การศึกษาค้นคว้าอิสระ เรื่องความร่วมมือในการดำเนินภารกิจขององค์กรปกครองส่วนท้องถิ่น : ศึกษากรณีความร่วมมือขององค์การบริหารส่วนตำบล มีวัตถุประสงค์ 1) เพื่อศึกษาแนวคิด ทฤษฎี เกี่ยวกับหลักการกระจายอำนาจทางปกครองและองค์กรปกครองส่วนท้องถิ่น ความร่วมมือและภารกิจขององค์กรปกครองส่วนท้องถิ่น 2) เพื่อศึกษากฎหมายว่าด้วยองค์กรปกครองส่วนท้องถิ่น และความร่วมมือในการดำเนินภารกิจขององค์กรปกครองส่วนท้องถิ่นของไทย 3) เพื่อวิเคราะห์ปัญหาข้อกฎหมายเกี่ยวกับการจัดทำความร่วมมือในการดำเนินภารกิจขององค์กรปกครองส่วนท้องถิ่น 4 ) เพื่อเสนอแนะแนวทางการแก้ไขปัญหาเกี่ยวกับการจัดทำความร่วมมือในการดำเนินภารกิจขององค์กรปกครองส่วนท้องถิ่น ซึ่งผู้ศึกษาได้ทำการศึกษาค้นคว้าถึงแนวคิดและทฤษฎีเกี่ยวกับการดำเนินการจัดทาบันทึกข้อตกลง และภารกิจขององค์กรปกครองส่วนท้องถิ่น การศึกษาค้นคว้าอิสระ นี้เป็นการวิจัยเชิงคุณภาพ โดยวิธีการวิจัยทางเอกสาร จากตัวบทกฎหมายเกี่ยวกับองค์กรปกครองส่วนท้องถิ่น แผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น ตำรากฎหมาย และเอกสารอื่นที่เกี่ยวข้อง ผลการศึกษาพบว่า การจัดทำบันทึกข้อตกลงหรือบันทึกความร่วมมือที่องค์กรปกครองส่วนท้องถิ่นจัดทำขึ้น สามารถแบ่งประเภทบันทึกโดยพิจารณาจากคู่สัญญาได้ 3 ประเภท 1) การจัดทำบันทึกระหว่างท้องถิ่นและท้องถิ่นด้วยกัน 2) การจัดทำบันทึกในกรณีที่ท้องถิ่นทำกับองค์กรอื่น ๆ ภาครัฐ 3) การจัดทำบันทึกในกรณีท้องถิ่นทำกับเอกชน และแบ่งประเภทบันทึกโดยพิจารณาจากลักษณะของกิจกรรมขององค์กรปกครองส่วนท้องถิ่นได้ 2 ประเภท 1) การทำบันทึกข้อตกลงหรือบันทึกความร่วมมือเพื่อร่วมมือกันในการจัดทำบริการสาธารณะของท้องถิ่น มี 2 ลักษณะ คือ 1. ความร่วมมือของท้องถิ่นในการบริการสาธารณะของท้องถิ่นโดยตรง 2. การทำบันทึกข้อตกลงหรือบันทึกความร่วมมือบริการสาธารณะที่เป็นอำนาจหน้าที่ของหน่วยงานอื่นของรัฐ 2) การทำบันทึกข้อตกลงเพื่อบริหารงานของท้องถิ่น ปัจจุบันบันทึกข้อตกลงยังมีรูปแบบหลากหลาย ดังนั้น จึงควรแยกประเภทของความร่วมมือว่าเป็นความร่วมมือในการจัดทำบริการสาธารณะขององค์กรปกครองส่วนท้องถิ่นหรือไม่
The objectives of this research are:1) to study concepts and theories about decentralization of administrative power, local administrative organizations, cooperation by local administrative organizations and the duties and work of local administrative organizations; 2) to study laws related to Thailand’s local administrative organizations and cooperative agreements that they enter into; 3) to analyze problems with laws related to cooperative agreements made by local administrative organizations; and 4) to propose solutions to those problems. The research was limited to concepts and theories concerning contracts and agreements made to carry out the work of local administrative organizations. This was a qualitative research based on the documentary research method. The documents studied included laws about local administrative organizations, the plan and steps of decentralization, law texts, and other related documents. The contracts or agreements made by local administrative organizations can be classified into 3 types: 1) agreements between two localities; 2) agreements between a local administrative organization and another government organization; and 3) agreements with the private sector. The types of contracts can also be divided into contracts for local administrative work and contracts for jointly providing public services. The contracts for public services can be sub-divided into cooperation for public services that are directly the responsibility of the local administrative organization and cooperation for public services that are the responsibility of other government agencies. At present, there are many diverse kinds of cooperative agreements, so they should be identified as cooperative agreements to provide public services provided by the local administrative organization.
