Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี ที่เกี่ยวข้องกับการดำเนินคดีอาญาและการสอบสวนคดีอาญา เพื่อศึกษาหลักเกณฑ์ ปัญหา และวิเคราะห์ปัญหา การสอบสวนและสั่งคดีในชั้นสอบสวนของตำรวจกับพนักงานอัยการกับเสนอแนวทางในการแก้ไข เพิ่มเติมบทบัญญัติกฎหมายในเรื่องที่เกี่ยวกับการสอบสวนของตำรวจกับพนักงานอัยการ เนื่องจากองค์กรตำรวจเป็นต้นธารของกระบวนการยุติธรรมทางอาญา เมื่อมีการกระทำความผิดอาญาเกิดขึ้น เจ้าพนักงาน ตำรวจที่เข้ามาเกี่ยวข้อง คือพนักงานสอบสวนเป็นผู้รวบรวมพยานหลักฐานที่จะใช้พิสูจน์ความผิดหรือความบริสุทธของผู้กระทำความผิด เมื่อพนักงานสอบสวนเห็นว่าการสอบสวนเสร็จจะทำความเห็นควรสั่งฟ้องหรือสั่งไม่ฟ้องแล้วส่งความเห็นพร้อมสำนวนการสอบสวนไปยังพนักงานอัยการเพื่อสั่งคดี การแจ้งข้อหาของพนักงานสอบสวนที่ไม่ถูกต้องกับข้อเท็จจริงและข้อกฎหมาย ย่อมส่งผลให้การยื่นฟ้องของพนักงานอัยการผิดพลาดคลาดเคลื่อนต่อข้อเท็จจริงและข้อกฎหมายเป็นผลเสียต่อการอำนวยความยุติธรรมในทางอาญา สอดคล้องกับทฤษฎี “ต้นไม้เป็นพิษ ผลย่อมเป็นพิษ” ดังนั้น ควรให้พนักงานอัยการมีอำนาจทำการสอบสวนใหม่ได้ด้วยตนเอง หรือสั่งให้พนักงานสอบสวนทำการสอบสวนตามที่พนักงานอัยการมีคำสั่ง หรือให้เป็นดุลพินิจของพนักงานอัยการที่จะทำการสอบสวนด้วยตนเอง โดยให้พนักงานอัยการเป็นผู้ควบคุมการสอบสวน และให้พนักงานอัยการเป็นผู้รับผิดชอบทำการสอบสวนและสั่งคดี การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเอกสาร โดยการศึกษาวิเคราะห์ ตำรา บทความหรือเอกสารทางวิชาการ คำพิพากษาศาลฎีกา รายงานผลการวิจัย และข้อมูลจากเอกสารอื่น ทั้งของประเทศไทยและของต่างประเทศ ผลการวิจัยศึกษาพบว่า การสอบสวนโดยพนักงานสอบสวน มีการบิดเบือนข้อเท็จจริง ให้แตกต่างจากความจริง ในหลายประเทศจะให้พนักงานอัยการเข้าไปมีบทบาทในการควบคุม การสอบสวน เห็นว่าควรจะแก้ไขกฎหมายให้พนักงานอัยการมีอำนาจสอบสวนคดีอาญา และให้พนักงานสอบสวนทำการสอบสวนตามคำสั่งของพนักงานอัยการ
A study of problems in this thesis has the objective. To study the problem and analyze the problem of investigation and making prosecution decisions in the police investigation and the prosecutor. Proposed amendments to the provisions of the law regarding the investigation of the police and the prosecutor. Because the police organization is the beginning process of criminal justice. When a criminal offense occurs, the police officer was involved and investigating officer shall collects every evidence to prove guilty or innocent of the offender. When the investigating officer concludes that the investigation is completed, he or she should make the opinion to file or not to file the cases and delivered the investigation files to the prosecutor in order to making prosecution decisions. Informing the fact or the charge unlawfully by inquiry officer may affect the prosecutor to make prosecution decisions. As a consequence of the unlawfully informing, criminal justice system may affect as the doctrine of the " Fruit of the poisonous Tree”. Therefor the prosecutor should have the power to commence a new investigation process on his/her behalf. It should allow the prosecutor to order the inquiry officer to investigate as the prosecutor request. The prosecutor may use their own discretion to investigate by themselves and allow the prosecutor to play as supervisor of investigate process. The prosecutor should responsible for investigating and ordering the case. This independent study is a qualitative research with document research. By analyzing texts. Articles or academic papers Judgment of the Supreme Court Research Report And information from other documents. Both of Thailand and abroad. The study found that. Investigation process by the inquiry officer, in many countries, prosecutors have a role to join in investigating. It should be amended to allow the prosecutor to investigate criminal cases. The inquiry officer shall conduct the investigation under supervision of the prosecutor.
