Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาถึงความเป็นมา แนวคิด และทฤษฎี เกี่ยวกับการส่งเสริมการจ้างงานและคุ้มครองแรงงานสูงอายุ (2) ศึกษามาตรการทางกฎหมายเกี่ยวกับการส่งเสริมการจ้างงานและคุ้มครองแรงงานสูงอายุตามกฎหมายของประเทศไทย ประเทศสิงคโปร์ และประเทศญี่ปุ่น (3) วิเคราะห์เปรียบเทียบกฎหมายของประเทศไทย ประเทศสิงคโปร์ และประเทศญี่ปุ่น เกี่ยวกับการส่งเสริมการจ้างงานและคุ้มครองแรงงานสูงอายุ (4) เสนอแนวทางที่เหมาะสมในการแก้ไขปัญหา และการปรับปรุงหรือเพิ่มเติมบทบัญญัติแห่งกฎหมายเกี่ยวกับการส่งเสริมการจ้างงานและคุ้มครองแรงงานสูงอายุ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ โดยการวิจัยข้อมูลเอกสารจากการรวบรวมข้อมูลเชิงปฐมภูมิ ได้แก่ บทบัญญัติทางกฎหมาย คำพิพากษา และข้อมูลทุติยภูมิ ได้แก่ ตำรา งานวิจัย บทความ วารสารทางวิชาการ รายงานจากสถาบันและหน่วยงานต่าง ๆ ตลอดจนข้อมูลทางสื่ออิเล็กทรอนิกส์ และเครือข่ายอินเทอร์เน็ตทั้งภาษาไทยและภาษาต่างประเทศ เพื่อศึกษาถึงความเป็นมา แนวคิด ทฤษฎี มาตรการทางกฎหมาย วิเคราะห์เปรียบเทียบ และเสนอแนวทางที่เหมาะสมในการแก้ไขปัญหาผลการศึกษาพบว่า (1) ความเป็นมา แนวคิด และทฤษฎี เกี่ยวกับการส่งเสริมการจ้างงานและคุ้มครองแรงงานสูงอายุ มีที่มาจากหลักการคุ้มครองสิทธิเสรีภาพของผู้สูงอายุ หลักความเสมอภาค การรักษากำลังแรงงานไม่ให้เกิดความขาดแคลน และการรองรับการเป็นสังคมผู้สูงอายุ (2) ประเทศไทยยังไม่มีมาตรการทางกฎหมายเกี่ยวกับการส่งเสริมการจ้างงานและคุ้มครองแรงงานสูงอายุไว้เป็นการเฉพาะ มีเพียงการคุ้มครองลูกจ้างตามกฎหมายแรงงานทั่วไป (3) ตามกฎหมายของประเทศสิงคโปร์ และประเทศญี่ปุ่นมีบทบัญญัติเกี่ยวกับการส่งเสริมการจ้างงาน การกำหนดสภาพการจ้างให้ได้รับความคุ้มครองอย่างเป็นธรรม รวมถึงการกำหนดหน้าที่ของนายจ้างและลูกจ้างให้มีความสอดคล้องกัน แต่ตามกฎหมายของประเทศไทยที่มีอยู่นั้นยังไม่เพียงพอต่อการแก้ไขปัญหาหรือขจัดอุปสรรคเพื่อให้การส่งเสริมการจ้างงานและคุ้มครองแรงงานสูงอายุบรรลุผล (4) มีความจําเป็นอย่างยิ่งที่จะต้องมีมาตรการทางกฎหมายเพื่อแก้ไขปัญหาดังกล่าว ดังนั้น ผู้ศึกษาจึงเสนอแนวทาง ดังนี้ ประการแรก ให้มีการร่างพระราชบัญญัติส่งเสริมการจ้างแรงงานสูงอายุ พ.ศ. ... โดยมีรายละเอียดเกี่ยวกับการกำหนดคำนิยามของคำว่า “แรงงานสูงอายุ” การสนับสนุนและให้ความช่วยเหลือแก่ลูกจ้าง การจ้างงานภายหลังที่ถึงกำหนดเกษียณ การกำหนดลักษณะงานที่เหมาะสม และหน้าที่ของนายจ้างในการให้ความร่วมมือกับภาครัฐ ประการที่ 2 การเพิ่มเติมบทบัญญัติในพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 โดยมีรายละเอียดเกี่ยวกับการป้องกันการกีดกันแรงงานสูงอายุ การกำหนดสภาพการจ้างอย่างเป็นธรรม และประการ ที่ 3 การประกาศกระทรวงแรงงานว่าด้วยลักษณะงานที่เหมาะสมกับแรงงานสูงอายุ ทั้งนี้ เพื่อให้การส่งเสริมการจ้างงานและคุ้มครองแรงงานสูงอายุของประเทศไทยมีความเหมาะสมและเป็นธรรม
This independent study has the following objectives : (1) to study the background, the concepts and the theories regarding employment promotion and protection for older workers. (2) to study legal measures regarding employment promotion and protection for older workers that according to the law of Thailand, the law of Singapore, and the law of Japan. (3) to comparatively analyze the law of Thailand, the law of Singapore and the law of Japan regarding employment promotion and protection for older workers. (4) to find appropriate approaches for solving the problems and to improve or add the legal provisions regarding employment promotion and protection for older workers. This independent study is qualitative research by researching the document data from collecting primary data, including legal provisions, judgments, and secondary data, including textbooks, researches, articles, academic journals and reports from various institutions and government organizations as well as the information via electronic media and internet networks in both Thai and foreign languages. The results of the study are as follows : (1) The background, the concepts and the theories regarding employment promotion and protection for older workers are based on the principle of protecting the rights and freedoms of elderly, the principle of equality, maintaining the labor force to prevent labor shortages, and supporting an aging society. (2) Thailand does not yet have specific legal measures to promote employment and protect older workers. There is only protection for employees under general labor law. (3) According to the law of Singapore and the law of Japan have provisions regarding employment promotion, determining employment conditions for equitable protection, including determining the duties of employers and employees to be consistent. However, the existing laws of Thailand are not sufficient to solve the problems or eliminate obstacles in order to achieve employment promotion and protection for older workers. (4) It is necessary to have the legal measures to solve these problems, therefore, I suggest the following solutions : (1) To draft the Employment Promotion for Older Workers Act, B.E. ... with details regarding the definition of the term “older workers”, supporting and assistance for the employees, employment after the retirement, determining the appropriate job characteristics, and determining the duty of employers to cooperate with the government sector. (2) To add provisions in The Labor Protection Act, B.E. 2541 regarding details on preventing discrimination which against older workers, determining of employment conditions justly and (3) Announcement of the Ministry of Labor concerning the nature of work suitable for older workers. Totally, these are in order to promote employment for older workers and protect older workers in Thailand appropriately and fairly.
