ปัญหาทางกฎหมายองค์กรบริหารงานบุคคลของสำนักงานการตรวจเงินแผ่นดิน

Abstract

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ (1) ทราบปัญหาและอุปสรรคการบริหารงานบุคคลของข้าราชการสำนักงานการตรวจเงินแผ่นดินอันเกิดจากพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการตรวจเงินแผ่นดิน พ.ศ. 2542 (2) ทราบถึงแนวทางแก้ไขปัญหาและอุปสรรคที่เกิดขึ้นจากการบริหารงานบุคคลของข้าราชการสำนักงานการตรวจเงินแผ่นดิน ตามพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการตรวจเงินแผ่นดิน พ.ศ. 2542 (3) ทราบถึงบทบัญญัติของกฎหมายที่ควรจะเป็นและเหมาะสมสำหรับการบริหารงานบุคคลของข้าราชการสำนักงานการตรวจเงินแผ่นดิน การศึกษาในครั้งนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยเอกสาร โดยศึกษาเกี่ยวกับพระราชบัญญัติระเบียบบริหารงานบุคคลของข้าราชการประเภทต่าง ๆ รวมถึง กฎ ระเบียบ ข้อบังคับ หลักเกณฑ์ แนวปฏิบัติที่เกี่ยวกับการบริหารงานบุคคลของข้าราชการ ตำรา และบทความทางวิชาการที่เกี่ยวข้องกับการบริหารงานบุคคลของข้าราชการพลเรือน รวมทั้งพระราชบัญญัติและร่างพระราชบัญญัติที่เกี่ยวข้องกับการตรวจเงินแผ่นดิน ผลการศึกษาพบว่า ที่มาและองค์ประกอบของคณะกรรมการข้าราชการสำนักงานการตรวจเงินแผ่นดินตามกฎหมายปัจจุบันมีความไม่เหมาะสม ควรให้ตัวกรรมการฯ มาจากการมีส่วนร่วมจากภาคส่วนอื่น ๆ ด้วย เช่น มีกรรมการผู้ทรงคุณวุฒิ หรือ กรรมการผู้แทนจากการเลือกของข้าราชการ และระบบพิทักษ์คุณธรรมหรือการให้หลักประกันการปฏิบัติงานแก่ข้าราชการ สำนักงานการตรวจเงินแผ่นดินยังไม่สอดคล้องกับหลักการและกฎหมายกลางด้านการบริหารงานบุคคลของข้าราชการพลเรือน ควรต้องแยกองค์กรที่ทำหน้าที่ผู้จัดการทรัพยากรบุคคล ออกจากองค์กรที่ทำหน้าที่พิทักษ์ระบบคุณธรรม และให้ตัวกรรมการคณะกรรมการพิทักษ์ระบบคุณธรรมมาจากการแต่งตั้งของคณะกรรมการตรวจเงินแผ่นดินส่วนหนึ่งและมาจากการสรรหาส่วนหนึ่ง

The objectives of Independent Study are, firstly, to analyze legal problems and obstacles on personnel administration of Office of the Auditor General under the Organic Law on State Audit, 1999, secondly, to survey and propose the best solution to solve the current problems, and thirdly, to propose the amendment to the provisions of law on such matters. This Independent Study is a qualitative research conducted through a documentary research by studying the law on personnel administration of other kinds of government officials including civil servants and personnel of the Office of the Auditor General, textbooks and academic articles concerned. The finding are, Firstly, the composition of the Personnel Administration Committee of the Office of the Auditor General is unsuitable, therefore, more qualified members from outside or a representative of the whole personnel should be appointed as a composition and, Secondly, according to Organic Law on State Audit, 1999, there is less merit protection system than under law on the administration of civil services. The proposed solutions is that the separation of Merit Protection Committee or Personnel Management Committee and respect to participation principle should be introduced, in order that the Auditor General Committee shall assign one part of the Merit Protection Committee and another part should be by professional selected process.
