การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิด ทฤษฎี ความเป็นมาเกี่ยวกับ การลงทัณฑ์แก่ผู้กระทำผิดวินัยทหาร (2) ศึกษาและเปรียบเทียบบทบัญญัติกฎหมายที่เกี่ยวข้องกับการลงทัณฑ์แก่ผู้กระทำผิดวินัยทหารทั้งในประเทศไทย กับ สหรัฐอเมริกา ราชอาณาจักรเดนมาร์ก เครือรัฐออสเตรเลีย (3) วิเคราะห์ปัญหาของมาตรการทางกฎหมายที่เกี่ยวข้องกับการลงทัณฑ์แก่ผู้กระทำผิดวินัยทหารประเทศไทย กับ สหรัฐอเมริกา ราชอาณาจักรเดนมาร์ก เครือรัฐออสเตรเลีย (4) เสนอแนะแนวทางในการพัฒนาปรับปรุงกฎหมายการลงทัณฑ์แก่ผู้กระทำผิดวินัยทหารในประเทศไทยการศึกษาค้นคว้าอิสระนี้เป็นการวิจัยทางนิติศาสตร์ โดยการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยเอกสาร ศึกษาตำรากฎหมาย บทความทางวิชาการ วารสาร ผลงานวิจัย วิทยานิพนธ์ รายงาน พระราชบัญญัติ รวมทั้งตำราและหลักกฎหมายของสหรัฐอเมริกา ราชอาณาจักรเดนมาร์ก เครือรัฐออสเตรเลีย แล้วนำมาวิเคราะห์หาคำตอบและข้อสรุปภายใต้หลักทฤษฎีและหลักกฎหมาย เพื่อนำมาเป็นข้อเสนอแนะแนวทางการปรับปรุงกฎหมายพระราชบัญญัติว่าด้วยวินัยทหาร พุทธศักราช 2476ผลจากการศึกษาพบว่า (1) มีทฤษฎีความยุติธรรม ทฤษฎีดุลยพินิจและทฤษฎีการลงโทษ เพื่อข่มขู่ยับยั้ง ที่สามารถนำมาประยุกต์ใช้ในการลงทัณฑ์แก่ผู้กระทำผิดวินัยทหาร (2) กฎหมายของประเทศไทยมีการลงทัณฑ์เพียง 5 สถาน คือ ภาคทัณฑ์ ทัณฑกรรม กัก ขัง จำขัง ซึ่งแตกต่างจาก สหรัฐอเมริกา ราชอาณาจักรเดนมาร์ก และเครือรัฐออสเตรเลีย ที่มีการลงทัณฑ์ ตัดเงินเดือน จ่ายค่าปรับ ทำงานพิเศษ ลดตำแหน่ง และการปลดจากประจำการหรือถอดยศทหารเป็นอำนาจของศาลไม่ใช่อำนาจของผู้บังคับบัญชา (3) ประเทศไทยยังไม่มีหลักเกณฑ์การลงทัณฑ์ทางวินัยทหารที่แน่ชัด ทำให้เกิดความเหลื่อมล้ำในการใช้ดุลพินิจของผู้บังคับบัญชา (4) ควรเสนอแนะพัฒนาปรับปรุงพระราชบัญญัติว่าด้วยวินัยทหาร พุทธศักราช 2476 และกำหนดหลักเกณฑ์ที่ชัดเจนในการลงทัณฑ์ เพื่อให้เกิดความยุติธรรมและลดความเหลื่อมล้ำในการพิจารณาทางวินัยทหาร
This independent study aims to (1) study the concept, theory, and background of military disciplinary punishment. (2) study and compare legal provisions related to military disciplinary punishment in Thailand and the United States, the Kingdom of Denmark, and the Commonwealth of Australia. (3) analyze the of legal issues concerning military disciplinary punishment in these countries; and (4) propose guidelines for the development and improvement of military disciplinary punishment laws in Thailand. This research employs qualitative methods, focusing on the study of legal textbooks, academic articles, journals, research works, theses, reports, acts, as well as the legal principles of the United States, the Kingdom of Denmark, and the Commonwealth of Australia. The research analyzes the gathered information to provide conclusions and recommendations for improving Thailand’s Military Discipline Act B.E. 2476. The findings are as follows: (1) Theories of justice, discretion, and deterrent punishment can be applied in military disciplinary cases. (2) Thailand’s military discipline law currently provides only five forms of punishment: reprimand, correction, detention, imprisonment and confinement. In contrast, the United States, Denmark and Australia, include additional measures such as salary deductions, fines, part-time work, demotion and discharge, which are administered by the court, rather than the commanding officer. (3) Thailand lacks clear criteria commanding officers. (4) The study recommends amending the Military Discipline Act B.E. 2476 to include clear guidelines punishment to ensure fairness and reduce inequalities in military disciplinary proceedings.
