompleteness of the declaration of intent, and how to make a declaration of intent. The person who makes the declaration must be completely conscious, there must be a witness, and the procedure before and after the event must be carried out according to the declaration of intent. There must always be a summary of procedures and methods, and a review of the procedures in the task as well. Even though the ministry has issued guidelines on some points already, researchers have seen that these matters described are important and should be defined in the National Health Act. Therefore, it is appropriate that there should be an additional revision of the National Health Act of 2550 regarding the points mentioned, instead of defining them in ministry guidelines or in subordinate legislation.
