การเพิ่มโทษในความผิดฐานฆ่าผู้ประกอบวิชาชีพพิเศษ

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาความเป็นมาแนวคิดและทฤษฎีที่เกี่ยวกับการเพิ่มโทษในความผิดฐานฆ่าผู้ประกอบวิชาชีพพิเศษ (2) ศึกษาหลักกฎหมายเกี่ยวกับการเพิ่มโทษในความผิดฐานฆ่าผู้ประกอบวิชาชีพพิเศษตามกฎหมายไทยและสาธารณรัฐฝรั่งเศส สาธารณรัฐฮังการีและสหรัฐอเมริกา (3) วิเคราะห์ปัญหากฎหมายเรื่องการเพิ่มโทษในความผิดฐานฆ่าผู้ประกอบวิชาชีพพิเศษตามกฎหมายไทยเปรียบเทียบกับสาธารณรัฐฝรั่งเศส สาธารณรัฐฮังการีและสหรัฐอเมริกา (4) เสนอแนะแนวทางในการแก้ไขเพิ่มเติมบทบัญญัติของกฎหมายให้ชัดเจนในเรื่องการฆ่าผู้ประกอบวิชาชีพพิเศษ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพโดยค้นคว้าและรวบรวมข้อมูลจากเอกสารเป็นหลัก โดยศึกษาจากตำรากฎหมาย เอกสารทางกฎหมาย วิทยานิพนธ์ วารสาร บทความ รวมถึงข้อมูลข่าวสารทางสื่ออิเล็กทรอนิกส์ โดยศึกษาจากเอกสารที่เป็นภาษาไทยและต่างประเทศ เพื่อรวบรวมข้อมูลมาทําการศึกษาวิเคราะห์และเรียบเรียงอย่างเป็นระบบ ผลการศึกษาพบว่า (1) แนวคิดและทฤษฎีการเพิ่มโทษในความผิดฐานฆ่าผู้ประกอบวิชาชีพพิเศษของไทยกับต่างประเทศมีความแตกต่างกัน (2) กฎหมายต่างประเทศมีการบัญญัติความผิดฐานฆ่าผู้ประกอบวิชาชีพพิเศษไว้อย่างชัดแจ้ง โดยบัญญัติไว้ว่าวิชาชีพใดบ้างที่ควรได้รับความคุ้มครองเป็นพิเศษในความผิดฐานฆ่าผู้อื่นซึ่งมีอัตราโทษสูงสุดแตกต่างจากการฆ่าบุคคลทั่วไป (3) เมื่อนำมาเปรียบเทียบกับกฎหมายไทยพบว่าตามกฎหมายไทยยังไม่มีการบัญญัติคุ้มครองผู้ประกอบวิชาชีพพิเศษเหล่านี้ไว้ ทั้งที่วิชาชีพผู้พิพากษา ครูอาจารย์และบุคลากรทางการศึกษา ล้วนเป็นวิชาชีพสำคัญที่ไม่ได้มุ่งแสวงหากำไรและต้องอาศัยความรู้ความสามารถอย่างสูง แต่กลับไม่ได้รับความคุ้มครองจากกฎหมายเท่าที่ควร โดยปรากฏเป็นข่าวอยู่เสมอว่าผู้ประกอบวิชาชีพพิเศษเหล่านี้ ถูกฆ่าอยู่เป็นประจำ จนสร้างความหวาดกลัวให้แก่สังคมส่วนรวมและชุมชน เนื่องจากกฎหมายอาญาของไทยไม่ได้ให้ความคุ้มครองอย่างเพียงพอ (4) สมควรให้มีการแก้ไขเพิ่มเติมบทบัญญัติแห่งประมวลกฎหมายอาญาให้มีการเพิ่มโทษในความผิดฐานฆ่าผู้ประกอบวิชาชีพพิศษ เพื่อคุ้มครองบุคคลผู้ประกอบวิชาชีพที่มีความสำคัญและกระทำเพื่อสังคมส่วนรวมเหล่านี้ อีกทั้งยังเป็นการทำให้กฎหมายอาญาของไทยมีความทัดเทียมอารยประเทศ

The objectives of this independent study are (1) to study concept and theories regarding on increased penalty in offences of special vocation murdering, (2) study legal principles regarding on increased penalty in offences of special vocation murdering underneath Thailand Penal Code, French Penal Code, Hungarian Criminal Code and American Criminal Law (3) analyze law problems about increased penalty in offences of special vocation murdering compare Thailand Penal Code with French Penal Code, Hungarian Criminal Code and American Criminal Law , (4) and propose to amend criminal law about increased penalty in offences of special vocation murdering This independent study is a qualitative research by using a documentary research method from legal textbooks, articles, thesis, journals including information from the electronic sources both in English and Thai languages for the analysis and compilation. Results of the study showed that (1) the concepts and theories on increased penalty in offences of special vocation murdering underneath Thailand Penal Code is different from international law, (2) because the international law legislate on the increased penalty in offences of special vocation murdering which has higher punishment than ordinary murdering, (3) when compare with Thailand Penal Code which doesn’t legislate about this, considering to about these special vocations; judge, teacher and educational personnel are important vocation in Thailand as same as foreign, but in Thailand these special vocations are not be protected on offences of special vocation murdering that bring scare to society. Moreover, these situations are be regarded as big problem for protecting these important careers in our society, but they don’t have enough protection from Thailand Penal Code. (4) All of these reasons, in the view as proper to amend Thailand Penal Code on increased penalty in offences of special vocation murdering for protecting these special vocations and adapting Thailand Penal Code to equal international law.
