Abstract
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาวิเคราะห์แนวติดและกฎหมายเกี่ยวกับการกำหนดวิทยฐานะข้าราชการครูของประเทศไทยและต่างประเทศ ทั้งในระบบกฎหมายคอมมอนลอว์และระบบกฎหมายซีริลลอว์ (2) ศึกษาวิเคราะห์ปัญหาการกำหนดวิทยฐานะของข้าราชการครูตามพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 กฎหมายและกฎระเบียบที่เกี่ยวข้อง (3) ศึกษาเปรียบเทียบกฎหมายในการบริหารงานบุคลากรทางการศึกษาของต่างประเทศ ทั้งในระบบกฎหมายคอมมอนลอว์ และระบบกฎหมายซีวิลลอว์บางประเทศ กับพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 และกฎหมายในการบริหารงานบุคลากรทางการศึกษาฉบับอี่นที่เกี่ยวข้องของประเทศไทย และ (4) เสนอแนวทางแก้ไขปรับปรุงพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 กฎหมายและกฎระเบียบที่เกี่ยวข้อง ในส่วนของการกำหนดวิทยฐานะให้มีการกำหนดวิทยฐานะข้าราชการครูที่มีความเหมาะสม สัมพันธ์กับผลลัมฤทธิที่สูงขึ้นของผู้เรืยน งานวิจัยเรื่องนี้เป็นการวิจัยทางกฎหมาย โดยการวิจัยเชิงคุณภาพ ด้วยการวิจัยทางเอกสาร จาก กฎหมาย ตำรา และบทความทางวิชาการ งานวิจัย วิทยานิพนธ์ และเอกสารทางวิชาการที่เกี่ยวข้อง ผลการวิจัยพบว่า การกำหนดวิทยฐานะข้าราชการครูมีปัญหาด้านความเหมาะสมของระบบการ กำหนดเงินวิทยฐานะตามพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 ทั้งในด้านการได้รับค่าตอบแทน และมีปัญหาในด้านการกำหนดวิทยฐานะข้าราชการครูไม่บรรลุตามวัตถุประสงค์เพื่อจูงใจ ให้ครูพัฒนาตนเองให้เป็นครูที่มีคุณภาพสูงและสัมพันธ์กับผลสัมฤทธิ์ของผู้เรียน ดังนั้น จึงควรปรับปรุงพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 และกฎระเบียบที่เกี่ยวข้องให้เอื้อประโยชน์และส่งเสริมให้ผู้เรียนมีผลสัมฤทธิทางการเรียนที่สูง และควรปรับปรุงพระราชบัญญัติเงินเดึอนเงินวิทยฐานะและเงินประจำตำแหน่งของข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 และกฎระเบียบที่เกี่ยวข้องให้ขั้นเงินเดือนของครูบรรจุใหม่สูงกว่าปัจจุบัน ขยายฐานเงินเดึอน ค่าตอบแทน สว้สดิการ และสิทธิประโยชน์จูงใจต่าง ๆ ของข้าราชการครูให้สูงขึ้น ให้เพียงพอกับการดำรงชีพและสามารถจัดการเรียนการสอนได้อย่างมีคุณภาพ
The purposes of this study were to (1) study and analyse the concepts and laws relating to the specification of academic qualification of government teachers in Thailand and some other countries within the common law and civil law systems ; (2) study and analyse the specification of academic qualification of government teachers under the Government Teachers and Education Personnel Act B.E. 2547, other laws and relevant regulations; (3) make a comparative study in the administration of education personnel under laws of some other countries within the common law and civil law system and the Government Teachers and Education Personnel Act B.E. 2547;and (4) propose the amendment of the Government Teachers and Education Personnel Act B.E. 2547, other laws and relevant regulations for a better performance and academic achievement of students. This legal research was conducted through the qualitative method by complying and analysing laws, textbooks and articles, academic researches, theses and related academic documents. Findings show that the specification of academic qualification of government teachers and application of the provisions under the Government Teachers and Education Personnel Act B.E. 2547 and relevant regulations are problematic. The legal system to the current academic standing by the Government Teachers and Education Personnel Act B.E. 2547 is inappropriate and irrelevant. The specification of academic qualification of government teachers did not achieve the ultimate objective providing remuneration to the teachers to encourage self-comprehensive professional development. Therefore, the specification of academic qualification of government teachers under the Government Teachers and Education Personnel Act B.E. 2547 and relevant regulations is suggested to improve as to enhance student performance for a better academic achievement. The Salaries, Remuneration and Emoluments of the Government Teachers and Education Personnel Act B.E. 2547 and relevant regulations should also be amended to raise the salaries, and the base salary should be expanded to meet the minimum standard of living. These would support and necessitate the new government teacher to live sufficiently and be the motivation for the new government teacher to strive to attain the quality education.
