Abstract
การศึกษาค้นคว้าอิสระเรื่อง มาตรการทางกฎหมาย และปัญหาอุปสรรคของการปฏิบัติงาน ตามกฎหมายคุ้มครองผู้ถูกกระทำด้วยความรุนแรงภายในครอบครัว มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวคิด ความหมาย ทฤษฎี ประเภท และรูปแบบเกี่ยวกับความรุนแรงในครอบครัว 2) เพื่อศึกษามาตรการทางกฎหมายในการแก้ไขปัญหาความรุนแรงในครอบครัวตามกฎหมายไทยและต่างประเทศ 3) เพื่อวิเคราะห์ปัญหาและอุปสรรคของการใช้กฎหมายคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัวของประเทศไทยเปรียบเทียบกับต่างประเทศ 4) เพื่อเสนอแนะแนวทางในการแก้ปัญหาเพื่อปรับปรุงแก้ไขกฎหมายคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัวของประเทศไทย การศึกษาค้นคว้าอิสระนี้ เป็นการศึกษาวิจัยเชิงคุณภาพ โดยการวิจัยจากเอกสาร ข้อมูลที่ทำการศึกษามีทั้งของประเทศไทยและต่างประเทศ โดยรวบรวมข้อมูลจากหนังสือ วารสาร สิ่งตีพิมพ์ ตัวบทกฎหมาย ตำรา บทความ ระเบียบวิธีปฏิบัติที่เกี่ยวข้องและข้อมูลทางอินเทอร์เน็ต ผลการศึกษาพบว่า 1) ปัญหาความหมายของคำว่า “ความรุนแรง” ครอบคลุมเพียงการกระทำที่ก่อให้เกิดอันตรายแก่ร่างกาย จิตใจ หรือสุขภาพ แต่ยังไม่ครอบคลุมถึงการกระทำที่ก่อให้เกิดความเสียหายต่อทรัพย์สิน และการกระทำที่ก่อให้เกิดความรำคาญของบุคคลในครอบครัว 2) ปัญหาคำนิยามของคำว่า “บุคคลในครอบครัว” ที่บัญญัติว่าบุคคลใดๆ ที่ต้องพึ่งพาอาศัยและอยู่ในครัวเรือนเดียวกันเห็นว่ายังมีความหมายไม่ชัดเจนจึงส่งผลให้การใช้กฎหมายนี้ต้องมีการตีความ 3) ปัญหาคำนิยามของคำว่า “บุตร” ยังไม่ครอบคลุมถึงบุคคลในครอบครัวที่ได้รับอุปการะโดยพฤตินัย 4) ปัญหาการปฏิบัติงานร่วมกันของเจ้าหน้าที่ที่ยังไม่มีการกำหนดทิศทางที่ชัดเจน ผลการศึกษาพบว่า บทบัญญัติของกฎหมายที่เกี่ยวข้องกับมาตรการและการปฏิบัติงานตามกฎหมายคุ้มครองผู้ถูกกระทำด้วยความรุนแรงภายในครอบครัว ยังมีปัญหาในการบังคับใช้อยู่หลายประการ 1) ปัญหาความหมายของคำว่า “ความรุนแรง” ครอบคลุมเพียงการกระทำที่ก่อให้เกิดอันตรายแก่ร่างกาย จิตใจ หรือสุขภาพ แต่ยังไม่ครอบคลุมถึงการกระทำที่ก่อให้เกิดความเสียหายต่อทรัพย์สิน และการกระทำที่ก่อให้เกิดความรำคาณของบุคคลในครอบครัว 2) ปัญหาคำนิยามของคำว่า “บุคคลในครอบครัว” ที่บัญญัติว่าบุคคลใด ๆ ที่ต้องพึ่งพาอาศัยและอยู่ในครัวเรือนเดียวกันเห็นว่ายังมีความหมายไม่ชัดเจนจึงส่งผลให้การใช้กฎหมายนี้ต้องมีการ 3) ปัญหาคำนิยามของคำว่า “บุตร” ยังไม่ครอบคลุมถึงบุคคลในครอบครัวที่ได้รับอุปการะโดยพฤตินัย 4) ปัญหาการปฏิบัติงานร่วมกันของเจ้าหน้าที่ที่ยังไม่มีการกำหนดทิศทางที่ชัดเจนจึงควรมีการแก้ไขเพิ่มเติมพระราชบัญญัติคุ้มครอง ผู้ถูกกระทำด้วยความรุนแรงในครอบครัว เพื่อแก้ไขปัญหาในการปฏิบัติงานตามกฎหมาย ซึ่งจะส่งผล ให้มีการนำกฎหมาย ฉบับนี้มาบังคับใช้มากขึ้น สมดังเจตนารมณ์ของกฎหมายฉบับนี้
Independent study on Legal Measures and Problems and Obstacles in the Operation under the Law on Protection of Victims of Domestic Violence had 4 objects: (1) to study concepts, definitions, theories, types, and forms of domestic violence. (2) to study of legal measures to solve domestic violence problems according to Thai and foreign laws. ( 3) to analyze problems and obstacles in using the law to protect victims with domestic violence in Thailand comparing to foreign countries. (4) to suggest for solving problems in order to improve the law on protection of domestic violence victims in Thailand. This independent study is a qualitative research study by researching from documents of both in Thailand and abroad by collecting information from books, journals, publications, laws, textbooks, articles, relevant procedures and information on the internet The study indicated that provisions of laws relating to measures and operations according to the law to protect victims of domestic violence. There are still many problems in enforcement as follows: (1) The problem of the definition of "violence" covers only actions that cause danger to the body, mind or health, but not yet covered actions that cause damage to property and acts that cause annoyance to family members. (2) Problems, definitions of the word "Person in the family" that states that any person must rely on and live in the same household. The meaning is still unclear therefore the use of this law requires interpretation. (3) The problem of the definition of the child has not been covered to a family member who is de facto foster. (4) Problems of joint operations of staff that do not have a clear direction. Therefore, there should be an amendment to the Family Protection Act for Victims of Violence in order to solve the problem of legal work which will affect to the law enforcement more as the spirit of this law.
