Abstract
การวิจัยเรื่องการใช้วิธีการควบคุมผู้กระทําผิดด้วยเครื่องมืออิเล็กทรอนิกส์ (EM) แทนการจําคุกใน เรือนจํา มีวัตถุประสงค์เพื่อ 1) ศึกษาทฤษฎีและรูปแบบการลงโทษ และหลักการคุมขังผู้กระทําผิดโดยไม่ใช้เรือนจํา 2) วิเคราะห์แนวคิดหลักการ และบทบัญญัติกฎหมายต่างประเทศว่าด้วยการควบคุมผู้กระทําผิดโดยใช้เครื่องมือ EM 3) วิเคราะห์การควบคุมผู้กระทําผิดด้วยเครื่องมือ EM ในกฎหมายไทยเปรียบเทียบกับต่างประเทศ และ 4) หาแนวทางที่เหมาะสมปรับปรุงกฎหมายและออกแบบระเบียบของกระทรวงยุติธรรมไทยเพื่อนําเครื่องมือ EM มาใช้แทนการจําคุก อย่างเต็มรูปแบบ งานวิจัยเรื่องนี้เป็นการวิจัยทางกฎหมาย ด้วยวิธีการเชิงคุณภาพ โดยการรวบรวมบทบัญญัติเกี่ยวกับ การควบคุมผู้กระทําผิดด้วยเครื่องมืออิเล็กทรอนิกส์ในประมวลกฎหมายที่เกี่ยวข้อง ตํารา และหนังสือของไทยและ ต่างประเทศ เมื่อรวบรวมเสร็จจะวิเคราะห์เปรียบเทียบกฎหมายไทยกับต่างประเทศ ทั้งในทางทฤษฎีที่เกี่ยวข้อง องค์ประกอบของกฎหมาย และการบังคับใช้กฎหมาย เพื่อจัดทําระเบียบกระทรวงยุติธรรมในการนําเครื่องมือ EM มา ใช้แทนการจําคุก Hผลการวิจัยพบว่า 1) เครื่องมือ EM เป็นหนึ่งในทางเลือกของกระบวนการยุติธรรม โดยมีวัตถุประสงค์ เพื่อฟื้นฟูผู้กระทําผิดเป็นสําคัญ 2) การใช้เครื่องมือ EM ในหลายประเทศทําให้ค่าใช้จ่ายลดลงกว่าวิธีการคุมขัง ผู้กระทําผิดในเรือนจํา และก่อให้เกิดค่าใช้จ่ายที่คุ้มค่าต่อกระบวนการยุติธรรมทางอาญา 3) การควบคุมดูแลจากชุมชน โดยใช้เครื่องมือ EM นี้บ่งชี้ถึงความรับผิดชอบของสังคมต่อการพัฒนาอย่างยังยืน เพื่อแก้ไขปัญหาที่เกิดจากความแออัดในเรือนจํา ลดการถูกตีตราจากสังคมเมื่อถูกจําคุก ทําให้ผู้กระทําผิดได้พัฒนาศักยภาพของตัวเองโดยการประกอบอาชีพ ลดภาระของรัฐบาล สร้างความสัมพันธ์ที่ดีระหว่างสมาชิกในครอบครัว ลดความตึงเครียดของ ผู้กระทําผิดจากการถูกคุมขังในเรือนจํา สร้างสัมพันธภาพที่ดีกับเจ้าหน้าที่เรือนจํา และคืนความสงบสุขปลอดภัย ให้กับชุมชนและสังคม 4) ผลกระทบในเชิงลบของเครื่องมือ EM ก็ยังมีผู้คัดค้านหยิบยกขึ้นมา เช่น ด้านงบประมาณ เครื่องมือ และด้านสิทธิเสรีภาพส่วนบุคคล เป็นต้น 5) การใช้งานเครื่องมือ EM ประเทศต่างๆ ทั่วโลกนํามาใช้ได้ใน 3 ขั้นตอน ได้แก่ก่อนการพิจารณาคดี (Pre-trial Monitoring) ภายหลังการพิจารณาคดี (Post-trial Monitoring) และภายหลัง จําคุกมาระยะหนึ่ง (Post-imprisonment Monitoring)อย่างไรก็ตาม การศึกษานี้มีความแตกต่างจากการศึกษาเกี่ยวกับเครื่องมืออิเล็กทรอนิกส์ในอดีตที่ผ่านมา ที่ศึกษาประเด็นต่างๆ เช่น วิเคราะห์การนําเครื่องมือ EM มาใช้กับการคุมประพฤติผู้กระทําผิดนอกเรือนจํา โดยศึกษาการควบคุมผู้กระทําผิดด้วยอุปกรณ์ EM ของต่างประเทศ แง่มุมทาง กฎหมาย ปัญหาและอุปสรรค ความเป็นไปได้หากนําเครื่องมือ EM มาใช้ในประเทศไทยอย่างเต็มรูปแบบจากผลการศึกษา มีข้อเสนอแนะ 2 ส่วน คือ 1) เสนอแนวทางแก้ไขปัญหา/อุปสรรค โดยปรับปรุงกฎหมายและจัดทําระเบียบ กระทรวงยุติธรรมว่าด้วยแนวทางการใช้เครื่องมืออิเล็กทรอนิกส์เป็นเงื่อนไขอื่นๆ แทนการจําคุกในเรือนจํา เพื่อให้เกิดความชัดเจนยิ่งขึ้นในการบังคับใช้เครื่องมือ และ 2) เสนอแนวทางปฏิบัติรวมถึงการวางแผนและกำหนดเป้าหมาย ที่ชัดเจน เพื่อช่วยลดค่าใช้จ่ายของการใช้เครื่องมือนี้
This research aims to (1) to study the theories and the patterns of criminal sentencing without imprisonment; (2) to analyze approaches, concepts and foreign laws towards the electronic monitoring of offenders; (3) to provide a comparative analysis between Thai laws and foreign laws on surveillance offenders by electronic monitoring; and (4) to find an appropriate approach for applicable laws and regulations implemented by Ministry of Justice using electronic monitoring of offenders in substitution of incarceration. This research was legal research by qualitative methodology research which uses both Thai and international electronic textbooks as well as related publications as source materials. The sources are then comparatively analyzed in regards to international law and Thai law. The results reveal that (1) electronic monitoring is one of the alternative tools used in judicial process significantly for recovering offenders; (2) the establishment of electronic monitoring program in many countries shows that the correctional costs are reduced in comparison to traditional imprisonment, and it also shows the likelihood of effective spending in the process; (3) this community-based surveillance using electronic monitoring indicates a responsibility of society towards sustainable development in solving problems caused by prison overcrowding and alienation. It allows prisoners to develop their potentials for future careers, reduce government’s burden, develop a good relationship in the family members, reduce tensions from being captive in prison, build a positive relationship with prison wardens, and restore peace and safety to community as well as society; (4) the negative effects of electronic monitoring include equipment budget and personal privacy etc. and (5) the implementation of electronic monitoring is divided into three processes; Pre-trial Monitoring, Post-trial Monitoring and Post-imprisonment Monitoring. However, there is a difference between this study and the past studies which focused on other related issues. To illustrate, this study shows the analysis of adopting electronic monitoring program on controlling offenders’ behavior outside prison through the studies of using electronic monitoring of offenders in foreign countries including legal aspects, problems, obstacles and the likelihood of adopting electronic monitoring program in Thailand. Regards to the result of this study, the suggestions are divided into two parts; (1) providing legal solutions by means of legal reform and ministerial regulations for Ministry of Justice to administer electronic monitoring as an alternative condition for incarceration and (2) proposing practical guidelines, potential schemes and explicit objectives in the reduction of costs and spending.
