Abstract
การศึกษาค้นคว้าอิสระฉบับนี้จัดทำขึ้นโดยมีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นมาและแนวคิด ทฤษฎี เกี่ยวกับการกันบุคคลไว้เป็นพยานในคดีอาญา โดย (2) ศึกษาถึงหลักเกณฑ์ หรือขอบเขตของการใช้ดุลพินิจของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ ในการเลือกบุคคลที่จะได้รับการกันไว้เป็นพยาน การยกเลิกกระบวนการรกันบุคคลไว้เป็นพยาน คุณค่า ในเชิงพิสูจน์ข้อเท็จจริงของพยานที่มาจากกระบวนการกันบุคคลไว้เป็นพยาน และกระบวนการควบคุมตรวจสอบถ่วงดุลการใช้ดุลพินิจ โดย (3) ศึกษาเปรียบเทียบหลักเกณฑ์ หรือขอบเขตของการใช้ดุลพินิจกันบุคคลไว้เป็นพยานทั้งของต่างประเทศและหน่วยงานต่างๆ ในประเทศไทย การศึกษาค้นคว้าอิสระฉบับนี้เป็นการวิจัยเชิงคุณภาพ ซึ่งดำเนินการศึกษาค้นคว้า โดยอาศัยวิธีการค้นคว้าและ รวบรวมข้อมูลจากเอกสารต่างๆ ที่เกี่ยวข้อง เช่น ตัวบทกฎหมายต่างๆ ทั้งของไทยและกฎหมายของต่างประเทศ ตำราทางกฎหมาย บทความ รายงานการศึกษา วิทยานิพนธ์ เอกสารราชการ คำพิพากษาฎีกา และแหล่งข้อมูลทางอินเตอร์เน็ต เพื่อทำการเก็บรวบรวม แยกแยะ และวิเคราะห์เพื่อทราบปัญหาและแนวทางปรับปรุงแก้ไขบทบัญญัติของกฎหมายต่อไป จากการศึกษาพบว่า (1) หลักเกณฑ์ หรือขอบเขตของการใช้ดุลพินิจในการเลือกบุคคลที่จะได้รับการกันไว้เป็นพยานของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาตินั้น ยังไม่รัดกุมชัดเจน (2) เนื่องจากไม่ได้กำหนดให้มีการยกเลิกกระบวนการกันบุคคลเป็นพยานไว้ (3) หลักเกณฑ์ในการคุ้มกันของประเทศสหรัฐอเมริกา มีหลักเกณฑ์การใช้ดุลพินิจในการคัดเลือกที่ละเอียดที่สุด โดยคำนึงถึงความเพียงพอของพยานหลักฐานและที่สำคัญมีการพิจารณาให้ความคุ้มกัน โดยคัดเลือกผู้กระทำความผิดจากสัดส่วนของการกระทำความผิด ความน่าเชื่อถือของพยาน และความคาดหมายว่าพยานจะสามารถเบิกความอันเป็น ประโยชน์แก่คดีได้รวมถึงประโยชน์ที่สังคมจะได้รับด้วย สำหรับประเทศอังกฤษ จะมีขอบเขตการใช้ดุลพินิจที่กว้างกว่าประเทศสหรัฐอเมริกาโดยคำนึงถึงความเพียงพอของพยานหลักฐานและประโยชน์แห่งความยุติธรรม รวมถึงประโยชน์แห่งความปลอดภัย ของสังคมส่วนรวม และการได้รับข่าวสารมีความสำคัญมากกว่าการลงโทษบุคคลผู้กระทำหรือมีส่วนร่วมในการกระทำความผิดนั้น ก็ให้มีการคุ้มกันจากการถูกฟ้องร้องคดีได้ นอกจากนี้ เมื่อศึกษาเปรียบเทียบหลักเกณฑ์การกันบุคคลไว้เป็นพยานในประเทศไทย จะพบว่าหลักเกณฑ์ในการใช้ดุลพินิจคัดเลือกบุคคลไว้เป็นพยานของพนักงานอัยการจะมีขอบเขตในการใช้ดุลพินิจที่แคบที่สุด โดยกำหนดให้เลือกผู้กระทำความผิดน้อยที่สุดไว้เป็นพยาน โดยจะต้องคำนึงว่าคำให้การของผู้ถูกกันไว้เป็นพยานนั้นว่าจะเป็นความสัตย์จริงและจะเป็นประโยชน์แก่คดีโดยแท้จริง สำหรับพนักงานสอบสวน จะใช้ในคดีที่มีเหตุพิเศษ มีความยุ่งยากสลับซับซ้อนร้ายแรง คนจำนวนมากพากันเกรงกลัว คดีที่เกิดขึ้นในที่ลี้ลับ โดยบุคคลอื่นไม่สามารถรู้เห็นได้นอกจากเป็นผู้กระทำผิดด้วยกัน หรือคดีที่มีการกระทำในรูปขบวนการ สำหรับคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ (คณะกรรมการ ป.ป.ช.) และคณะกรรมการป้องกันและปราบปรามการทุจริตในภาครัฐ (คณะกรรมการ ป.ป.ท.) จะพิจารณาถึงพยานหลักฐานที่มีอยู่ว่าเพียงพอที่จะดำเนินคดีกับผู้กระทำความผิดที่เป็นตัวการสำคัญหรือไม่ และพยานจะต้องไปเบิกความต่อศาลตามที่ให้การไว้เท่านั้น ดังนั้นผู้ศึกษาเห็นว่า ควรมีการกำหนดหลักเกณฑ์ หรือกรอบการพิจารณาการกันบุคคลไว้เป็นพยานให้ชัดเจนมากขึ้น รวมถึงให้มีกระบวนการสำหรับยกเลิกการใช้มาตรการการกันบุคคลไว้เป็นพยาน เพื่อให้การใช้ดุลพินิจของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติในการเลือกบุคคลที่จะได้รับการกันไว้เป็นพยาน เป็นไปด้วยความบริสุทธิ์ ยุติธรรมอย่างแท้จริง และเพื่อมิให้เป็นที่ครหาได้ว่าเป็นการเลือกปฏิบัติอย่างไม่เป็นธรรม.
The objective for preparing this independent study is (1) to study the background, concepts, and theories of taking of the person as witness in criminal case, (2) to study the rule or scopes for the NACC’s use of discretion in selecting the person who will be taken as witness, cancellation of the process on taking of the person as witness, the value in term of proof of the witness’ fact derived from the process on taking of the person as witness, and the process on control, verification, and balance of the use of discretion, and (3) to conduct a comparative study on the rule or scope for the use of discretion in taking of the person as witness by both foreign agencies and Thailand agencies. This independent study is a qualitative research. The study was conducted using data searching and collection method from the related documents, such as articles of law both of Thailand and foreign countries, law textbooks, articles, studying papers, thesis, white papers, petition sentences, and sources of internet data, for collection, identification, and analysis to be aware of problems, and improvement and corrective guidelines of the positive law accordingly. The finding from the study indicated that: (1) the rule or scope for the NACC’s use of discretion in selecting the person who will be taken as witness has not yet been obviously concise,(2) due to non-determination on cancellation of the process on taking of the person as witness, (3) The United States immunity rules have the most thorough criteria in the selection process considering the sufficiency of the evidence, and more importantly, considering the immunity by selecting the perpetrators from the proportion of the offenses, the credibility of the witness, and the expectation that the witness will be able to testify that is beneficial to the case, including the benefits that society will receive. For England, it has a wider scope of discretion than the United States, concerning the sufficiency of the evidence and the benefit of justice. Including the benefits of the safety of the whole society and getting information is more important than punishing a person who has committed or participate in the offense so that they can be protected from prosecution. Besides, when studying and comparing the rule or scopes use of discretion in selecting the person who will be taken as witness in Thailand, it was found that the criteria for using the discretion to select a person as a witness for the prosecutor had the narrowest scope of discretion that the minimum of offenders to be selected as witnesses. It must be considering that the testimony taking of the person as witness is truthful and will benefit the case truly. For the inquiry official will be used in cases that are a special cause and serious complications. Many people fear cases that arise in the mystical place, which other persons cannot see except they are the offenders or a case that has been executed as a movement. The National Anti-Corruption Commission (NACC) and the Public Sector Anti-Corruption Commission (PACC) have similar rules that will be considered. Considering that the available evidence is sufficient to prosecute the principal offender or not Moreover, the witness must go and testify to the court only. Therefore the researcher has deemed appropriate to be available the determination of a clearer rule or framework for considering taking of the person as witness, and establishing the process on cancelling the use of a measure on taking of the person as witness to ensure the NACC’s use of discretion in selecting the person who will be taken as witness on faithfulness and justice basis and a non-scandal as unfair discrimination.
