Abstract
งานวิจัยเรื่องนี้มีวัตถุประสงค์เพื่อศึกษาการออกคำสั่งของนายกรัฐมนตรี กำหนดมาตรการ เพื่อแก้ไขและป้องกันภาวะการขาดแคลนน้ำมันเชื้อเพลิงกฎหมายการใช้เชื้อเพลิงชีวภาพของประเทศฟิลิปปินส์ และกฎหมายการสำรองน้ำมันทางยุทธศาสตร์ของประเทศญี่ปุ่น เพื่อนำผลการศึกษามาวิเคราะห์เปรียบเทียบกับร่างพระราชบัญญัติกองทุนน้ำมันเชื้อเพลิง พ.ศ. .... เพื่อเป็นแนวทางพัฒนากฎหมายวาด้วยการแก้ไขและป้องกัน ภาวะการขาดแคลนน้ำมันเชื้อเพลิง วิทยานิพนธ์นี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเอกสารโดยทำการศึกษาค้นคว้าข้อมูลจาก หนังสือ บทความ วารสาร รายงานการวิจัย วิทยานิพนธ์ คำวินิจฉัยศาลรัฐธรรมนูญ คำพิพากษาหรือคำสั่งศาล ปกครองสูงสุด คำพิพากษาศาลฎีกา ทั้งในห้องสมุดรัฐสภา และข้อมูลอิเล็กทรอนิกส์ต่างๆ ผลการวิจัยพบว่า พระราชกำหนดแก้ไขและป้องกันภาวะการขาดแคลนน้ำมันเชื้อเพลิง พ.ศ. 2516 มีความมุ่งหมายเพื่อจะรักษาไว้ ซึ่งความมั่นคงในทางเศรษฐกิจของประเทศ เหมือนกับรัฐกำหนดจัดสรรปันส่วน น้ำมันเชื้อเพลิง ค.ศ. 1973 ของประเทศสหรัฐอเมริกา โดยลักษณะของบทบัญญัติมาตรา 3 ของพระราชกำหนดนี้ ให้นายกรัฐมนตรีมีอำนาจออกคำสั่ง โดยมีขอบเขตอย่างกว้าง ไม่จำเป็นต้องปฏิบัติตามกฎหมายที่มีอยู่ และให้ใช้บังคับมีกำหนดหนึ่งปี เมื่อมีการแก้ไขเพิ่มเติมให้บังคับได้ เช่นเดียวกับบทบัญญัติแห่งกฎหมายทั่วๆ ไป บทบัญญัติที่ไม่มีเกณฑ์หรือข้อจำกัดใดๆ ทำให้การออกคำสั่่งเพื่อกำหนดมาตรการ ซึ่งเป็นการกระทำทางปกครองประเภทออกกฎหรือตรากฎหมายลำดับรองสามารถกำหนดเงื่อนไขอย่างใดก็ได้ คือการให้คณะกรรมการมีอำนาจต่างๆ การตั้งพนักงานเจ้าหน้าที่ การห้ามร้านค้าจำหน่ายน้ำมันเชื้อเพลิง และการปิดสถานบริการเพื่อประหยัดไฟฟ้า ผู้ฝ่าฝืนหรือไม่ปฏิบัติตามคำสั่งของนายกรัฐมนตรีเป็นความผิดอาญาซึ่งศาลฎีกาลงโทษตามพระราชกำหนดนี้ด้วย ถึงแม้ว่า ผู้ตรวจการแผ่นดินจะเห็นว่า คำสั่งนายกรัฐมนตรี ที่ 4/2547 เรื่อง กำหนดมาตรการเพื่อแก้ไขและป้องกันภาวะการขาดแคลนน้ำมันเชื้อเพลิง ลงวันที่ 23 ธันวาคม 2547 ที่ให้คณะกรรมการมีอำนาจหน้าที่กำหนดอัตราเงิน ส่งเข้ากองทุน หรือกำหนดอัตราเงินชดเชย อาจเป็นการไม่ชอบด้วยพระราชบัญญัติเงินคงคลัง พ.ศ. 2491 ก็ตาม เมื่อไม่มีการฟ้องคดีต่อศาลปกครองขอให้เพิกถอนกฎฉบับนี้ และองค์กรผู้ทรงอำนาจก็ไม่มีการยกเลิกคำสั่งนี้ ดังนั้น ต้องถือว่าคำสั่งของนายกรัฐมนตรีดังกล่าวชอบด้วยกฎหมายสามารถบังคับต่อเนื่องไปได้ อย่างไรก็ตาม เพื่อไม่ให้เกิดปัญหาอีก ผู้วิจัยจึงเสนอให้ปรับปรุงแก้ไขพระราชกำหนดนี้ และในร่างพระราชบัญญัติกองทุน น้ำมันเชื้อเพลิง พ.ศ. .... คณะกรรมการควรจะมีอำนาจเฉพาะการรักษาเสถียรภาพระดับราคาน้ำมันเชื้อเพลิง และ การสนับสนุนราคาเชื้อเพลิงชีวภาพ ควรแยกเป็นกฎหมายเฉพาะเหมือนประเทศฟิลิปปินส์ เช่นเดียวกับการสำรองน้ำมันทางยุทธศาสตร์ ควรมีกฎหมายเฉพาะเหมือนประเทศญี่ปุ่น เพื่อประโยชน์ของรัฐ ประชาชน และผู้บริโภค
The objective of this thesis is to study and analyze the order of Prime Minister regarding corrective and preventive actions for oil shortages, the Philippines Biofuel Act and the Japan Strategic Petroleum Reserves Law. This study is compared with the Fuel Oils Fund Act B.E. … and will be used as a guideline for solving and preventing fuel oil shortages This is qualitative legal research which is based on document research. The data was collected from text books, articles, journals, reports, theses, information on the Internet, the Constitutional Court rulings, judgments or writs of the Supreme Administrative Court, Supreme Court judgments and relevant laws from the National Assembly Library of Thailand. The research found that the Emergency Decree on Remedy and Prevention of Shortage of Fuel Oil B.E. 2516 was meant to maintain national economic security, which is similar to the USA Petroleum Allocation Act of 1973. In accordance with Section 3 of this decree, the Prime Minister has the power to issue orders without boundaries and abide by the law. The Emergency Decree shall come into operation for a period of one year and the amendment of the Emergency Decree is enforceable in the same way as laws in general. The legislations which do not limit any criteria or restriction making measures can be issued without conditions such as appointment the authorized committee, appointment the authorized officer, banning the gas station to supply oil, and closing the gas station for saving electricity. The person who violates the order of Prime Minister shall be liable to imprisonment as defined in section 8 of this emergency decree. Although the ombudsman found that the order of the Prime Minister no. 4/2547 on measurement of remedy and prevention of shortage of fuel oil dated on 23 December B.E. 2547 which empowered committee to rate the circulating fund and compensation was illegal and not abide by the Treasury Balance Act B.E. 2491, the order of Prime Minister is still lawful and enforceable if there is no complaints to the Supreme Administrative Court to repeal the discretion and this order is not revocable. However, to avoid repeating problems, the researcher proposes that the Emergency Decree and the Oil Fund Draft Act B.E. … should be amended, namely, the authorized committee should have just a power to make oil refineries, separate the supporting the cost of bio-oil matter to specific statute as the Philippines Act, and also legislate separately the Strategic Petroleum Reserve as Japan law for the great benefit to this state people and customers.
