Abstract
การวิจัย เรื่อง การรับฟังพยานหลักฐานทางนิติวิทยาศาสตร์กรณีรอยฝ่าเท้าที่ไม่ปรากฏรอยลายเส้น มี วัตถุประสงค์เพื่อ (1) ศึกษาแนวคิด ทฤษฎีและความหมายเกี่ยวกับการได้มาและการรับฟัง พยานหลักฐานทางนิติวิทยาศาสตร์ กรณีรอยฝ่าเท้าที่ไม่ปรากฏรอยลายเส้น (2) ศึกษาหลักการทางกฎหมายใน การรับฟังพยานหลักฐานทางนิติวิทยาศาสตร์ กรณีรอยฝ่าเท้าที่ไม่ปรากฏรอยลายเส้นจากกฎหมายต่างประเทศ กับกฎหมายของประเทศไทยที่บังคับใช้ในปัจจุบัน (3) วิเคราะห์ปัญหาและอุปสรรคทางกฎหมายในการรับฟัง พยานหลักฐานทางนิติวิทยาศาสตร์ กรณีรอยฝ่าเท้าที่ไม่ปรากฏรอยลายเส้นในประเทศไทย (4) นำผลการศึกษา มาจัดทำข้อสรุปและข้อเสนอแนะในการปรับปรุงแก้ไขบทบัญญัติของกฎหมายเกี่ยวกับการรับฟัง พยานหลักฐานทางนิติวิทยาศาสตร์ กรณีรอยฝ่าเท้าที่ไม่ปรากฏรอยลายเส้นเพื่อใช้เป็นแนวทางในการตรวจ พิสูจน์สำหรับประเทศไทย การวิจัยนี้ เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยเอกสาร อันได้แก่ ประมวลกฎหมายวิธีพิจารณา ความอาญา พระราชกฤษฎีกา ระเบียบ คำสั่งที่เกี่ยวข้อง ผลงานวิจัย หนังสือ ตำรา บทความ รายงานการศึกษา วิทยานิพนธ์ ข้อมูลจากเครือข่ายอินเตอร์เน็ตทั้งของประเทศไทยและต่างประเทศ รวมถึงการศึกษาคดีที่เกิดขึ้น จริงและการสัมภาษณ์ผู้เกี่ยวข้อง แล้วนำข้อมูลที่ได้มาทำการวิเคราะห์เพื่อนำไปสู่ผลการวิจัยผลการศึกษาวิจัย พบว่า รอยฝ่าเท้าทั้งที่ปรากฏรอยลายเส้นและไม่ปรากฏรอยลายเส้นเป็นพยานหลักฐานที่ตรวจพบได้ง่ายใน สถานที่เกิดเหตุ สามารถตรวจพิสูจน์เพื่อยืนยันเอกลักษณ์บุคคลได้จากความจริงสองประการ คือ ลายนิ้วมือ ฝ่ามือ ฝ่าเท้าของแต่ละบุคคลไม่เหมือนกัน มีลักษณะพิเศษเฉพาะแตกต่างกันไปและไม่เปลี่ยนแปลงตั้งแต่เกิดจนตาย การนำลายนิ้วมือฝ่ามือ ฝ่าเท้ามาใช้ในการตรวจพิสูจน์เอกลักษณ์บุคคลจึงเป็นที่ยอมรับของนานาอารยประเทศทั่วโลก แต่จากการศึกษาพบว่า ในประเทศไทยยังขาดการให้ความสนใจวิธี การตรวจพิสูจน์ เอกลักษณ์บุคคลด้วยรอยฝ่าเท้าที่ไม่ปรากฏรอยลายเส้น วิทยานิพนธ์ฉบับนี้จึงเสนอแนวทางให้มีการแก้ไข เพิ่มเติมบทบัญญัติกฎหมายวิธีพิจารณาความอาญา มาตรา 132/1, 226, 243 และ 244/1 การจัดตั้งองค์กร ตรวจสอบและควบคุมมาตรฐานการปฏิบัติงานด้านนิติวิทยาศาสตร์ การกำหนดให้มีผู้ตรวจพิสูจน์รอยฝ่าเท้าที่ ไม่ปรากฏรอยลายเส้นเพื่อทำหน้าที่เบิกความเป็นพยานผู้เชี่ยวชาญในชั้นศาล วิธีการป้องกนและเก็บรักษารอยฝ่าเท้าที่ไม่ปรากฏรอยลายเส้นอย่างมีมาตรฐานตามกฎลูกโซ่แห่งการครอบครองวัตถุพยาน ซึ่งจะทำให้การสืบสวนสอบสวนมีประสิทธิภาพมากขึ้น ตลอดจนเป็นพยานหลักฐานสำคัญที่จะใช้สนับสนุน หักล้างการ พิสูจน์ข้อเท็จจริงต่างๆ อันเป็นการสร้างความบริสุทธิ์ยุติธรรมให้เกิดขึ้นแก่ทุกฝ่ายตามกระบวนการยุติธรรม ต่อไป
The purposes of this study were (1 ) to study the concepts, theories,definitions, and the source of the law that relate to the acceptance of forensic science evidence in case of bare-foot impressions.; (2) to study the legal principles in the acceptance of forensic science evidence in case of bare-foot impressions from international law and the inforce Thai laws.; (3 ) to analyze the legal problems in the acceptance of forensic science evidence in case of bare-foot impressions.; and (4 ) to summarize conclusions and recommendations in order to amend the provision that regarding the acceptance of forensic science evidence in case of bare-foot impressions as use to examine the verification in Thailand. This research is a qualitative study by examining Criminal Procedure Code, ordinance, regularity, command, research, textbooks, articles, research reports, thesis, and the other sources from the internet information both Thai and abroad. Besides, these involve the actual case studies and the interviews with relevant person. All above are analyzed and synthesized so as to acquire research outcomes. The study suggested that both bare-foot impressions that appear with the line and no visible markings are evidences that can be easily detected at the crime scene. These can be used to verify that a person's identity is based on two facts as the fingerprints and soles of the feet are individual. They are uniqueness. The fingerprints and bare-foot do not change between life. The civilized country has accepted this bare feet testimony for several time. In according to study, it has been found that there is no attention in the principle of identifying individual people with bare-foot impressions. This thesis proposes the amendment provision of Criminal Procedure Code in section 132/1, 226, 243 and 244/1. To organized the inspected organization and the standard rules of forensic practices. There for should be noted the bare-foot inspector and the requirements with the specification for the expert witness to testify in case. To protect and preserve of footprints in according to the chain of custody rule. These will lead to extricate in effective investigation as well as the most important evidence that support or disprove the facts. In order to find fairness of justice for litigant in accordance with the justice procedure.
