Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์ เพื่อ (1) ศึกษาถึงแนวคิด ทฤษฎี ความหมาย และหลักการต่าง ๆ ทางกระบวนการยุติธรรมทางอาญา หลักมนุษยชน หลักการคุ้มครองสิทธิ เสรีภาพของประชาชน (2) ศึกษา ถึงมาตรการทางกฎหมายที่เกี่ยวข้องกับการรับฟังพยานหลักฐานที่ได้มาโดยมิชอบ และ (3) วิเคราะห์ปัญหา กฎหมายเกี่ยวกับการใช้ดุลพินิจของศาลเพื่อรับฟังพยานหลักฐานที่ได้มาโดยมิชอบ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพศึกษาจากบทความทางวิชาการ ตำราวิชาการ วิทยานิพนธ์ทางกฎหมาย คำพิพากษา ประมวลกฎหมาย รัฐธรรมนูญ และเว็บไซต์ ต่าง ๆ ที่เกี่ยวข้องกับกฎหมาย ทั้งของประเทศไทยและต่างประเทศ รวมถึงเอกสารทางวิชาการ แนวคิด ทฤษฎี บทความทางกฎหมาย ผลการศึกษา พบว่า (1) หลักมนุษยชน และสิทธิเสรี ภาพขั้นพื้นฐานของประชาชนเป็นสิ่งที่มี ความสำคัญสูงสุดโดยเฉพาะอย่างยิ่งการใช้อำนาจในการแสวงหาพยานหลักฐานในคดีอาญาในปัจจุบัน ฉะนั้น เจ้าพนักงานของรัฐที่เป็นองค์กรผู้ใช้บังคับกฎหมาย ย่อมจะต้องปฏิบัติตามแนวทางภายใต้กรอบและกฎเกณฑ์ ตามที่กฎหมายวางไว้โดยเคร่งครัดเสมอ โดยเฉพาะการใช้อำนาจในการแสวงหาพยานหลักฐานที่ได้กระทำไป โดยมิชอบด้วยกฎหมาย ห้ามมิให้รับฟังพยานหลักฐานชิ้นนั้นเป็นพยานหลักฐานโดยทันที อย่างไม่มีข้อยกเว้น เพื่อเป็นการสร้างมาตรฐานให้เกิดขึ้นในกระบวนการยุติธรรมอีกทั้งเป็นการลดการใช้อำนาจตามอำเภอใจ ของเจ้าหน้าที่ของรัฐ (2) สำหรับในประเทศไทยแม้มีบทบัญญัติที่ไม่ให้รับฟังพยานหลักฐานที่ได้มาโดยมิชอบ ตามประมวลกฎหมายวิธีพิจารณาความอาญามาตรา 226 ก็ตาม แต่ก็มีการออกกฎหมายตามประมวลวิธีพิจารณา ความอาญามาตรา 226/1 ขึ้นมาเพื่อผ่อนปรนการรับฟังพยานหลักฐานที่ได้มาโดยมิชอบนี้ หากจะสามารถพิสูจน์ ความผิดของจ าเลยและสามารถด ารงความยุติธรรมและไม่กระทบต่อมาตรฐานของระบบงานยุติธรรม ศาลก็สามารถ รับฟังพยานหลักฐานที่ได้มาโดยมิชอบนี้ได้ (3) การออกกฎหมายตามประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 226/1 นั้น ส่งผลเสียต่อสิทธิเสรีภาพของประชาชน เนื่องจากเจ้าพนักงานอาจใช้อ านาจโดยมิชอบ กระท าการ โดยไม่คำนึงถึงสิทธิเสรีภาพของประชาชน เพื่อให้ได้ซึ่งพยานหลักฐานที่ตนเองต้องการและเป็นการออกกฎหมาย ขัดต่อรัฐธรรมนูญว่าด้วยหลักสิทธิเสรีภาพ ทั้งขัดต่อหลักมนุษยชนด้วย จึงไม่เห็นควรในการนำถ้อยคำในเรื่อง การอำนวยความยุติธรรม มาตรฐานของระบบงานยุติธรรม ทั้งการแก้ไขเรื่องการนำหลักสิทธิเสรีภาพมาใช้ เป็นเงื่อนไขในการรับฟังพยานหลักฐานที่ได้มาโดยมิชอบของศาล
The objective of this independent research is to (1) study the concepts, theories, meanings, and criminal justice principle, human right principle, and people rights and liberties protection principle, (2) study on the legal measures relating to the inclusionary rule of the unlawfully obtained evidence, and (3) analyze the legal problems relating to an exercise of the judicial discretion on inclusionary rule of the unlawfully obtained evidence. This independent study is a qualitative research through the study from the academic articles, academic textbooks, legal thesis, judgments, code of laws, constitution, and websites relating to both Thai and foreign laws, including the academic papers, concepts, theories, and legal articles. The finding of the studying result indicated that: (1) due to the utmost importance of the human right principle and the fundamental people rights and liberties protection principle particularly in exercise of the power to acquire evidence in the current criminal cases, the state official of the organization which enforces the law must strictly comply with a guideline under the frameworks and rules prescribed by laws on regular basis particularly in exercise of the power to unlawfully acquire evidence. An inclusionary rule of the said piece of evidence is immediately prohibited without exception to standardize the criminal justice and reduce the arbitrary exercise of power by the state officer, (2) in Thailand, despite of the legislation on exclusionary rule of the unlawfully obtained evidence under Section 226 of the Criminal Procedure Code, but the law under Section 226/1 of the Criminal Procedure Code is enacted to alleviate this inclusionary rule of the unlawfully obtained evidence. If a defendant’s offence can be proven and a justice can be sustained without an impact on the standard of the justice system, the court can admit the unlawfully obtained evidence, (3) an enactment of the law under Section 226/1 of the Criminal Procedure Code adversely affects the people’s rights and liberties due to a possible unlawful exercise of power by the official, an act without concern on the people’s rights and liberties in order to acquire the evidence required by him/her, and an enactment of law in conflict both with the constitution on the rights and liberties principle and the human principle. Therefore, it has been improper for applying the words in respect to the justice administration, justice system standard, and revision on the rights and liberties principle, as the court’s condition of the inclusionary rule of the unlawfully obtained evidence.
