Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) เพื่อศึกษาความเป็นมาแนวคิดหลักการของกฎหมายเกี่ยวกับองค์กรการกุศลให้บรรลุเป้าหมายความสำเร็จในการทำกุศล (2) เพื่อศึกษาปัญหาของกฎหมายเกี่ยวกับองค์กรการกุศลในประเทศไทยนำไปแก้ไขปัญหาการทำกุศล (3) เพื่อเปรียบเทียบวิเคราะห์ปัญหากฎหมายเกี่ยวกับองค์กรการกุศลของประเทศไทยและต่างประเทศ (4) เพื่อเสนอแนะแนวทางแก้ไขกฎหมายเกี่ยวกับองค์กรการกุศลใช้ภายในประเทศไทย งานวิจัยเรื่องนี้เป็นงานวิจัยทางกฎหมาย โดยการวิจัยเชิงคุณภาพด้วยการศึกษาวิจัยทางเอกสาร รวบรวมค้นคว้าจากประมวลกฎหมาย หนังสือ บทความ ข้อมูลจากอินเทอร์เน็ตที่เกี่ยวกับองค์กรกุศลของประเทศไทยและของต่างประเทศรวมไปถึงวิทยานิพนธ์และสารนิพนธ์ ผลงานวิจัยพบว่า (1) องค์กรการกุศลมีเป้าหมายโน้มน้าวจิตใจให้คนในสังคมช่วยเหลือซึ่งกันและกันลดความเหลื่อมล้ำของคนในสังคมและให้ความยุติธรรมแก่ผู้บริจาคด้วยการคุ้มครองวัตถุประสงค์ของผู้บริจาคที่ได้บริจาคทรัพย์สินนำไปมอบความช่วยเหลือให้แก่ผู้ประสบภัยความทุกข์ยากได้หลุดพ้นจากความทุกข์ยากจนสามารถพัฒนามีชีวิตที่ดีขึ้น (2) การทำโครงการการกุศลระยะสั้น ๆ หรือโครงการกุศลระยะยาวจำเป็นต้องสร้างความน่าเชื่อถือให้เกิดขึ้นแก่ประชาชนตรวจสอบยืนยันความซื่อสัตย์สุจริต (3) การลดขั้นตอนการจดทะเบียนเป็นองค์กรการกุศลสามารถอำนวยความสะดวกแก่องค์กรการกุศลให้ได้รับการรับรองจากรัฐ (4) การควบคุมตรวจสอบองค์กรการกุศลมีความจำเป็นเพื่อปกป้องทรัพย์สินขององค์กรการกุศลไม่ให้เกิดความเสียหายในอนาคต
The research aims to (1) study a conceptual framework law on charities that are currently in use in Thailand (2) to study the issue of legislation on charities to fix problems. (3) to analyze the legal issues relating to charities of Australia (4) to propose amendments to the law c. About a charity for domestic use in Thailand. This research is research legal. The qualitative research with research papers. Code compiled from books, articles and research information on the Internet relating to charitable organizations in Thailand and overseas, including dissertations and theses. Research found that (1) under the Civil and Commercial Code. The law on charity is not enough, can not achieve the necessary solutions charity. (2) making charitable projects, shortterm or long-term charitable project to build credibility to happen to the people of a monitoring program to verify the integrity of charity. (3) reducing the process of registering as a charity is to facilitate the certification of charities. (4) To ensure the proper conduct of charity, it is necessary to protect the assets of the charity not to damage that may occur in the future.
