Abstract
การศึกษาค้นคว้าอิสระเรื่อง การใช้อำนาจตามกฎหมายของฝ่ายปกครองที่เกี่ยวข้องในการดูแลควบคุมมลพิษทางน้ำนี้ มีวัตถุประสงค์ (1) เพื่อศึกษาสภาพปัญหามลพิษทางน้ำที่ของประเทศไทยตั้งแต่อดีตจนถึงปัจจุบัน (2) เพื่อศึกษาถึงความหมายของฝ่ายปกครองและหลักการกระทำทางปกครอง (3) เพื่อศึกษาบทบัญญัติของกฎหมายเกี่ยวสิ่งแวดล้อมทางน้ำที่ให้อำนาจแก่ฝ่ายปกครอง ทั้งของไทยและต่างประเทศ (4) เพื่อศึกษาปัญหาการใช้อำนาจของฝ่ายปกครองที่เกี่ยวข้องกับการดูแลควบคุมมลพิษทางน้ำ (5) วิเคราะห์แนวคำพิพากษาของศาลปกครอง และแนวคำพิพากษาของศาลต่างประเทศเกี่ยวกับคดีสิ่งแวดล้อม ว่าใช้เหตุผล หรือหลักการใด ในการพิจารณา (6) เพื่อนำผลจากการศึกษาดังกล่าวมาวิเคราะห์เปรียบเทียบพร้อมเสนอแนะแนวทางการแก้ไขปัญหาดังกล่าว การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสารโดยศึกษาค้นคว้าจาก ตำรา หนังสือ บทความ วิทยานิพนธ์ วารสาร ทฤษฎี หลักกฎหมาย แนวคำพิพากษาศาลปกครอง แนวคำพิพากษาของศาลต่างประเทศ เป็นต้น โดยการนำข้อมูลมาวิเคราะห์รวมกัน เพื่อหาข้อสรุป และเสนอแนะแนวทางการแก้ไขปัญหา ผลการศึกษาพบว่า (1) สถานการณ์มลพิษทางน้ำของประเทศไทยยังมีอยู่อย่างต่อเนื่อง เนื่องจากมีการขยายตัวทั้งจำนวนประชากร และการประกอบกิจการอุตสาหกรรม เกษตรกรรม (2) การใช้อำนาจหน้าที่ของฝ่ายปกครองที่เกี่ยวข้องกับกฎหมายสิ่งแวดล้อมทางน้ำ ยังมีความคลาดเคลื่อน เพราะขาดองค์ประกอบหรือหลักเกณฑ์ที่ชัดเจน ส่งผลให้เกิดปัญหามลพิษทางน้ำโดยอาจคาดไม่ถึง (3) ผลการวิเคราะห์แนวคำพิพากษาทั้งของศาลปกครองไทย และต่างประเทศแสดงให้เห็นว่าล้วนแล้วแต่นำเหตุผลที่ใกล้เคียงกับหลักความชอบด้วยกฎหมายของการกระทำทางปกครอง และแนวคิดทฤษฎีเกี่ยวกับการควบคุมดูแลปัญหาสิ่งแวดล้อมมาประกอบการพิจารณา (4) ข้อเสนอแนะคือควรมีแนวนโยบายหรือยุทธศาสตร์ โดยกำหนดหลักเกณฑ์ให้เป็นระเบียบสำนักนายกรัฐมนตรีเกี่ยวกับหลักการปฏิบัติงาน หรือหลักการใช้อำนาจของฝ่ายปกครองที่เกี่ยวกับการควบคุมดูแลมลพิษทางน้ำ เพื่อเป็นแนวทางปฏิบัติให้กับฝ่ายปกครองอย่างชัดเจน เพื่อให้เป็นแนวทางเดียวกัน
The objectives of this independent study are: 1) to study the country's water pollution problems from past to present; 2) to study of the meaning of justice and the principles of administrative action; 3) to provide the law on the aquatic environment that empowers parents, both in Thailand and overseas; 4) to study the issue of using the power of the ruling related to the control of water pollution; 5) to analyze the judgment of the court and the judgment of the foreign court regarding the environmental case to find out whether logics or principles were used; and 6) to compare results of the study with guidelines for resolving such issues. This independent study is a qualitative research and documentary research. Books, journal articles, theses, Supreme Court judgments, judicial rulings of foreign courts, etc., were studied. The data were analyzed and solutions were suggested. The study findings are as follows. First, the situation of water pollution is an ongoing issue due to the expansion of the population, industry and agricultural activities. Second, the power and duties of administrative laws related to the marine environment. There are also discrepancies or a lack of clear criteria caused by water pollution that might not be expected. Third, an analysis of the judgements of the Supreme Administrative Court of Thailand and international courts showed the main reason of the legality of administrative acts. Theories and supervisory environmental issues were taken into consideration. Fourth, there should be a policy, a strategy and guidelines for regulation of the Prime Minister on the operation or use of administrative power related to the control of water pollution so as to have a clear pragmatic approach for the government.
