ปัญหาทางกฎหมายเกี่ยวกับการก่อสร้างอาคารสูง

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดและความเป็นมาของกฎหมายควบคุมอาคารสูง (2) ศึกษาหลักเกณฑ์ทางกฎหมายเกี่ยวกับการควบคุมอาคารสูงที่ส่งผลกระทบต่อการดำรงชีพของบุคคลในระบบกฎหมายไทยและกฎหมายต่างประเทศ (3) ศึกษาเปรียบเทียบการบังคับใช้กฎหมายควบคุมอาคารสูงในประเทศไทยและกฎหมายควบคุมอาคารสูงในต่างประเทศ (4) เพื่อเสนอแนะแนวทางในการแก้ไขปัญหาการบังคับใช้กฎหมายควบคุมอาคารสูงของประเทศไทยให้เหมาะสมต่อสภาพเศรษฐกิจสังคม และสภาพแวดล้อมโดยรวม การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีวิจัยเอกสารโดยศึกษาพระราชบัญญัติควบคุมอาคาร พ.ศ. 2522 กฎกระทรวงฉบับที่ 33 (พ.ศ. 2535) และกฎกระทรวงฉบับอื่นๆ ที่เกี่ยวกับอาคารสูง พระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 พระราชบัญญัติผังเมืองรวม พ.ศ. 2518 และทำการศึกษาถึงระเบียบข้อกฎหมายที่เกี่ยวกับการจัดทำประมวลข้อบังคับอาคารสูง ตลอดจนกฎหมายหรือมาตรการทางกฎหมายเกี่ยวการก่อสร้างอาคารของต่างประเทศ เช่น ประเทศญี่ปุ่น ประเทศสาธาณรัฐฝรั่งเศส และศึกษาจากตำราทางวิชาการของไทยและต่างประเทศรวมไปถึงบทความ วารสาร เอกสาร จุลสาร ระเบียบข้อบังคับ งานวิจัย และวิทยานิพนธ์ที่เกี่ยวข้องกับปัญหาการก่อสร้างอาคารสูง ผลการศึกษาพบว่า (1) มีการนำแนวคิดและทฤษฎีทางกฎหมายที่เกี่ยวกับกฎหมายควบคุมอาคารสูงนำมาใช้เพื่อควบคุมและกำหนดหลักเกณฑ์การสร้างอาคารสูง (2) กฎหมายของไทยมีขึ้นเพื่อคุ้มครองประโยชน์และความปลอดภัยของประชาชนโดยส่วนรวมเป็นสำคัญ โดยเน้นไปที่ความมั่นคงแข็งแรง ความปลอดภัย การป้องกันอัคคีภัย การสาธารณสุข การรักษาคุณภาพสิ่งแวดล้อมของอาคารเป็นหลัก (3) มาตรการในการกำหนดโทษและการลงโทษเกี่ยวกับกรณีการก่อสร้างอาคารโดยไม่ได้รับอนุญาตหรือฝ่าฝืนทำผิดตามกฎหมายต่างประเทศ โดยเฉพาะประเทศสาธาณรัฐฝรั่งเศสมีความรุนแรงและเข้มงวดกว่ากฎหมายของไทย (4) การแก้ไขเพิ่มเติมพระราชบัญญัติควบคุมอาคาร พ.ศ. 2522 โดยเพิ่มหลักเกณฑ์หรือข้อกำหนดเกี่ยวกับการควบคุมอาคารสูงของประเทศไทยจะส่งผลดีต่อสภาพเศรษฐกิจสังคม และสภาพแวดล้อมโดยรวม

This Independent Study aims to (1)study concepts and backgrounds of laws on high-rise control, (2) study legal criteria on high-rise control having impact on individual subsistence in Thai and foreign legal systems, (3) compare and study enforcement of laws on high-rise control in Thailand and laws on high-rise control in foreign countries, and (4) suggest guidelines for problem-solving of enforcement of laws on high-rise control of Thailand as appropriate for overall economic, social, and environmental situations. This Independent Study is a qualitative research based upon documentary research method by studying Hire-rise Control Act B.E.2522 (1979), Ministerial Regulation No. 33 B.E.2535 (1992) and other ministerial regulations in relation to high-rises, National Environment Quality Enhancement and Conservation B.E. 2535 (1992), and City Plan Act B.E.2518 (1975); studying legal rules and regulations as to High-rise Code preparation, as well as laws or legal measures on high-rise construction, such as Japan and Republic of France; and Thai and foreign textbooks, inclusive of articles, journals, papers, pamphlets, rules, regulations, researches, and theses in association with the problems on high-rise construction. According to the Study, (1) legal concepts and theories with respect of laws on high-rise control applied to controlling and providing criteria on high-rise construction, (2) Thai laws were made so as to overall protect people’s interest and security by concentrating on security, safety, fire prevention, public health affairs, and high-rise environment quality conservation, (3) measures on determination of punishment and infliction of punishment in the event of high-rise construction without permission or in violation of foreign laws, in particular Republic of France, were more serious and stricter than Thai laws; and (4)amendment to Hire-rise Control Act B.E.2522 (1979) by adding criteria on or requirements for high-rise control of Thailand was good for overall economic, social and environmental situations
