Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อทำการศึกษาถึงปัญหาทางกฎหมายเกี่ยวกับการคุ้มครองผู้บริโภคที่ไม่ได้รับความเป็นธรรมจากการซื้อรถยนต์ โดยใช้มาตรการทางกฎหมายคุ้มครองผู้บริโภคตั้งแต่ก่อนซื้อรถยนต์ และหลังซื้อรถยนต์ โดยศึกษาเปรียบเทียบกฎหมายประเทศไทยกับ ประเทศสหรัฐอเมริกา เพื่อเป็นแนวทางในการปรับปรุงแก้ไขกฎหมายคุ้มครองผู้บริโภคของประเทศไทยไม่ว่าจะเป็นสัญญาเอกเทศ จากการศึกษากฎหมายของประเทศไทยที่เกี่ยวกับการคุ้มครองผู้บริโภคหลักความรับผิดทางสัญญาตามประมวลกฎหมายแพ่งและพาณิชย์ว่าด้วยนิติกรรมสัญญาว่าด้วย ซื้อขาย พระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ. 2522 และ (ฉบับแก้ไขเพิ่มเติม) พ.ศ. 2541 พระราชบัญญัติว่าด้วยข้อสัญญาที่ไม่เป็นธรรม พ.ศ. 2540 พระราชบัญญัติความรับผิดต่อความเสียหายที่เกิดขึ้นจากสินค้าที่ไม่ปลอดภัย พ.ศ. 2551 และพระราชบัญญัติมาตรฐานผลิตภัณฑ์อุตสาหกรรม พ.ศ. 2511 อีกทั้ง พบว่ากฎหมายของประเทศไทยยังไม่มีมาตรการทางกฎหมายในการคุ้มครองผู้บริโภคทั้งก่อนซื้อรถยนต์ และหลังซื้อรถยนต์ ในขณะที่ ประเทศสหรัฐอเมริกา มีมาตรการคุ้มครองผู้บริโภคทั้งก่อนซื้อรถยนต์ และหลังซื้อรถยนต์จากการศึกษาถึงปัญหาดังกล่าว จึงขอเสนอแนะแนวทางแก้ไขปัญหาการคุ้มครองให้มีมาตรการทางกฎหมายต่าง ๆ อาทิ เช่น ปรับปรุงแก้ไขเพิ่มเติมพระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ. 2522 โดยมีบทบัญญัติที่เป็นมาตรการควบคุมการโฆษณาโดยให้ผู้กระทำการโฆษณารถยนต์ยื่นคำขออนุญาต และต้องได้รับอนุญาตก่อนจึงจะทำการโฆษณาได้ และให้มีมาตรการกำหนดให้ผู้ผลิตรถยนต์ใหม่ต้องติดฉลากระบุรายละเอียดข้อมูลของรถยนต์ เป็นสติ๊กเกอร์ติดไว้ที่กระจกหน้าต่างของรถยนต์ใหม่ทุก ๆ คน เพื่อเป็นข้อมูลให้ผู้บริโภคพิจารณาในการตัดสินใจเลือกซื้อรถยนต์ และมีการตรวจสอบการใช้ข้อความในฉลากก่อนน่ารถยนต์ออกขายว่า มีการแสดงฉลากครบถ้วนและมีการใช้ข้อความที่ตรงต่อความเป็นจริง พร้อมทั้งเสนอแนะให้มีคู่มือแนะนำผู้บริโภคผู้ซื้อรถยนต์ใหม่ โดยให้เอกสารคู่มือคำแนะนำผู้ซื้อเป็นส่วนหนึ่งของสัญญา เพื่อใช้เป็นหลักฐานในการฟ้องร้องบังคับคดีต่อไป
This independent research is undertaken to study the legal issues in relation to the consumer protection, arising from the unfair car purchasing transactions. Legal measures for both before and after car purchase have been considered. The relevant Thai laws and the American laws are compared with the purpose to amend Thai laws. This research has taken into account several relevant laws including general legal principles on contractual liabilities the provisions on Juristic Acts, Contract and Specific Contract on Sale in the Civil and Commercial Code, the Consumer Protection Act B.E. 2522 (1979) (as amended), the Act on Unfair Contract Terms B.E. 2540 (1997), The Act on Liabilities for Damages Arising from Unsafe Products B.E. 2551 (2008) and the Act on Standard for Industrial Products B.E. 2511 (1968). It is found that Thai laws lack the legal measures to protect the consumers in the car purchasing transactions, both before and after purchasing, while the laws in the United States have the measures to protect the consumer both before and after purchasing. Based on the result of this research, it is recommended that some protective legal measures be introduced. Examples of the proposed measures are the amendment to the Consumer Protection Act B.E. 2522 (1979) by inserting the provisions which require any person who would like to advertise the cars to receive permission prior to making such advertisement; the requirement for the new car manufacturers to affix on the windshield of the new cars the labels describing details and information of each car to assist the consumers in making decision to purchase. The information given on such label should be verified that it is correct and complete before the cars are placed on the market. It is also suggested that the car manual be given to the new car purchasers and be included as a part of the relevant car sale I agreement to ensure its enforceability in the court.
