การศึกษาค้นคว้าอิสระ เรื่องสิทธิของวัยรุ่นหญิงศึกษากรณีทำแท้ง มีวัตถุประสงค์เพื่อศึกษา แนวความคิดเกี่ยวกับการทำแท้งและแนวคิดตามหลักสิทธิมนุษยชนและสิทธิอนามัยเจริญพันธุที่เกี่ยวข้อง กับการทำแท้งของวัยรุ่นหญิง เพื่อศึกษาวิเคราะห์มาตรการทางกฎหมายที่จะช่วยเหลือให้วัยรุ่นหญิงทำแท้งอย่างถูกกฎหมาย และเพื่อหาแนวทางการปรับปรุงแก้ไขประมวลกฎหมายอาญาในประเด็นกรณีศึกษา
การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสารโดยทำการศึกษา จากหนังลือ บทความ เอกสาร งานวิจัย ข้อมูลทางอินเตอร์เน็ต ตัวบทกฎหมายที่เกี่ยวข้อง เพื่อใช้เป็นข้อมูลในการศึกษาวิจัย และนำมาวิเคราะห์เพื่อนำไปสู่ข้อสรุปและข้อเสนอแนะของการวิจัยต่อไป ผลจากการศึกษา พบว่า หากประเทศไทยมีการแก้ไขประมวลกฎหมายอาญาว่าด้วยความผิด ฐานทำให้แท้งลูก โดยให้วัยรุ่นหญิงไทยมีสิทธิตามกฎหมายในการทำแท้งหรือยุติการตั้งครรภ์ได้ในฐานะ ทีเป็นสิทธิมนุษยชนขั้นพื้นฐานและสิทธิอนามัยเจริญพันธุอันจะเป็นการสอดคล้องกับสิทธิการมีชีวิตอยู่
อย่างมีศักดศรีความเป็นมนุษย์สิทธิการตัดสินใจว่าจะมีบุตรหรือไม่และจะมีเมื่อไร และสิทธิการดูแลและป้องกันสุขภาพ ซึ่งจะเป็นการคุ้มครองและคำนึงถึงประโยชน์ของวัยรุ่นหญิงเป็นสำคัญ โดยให้การทำแห้งของวัยรุ่นหญิงนั้นอยู่ภายใต้กรอบของกฎหมายเพื่อมิให้เป็นการทำแห้งโดยเสรี จึงเสนอแนะให้มีการปรับปรุงแก้ไขเพิ่มเดิมเหตุยกเว้นความผิดจากการทำแท้ง ตามประมวลกฎหมายอาญา มาตรา 305 ให้หญิงซึ่งมีอายุต่ำกว่า 18 ปีและมีอายุครรภ์ไม่เกิน 12 สัปดาห์ และหากการตั้งครรภ์เป็นผลร้ายต่อการเป็นอยู่ของหญิงนั้น สามารถทำแท้งไต้โดยไต้รับการยกเว้นความผิด พร้อมทั้งแก้ไขเพี่มเดิมข้อบังคับแพทยสภาว่าด้วยหลักเกณฑ์การปฏิบัติเกี่ยวกับการยุติการตั้งครรภทางการแพทย์ ให้สอดคลองกับกฎหมายอาญาที่มีการแก้ไขเพี่มเติมเหตุยกเว้นความผิดจากการทำแท้งดังกล่าวนี้ อีกประการหนึ่ง ควรบัญญัติให้การปฏิเสธการทำแท้งที่ถูกกฎหมายของวัยรุ่นหญิง ถือเป็นการทารุณกรรมอย่างหนึ่งใน พระราชบัญญัติคุ้มครองเด็ก พ.ศ.2546 เพื่อเป็นการป้องกันมิให้แพทย์ใช้ดุลพินิจปฏิเสธการยุติการ ตั้งครรภ์ให้แก่วัยรุ่นหญิงที่ไต้ปฏิบัติตามเงื่อนไขของกฎหมายแล้ว ซึ่งการแก้ไขเพี่มเติมกฎหมายดังกล่าว จะทำให้วัยรุ่นหญิงสามารถเข้าถึงสิทธิมนุษยชนขั้นพื้นฐานและสิทธิอนามัยเจริญพันธุไต้อย่างแท้จริง ทั้งยังเป็นการลดปัญหาวัยรุ่นหญิงลักลอบทำแท้งผิดกฎหมายลงได้
This independent study intends to analyze the rights of adolescent girls in the case of abortion by studying related concepts about human rights and reproductive rights. Furthermore, this study intends to analyze legal measures that would provide access to legal abortion for adolescents and to propose recommended amendments to the Criminal Code. This study uses a qualitative research approach, through documentary research, analyzing research papers , textbooks, laws, rules, regulations, and statutes, as well as electronic media. The results of the study showed that if Thailand revised the part of its Criminal Code regarding the offense of aborting a fetus in order to give adolescent girls the legal right to get an abortion or terminate a pregnancy, it would be in compliance with the principle of upholding their basic human right to live in dignity with self determination, their reproductive rights to decide whether or not to have children and when to have children, and their right to health care and health protection. Such legal amendments would be based on the interests of adolescents as the primary concern and would aim to expand the legal framework for abortion rather than completely opening free access to abortion. It is recommended that Clause 305 of the Criminal Code regarding exceptions to the offense of abortion should be amended to state that girls under the age of 18 who are no more than 12 weeks pregnant are allowed to get an abortion if the pregnancy would have a negative effect on their wellbeing. The relevant rules of the Medical Council should also be revised to be in compliance with the proposed amendment to the Criminal Code. In addition, in order to insure that medical personnel do not use their discretion in such cases, the 2003 Child Protection Act should be amended to state that refusing to provide a legal abortion for an adolescent in the said circumstances may be considered a form of abuse that is punishable by law. These proposed amendments would give adolescent girls real access to their basic human rights and reproductive rights and would help solve the problem of illegal abortions.
