Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นมาและความสำคัญของปัญหาแนวคิดทฤษฎี และหลักการเกี่ยวกับการกระจายอำนาจทางปกครองและความเป็นอิสระขององค์ปกครองส่วนท้องถิ่น การกำกับดูแลองค์ปกครองส่วนท้องถิ่น เพื่อศึกษาแนวคิดทฤษฎีและหลักกฎหมายเกี่ยวกับการอุทธรณ์คำสั่งทางปกครองขององค์กรปกครองส่วนท้องถิ่นและการกำกับดูแลองค์กรปกครองส่วนท้องถิ่นในประเทศไทยและต่างประเทศ เพื่อวิเคราะห์ปัญหาการพิจารณาอุทธรณ์คำสั่งทางปกครองขององค์กรปกครองส่วนท้องถิ่นโดยศึกษาเปรียบเทียบกฎหมายไทยและกฎหมายต่างประเทศ และเพื่อเสนอแนะแนวทางในการแก้ไขกฎหมายเกี่ยวกับการพิจารณาอุทธรณ์คำสั่งทางปกครองขององค์กรปกครองส่วนท้องถิ่นให้มีความเหมาะสม การค้นคว้าอิสระนี้เป็นการศึกษาเชิงคุณภาพ โดยการศึกษาจากเอกสารตำราหรือเอกสารวิชาการ งานวิจัย วิทยานิพนธ์ บทความและเอกสารที่เกี่ยวกับความเป็นอิสระองค์กรปกครองส่วนท้องถิ่น การกำกับดูแลองค์กรปกครองส่วนท้องถิ่น การอุทธรณ์คำสั่งทางปกครองและสัมภาษณ์ผู้บริหารท้องถิ่นและเจ้าหน้าที่ของรัฐซึ่งรับผิดชอบเรื่องการพิจารณาอุทธรณ์คำสั่งทางปกครองขององค์กรปกครองส่วนท้องถิ่น ผลการศึกษาพบว่าการอุทธรณ์คำสั่งทางปกครองที่ออกตามอำนาจหน้าที่ขององค์กรปกครองส่วนท้องถิ่นโดยแท้ ผู้ว่าราชการจังหวัดซึ่งเป็นผู้กำกับดูแล มีอำนาจพิจารณาอุทธรณ์ก้าวล่วงไปถึงเรื่องความเหมาะสมและการใช้ดุลพินิจของผู้บริหารท้องถิ่น ทำให้ขัดแย้งกับหลักการกำกับดูแลองค์กรปกครองส่วนท้องถิ่น ที่มีอำนาจควบคุมเฉพาะความชอบด้วยกฎหมายเท่านั้น ดังนั้น จึงควรแก้ไขการพิจารณาอุทธรณ์คำสั่งทางปกครองที่ออกตามอำนาจหน้าที่ขององค์กรปกครองส่วนท้องถิ่นโดยแท้ โดยกำหนดให้ผู้กำกับดูแลมีอำนาจพิจารณาอุทธรณ์เฉพาะความชอบด้วยกฎหมายและหากเห็นว่าคำสั่งทางปกครองนั้นไม่ชอบด้วยกฎหมายให้มีอำนาจฟ้องต่อศาลปกครองเพื่อเพิกถอนคำสั่งทางปกครองเท่านั้น แต่ในกรณีที่เป็นการอุทธรณ์คำสั่งทางปกครองในเรื่องอื่นๆที่ไม่เกี่ยวกับความชอบด้วยกฎหมาย ควรกำหนดให้ยื่นคำอุทธรณ์ต่อผู้บริหารท้องถิ่นเมื่อผู้บริหารท้องถิ่นพิจารณาอุทธรณ์แล้วให้เป็นที่สุด
The objectives of this Independent Study are to study the background, principle and theory of administrative decentralization, study the autonomy and supervision of local governments and the consideration of appeal against administrative orders of local governments, and to analyze problems on consideration of appeal against administrative orders of local governments by comparing Thai and foreign legal principle to provide recommendation for improvement. This study is a qualitative, documentary study with collection and analysis of related legal textbooks, research, thesis, articles and documents on judicial autonomy of local government administrative organization and principle of appeal against administrative orders. Interview of local administrators and administrative officials who are responsible for consideration of appeal against administrative orders was also conducted. It is found that in case of an appeal against an administrative order that has been truly issued by authority of local governments according to their autonomy, the governor of each province who supervises the consideration is authorized to consider the justification of the appeal as well as to overrule the decision of local administrators. This conflicts with the principle of local autonomy by which a governor is authorized to appeal only in case of legitimacy of an administrative order. It is therefore recommended to amend the principle of appeal against an administrative order that has been truly issued by authority of local governments according to their autonomy to authorize the supervisor to consider an appeal only in case of legitimacy of an order; whereas, in the case where the supervisor considers that an order is illegitimate, he is authorized to submit the case to the administrative court to withdraw such order. For other appeals that are not related to the legitimacy of administrative order, it is recommended to be submitted for local administrator’s consideration whose judgment is deemed final.
