Abstract
การศึกษาค้นคว้าอิสระ เรื่อง การศึกษาหาแนวทางที่เหมาะสมในการออกเสียงประชามติท้องถิ่น ตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 มาตรา 287 มีวัตถุประสงค์ 1) เพื่อศึกษาแนวคิด ทฤษฎี และวิวัฒนาการการออกเสียงประชามติท้องถิ่น 2) เพื่อวิเคราะห์ปัญหาการออกเสียงประชามติตามรัฐธรรมนูญ และกฎหมายอื่นที่เกี่ยวข้อง 3) เพื่อวิเคราะห์เปรียบเทียบกฎหมายว่าด้วยการออกเสียงประชามติของประเทศไทยกับของประเทศอังกฤษ และ 4) เพื่อหาแนวทางแก้ไขปรับปรุงกฎหมายว่าด้วยการออกเสียงประชามติท้องถิ่น การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพ โดยการค้นคว้าจากเอกสาร (documentary research) วิทยานิพนธ์ หนังสือ บทความต่าง ๆ และสารสนเทศทางอินเตอร์เน็ต โดยผู้ศึกษาใช้วิธีการเรียบเรียงโดยวิธีพรรณนา (descriptive method) วิธีการเปรียบเทียบ (comparative method) และวิธีวิเคราะห์ (analytical method) ผลการศึกษา พบว่าการออกเสียงประชามติท้องถิ่นของไทยยังไม่มีกฎหมายบัญญัติออกมาบังคับใช้โดยตรง ได้แต่นำพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการออกเสียงประชามติ พ.ศ. 2552 มาปรับใช้ จึงมีบทบัญญัติบางประการที่ไม่สอดคล้องกับบทบัญญัติของรัฐธรรมนูญ และมีความไม่เหมาะสมในการนำมาบังคับใช้กับท้องถิ่น จึงสมควรเสนอให้มีการแก้ไขปรับปรุงพระราชบัญญัติว่าด้วยการออกเสียงประชามติท้องถิ่นโดยการกำหนดประเด็นที่จะให้มีการออกเสียงประชามติมีความชัดเจนยิ่งขึ้น บัญญัติให้ประชาชนผู้มีสิทธิเลือกตั้งในท้องถิ่นมีสิทธิเสนอให้มีการออกเสียงประชามติได้ และควรจะมีการกำหนดกรอบวงเงินค่าใช้จ่ายในการจัดการออกเสียงประชามติไว้ ทั้งนี้เพื่อให้การออกเสียงประชามติเป็นไปตามเจตนารมณ์ของกฎหมายอย่างแท้จริง นอกจากนั้นบทบัญญัติของกฎหมายสมควรกำหนดให้มีการออกเสียงทั้งเป็นไปเพื่อให้มีข้อยุติ หรือเป็นไปเพื่อให้คำปรึกษา ส่วนจำนวนเสียงที่ใช้ในการตัดสินในเรื่องที่ขอให้มีการออกเสียงประชามติ ควรระบุไว้ในกฎหมายให้ชัดเจนว่าต้องมีจำนวนเสียงเท่าใดในการออกเสียงที่เป็นไปเพื่อให้มีข้อยุติ และจำนวนเสียงเท่าใดกรณีเป็นไปเพื่อให้คำปรึกษา
The objectives of this research on suitable approaches to local referendum under Article 287 of the Constitution of the Kingdom of Thailand, B.E. 2550, were: 1) to study concepts, theories, and evolution of local referendum; 2) to analyze problems of local referendum under the present Constitution and related laws; 3) to compare Thailand’s laws on local referendum with those of England; and 4) to suggest approaches to Thai laws’ amendment regarding local referendum. This was a qualitative research based on documentary research, i.e. study of related theses, books, articles, and data from the Internet. The research was conducted using descriptive, comparative and analytical methods. The results showed that there is not yet a specific law in Thailand concerning local referendum. Organic Act on Referendum, B.E. 2552 is referred to, and thus some parts are not completely consistent with the constitution, and some are not suitable in practice to apply to local referendum. The law should be amended to take into consideration the circumstances of local referendum with clear rules stating which kinds of issues can be decided by local referendum. Citizens with voting rights should be given the right to propose a referendum on an issue in their locality. Limits should be specified on the costs to be expended for holding local referendum. Setting clear provisions for these considerations would insure that the instrument of local referendum would be used following the intent of the law. The law should also state that local referendum can be used to decide on a question or as an advisory measure, and the proportion of votes required for passing the referendum in the case of deciding a question and in the case of advising the local government should be stated in the law.
