Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาหลักการแนวคิดทฤษฎีอำนาจหน้าที่ในการดำเนินคดีอาญาของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ เพื่อศึกษาหลักการแนวคิดทฤษฎีตามประมวลกฎหมายวิธีพิจารณาความอาญา เพื่อศึกษาหลักการแนวคิดทฤษฎีอำนาจหน้าที่ของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ ตามพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการป้องกันและปราบปรามการทุจริตแห่งชาติ พ.ศ. 2542 และที่แก้ไขเพิ่มเติม กรณีส่งเรื่องให้พนักงานสอบสวนดำเนินการตามประมวลกฎหมายวิธีพิจารณาความอาญา ตามมาตรา 89/2 เพื่อศึกษาหาแนวทางในการแก้ไขปัญหาอำนาจหน้าที่ของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ ตามพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการป้องกันและปราบปรามการทุจริตแห่งชาติ พ.ศ. 2542 และที่แก้ไขเพิ่มเติม อันจะนำไปสู่การบัญญัติกฎหมายหรือมาตรการอื่น ๆ เพื่อให้การปราบปรามการทุจริตมีประสิทธิภาพ และประสิทธิผลมากยิ่งขึ้นไป การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยเอกสาร โดยรวบรวมข้อมูลจากเอกสารต่าง ๆ ที่เกี่ยวข้องทั้งหมด ไม่ว่าจะเป็นตัวบทกฎหมายของประเทศไทยและต่างประเทศ ตำรา บทความ วิทยานิพนธ์ สารนิพนธ์ งานวิจัย และข้อมูลอิเล็กทรอนิกส์ต่าง ๆ ทั้งภาษาไทยและภาษาต่างประเทศ ผลการศีกษาพบว่า มาตรการทางกฎหมายเกี่ยวกับอำนาจหน้าที่ในการดำเนินคดีอาญาของ
คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ กรณีที่เกิดจากความตายในระหว่างที่อยู่ในความควบคุมของเจ้าพนักงานซึ่งอ้างว่าปฏิบัติราชการตามหน้าที่ ยังมีปัญหาในการบังคับใช้กฎหมายหลายหน้าที่ของคณะกรรมการประการ และมีผลกระทบต่ออานาจหน้าทีทีมีความเกี่ยงกันระหว่างป้องกันและปราบปรามการทุจริตแห่งชาติ และอำนาจของพนักงานสอบสวน รวมทั้งผลกระทบถึงการดำเนินการในฟ้องคดี จึงเห็นสมควรให้มีการแก้ไขกฎหมาย เพื่อให้เกิดปัญหาความซ้ำซ้อนในการดำเนินคดีอาญา และการตีความในการบังคับใช้กฎหมาย
This independent study has the following objectives: to study fundamental and theoretical concepts as well as authority and responsibility of National Anti-Corruption Commission (NACC) in conducting criminal prosecution; to study fundamental and theoretical concepts concerning code of criminal procedure; to study fundamental and theoretical concepts as well as authority and responsibility of NACC in accordance with the Organic Act on Counter Corruption, B.E. 2542, and other related acts, particularly the act of passing the case to investigative officer for further actions under the code of Criminal Procedure (Act No. 8 9 /2 ) ; to explore effective approaches in solving issues concerning authority and responsibility of NACC in accordance with the Organic Act on Counter Corruption, B.E. 2542, and other related acts. This will lead to an adoption of laws and other measures to enhance effectiveness of counter-corruption practices. This independent study involves qualitative research by examining a collection of documents from various sources including Thai and foreign laws, textbooks, dissertations and other related research as well as information in the form of electronic files. The results of this study indicate that the legal measures related to the authority of the NACC responsible for prosecuting investigating deaths that occur following police custody have some problems in law enforcement issues which effect NACC authority, the investigating officers authority, and the prosecution. The existing law concerning requires amending in order to avoid duplication problems in criminal proceedings and interpretation problems in law enforcement.
