การกระจายอำนาจให้แก่เทศบาลในด้านบุคลากรกรณีคณะกรรมการพนักงานเทศบาลจังหวัด

Abstract

การศึกษาค้นคว้าอิสระเรื่องการกระจายอำนาจให้แก่เทศบาลในด้านบุคลากร กรณีคณะกรรมการพนักงานเทศบาลจังหวัด มีวัตถุประสงค์เพื่อ (1) ศึกษา แนวคิด ทฤษฎี และหลักการเกี่ยวกับการกระจาย อำนาจทางปกครองให้แก่องค์กรปกครองส่วนท้องถิ่น (2) เพื่อศึกษาหลักกฎหมายเกี่ยวกับการกระจายอำนาจให้แก่เทศบาลในด้านบุคลากร กรณีคณะกรรมการพนักงาน เทศบาลจังหวัด ตลอดจนปัญหาและอุปสรรคในการดำเนินการ (3) เพื่อเสนอแนะแนวทางการกระจายอำนาจให้แก่เทศบาลในด้านบุคลากรกรณีคณะกรรมการพนักงานเทศบาลจังหวัด การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร จากการศึกษาค้นคว้าจากบทความ เอกสารตำรา แนวคำพิพากษาของศาล รวมทั้งพระราชบัญญัติและกฎระเบียบต่าง ๆ ที่เกี่ยวข้อง ผลการศึกษาพบว่ารัฐธรรมนูญแห่งราชอาณาจักรไทย ได้บัญญัติหลักการเกี่ยวกับการกระจายอำนาจการปกครองให้แก่องค์กรปกครองส่วนท้องถินในด้านบุคลากรไว้ดีแล้ว แต่ควรมีการเพิ่มเติมในส่วนรายละเอียดของกฎหมาย คือ ควรปรับปรุงพระราชบัญญัติระเบียบบริหารงานบุคคลส่วนท้องถิ่น พ.ศ. 2542 เกี่ยวกับคณะกรรมการพนักงานเทศบาลจังหวัด โดยมีการเพิ่มเติมสัดส่วนของคณะกรรมการที่มาจากท้องถิ่นในตำแหน่งปลัดองค์กรปกครองส่วนท้องถิ่นให้เพิ่มมากขึ้น เพราะท้องถิ่นควรมีส่วนในการบริหารงานบุคคลของท้องถิ่นให้มีความเป็นอิสระและเป็นไปตามความต้องการของประชาชนในท้องถิ่น ซึ่งเป็นไปตามหลักการกระจายอำนาจการปกครองให้แก่องค์กรปกครองส่วนท้องถิ่น ควรมีการเพิ่มเติมเกี่ยวกับคณะกรรมการพิทักษ์ระบบคุณธรรมของข้าราชการและพนักงานส่วนท้องถิ่นไว้เพื่อให้บุคลากรสามารถใช้สิทธิในการอุทธรณ์หรือร้องทุกข์ในกรณีที่เกิดความไม่เป็นธรรมแก่ข้าราชการและพนักงานเทศบาลขึ้น ซึ่งคณะกรรมการพิทักษ์ระบบคุณธรรมนี้จะช่วยลดคดีความที่จะนำขึ้นสู่ศาลปกครองได้

This independent study on “Decentralization of Personnel Management to Municipalities in Case of Provincial Municipal Employee Committees” aims to (1) study concepts, principles and theories on decentralization to local government; (2) study principles on decentralization of personnel management to municipalities in case of provincial municipal employee committees together with legal problems in implementing them; (3) propose recommendation in relation to decentralization of personnel management to municipalities in case of provincial municipal employee committees. This study is a qualitative research by using documentary research methodology to collect data from articles, textbooks, judgments of courts, and the related laws and regulations. The result of study is that, although the Constitution of the Kingdom of Thailand significantly provides legal frameworks for decentralization for local governments including personnel management, it is suggested that there should have additional statutory provisions to improve the Personnel Management for Local Administration Act B.E. 2542 regarding provincial municipal employee committee by increasing ratio of local component. In particular, the permanent secretary of each local administrative organization should have a seat on such employee committee to reflect participation of the local in respect of local personnel management with an aim to respond to local community needs in accordance with the principles of decentralization for local government. Moreover, there should also have the merit system protection committee for local officials and employees in order that local personnel can exercise their right to file an appeal or a complaint when they have experienced unfair treatment or matters. This merit system protection committee can considerably screen the dispute before being filed to the Administrative Court.
