Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นมา แนวคิด ทฤษฎีในความผิดเกี่ยวกับเพศในความสัมพันธ์ของบุคคลที่เป็นเหตุให้ต้องรับโทษหนักขึ้น จากกฎหมายประเทศไทย กฎหมายระหว่างประเทศ และกฎหมายของประเทศอังกฤษ สหรัฐอเมริกา สหพันธ์สาธารณรัฐเยอรมนี และสาธารณรัฐฝรั่งเศส (2) ศึกษากฎหมาย สำหรับความสัมพันธ์ของบุคคลที่เกี่ยวข้องกับการกระทำทางเพศให้รับโทษที่หนักขึ้นทั้งในส่วนของจากกฎหมายประเทศไทย กฎหมายระหว่างประเทศ และกฎหมายต่างประเทศ อาทิ ประเทศอังกฤษ สหรัฐอเมริกา สหพันธ์สาธารณรัฐเยอรมนี และสาธารณรัฐฝรั่งเศส (3) ศึกษาวิเคราะห์มาตรการทางกฎหมายที่เกี่ยวข้องกับความสัมพันธ์ของบุคคลโทษที่ต้องรับโทษหนักขึ้นทั้งในส่วนของกฎหมายประเทศไทย กฎหมายระหว่างประเทศ และกฎหมายต่างประเทศ อาทิ ประเทศอังกฤษ สหรัฐอเมริกา สหพันธ์สาธารณรัฐเยอรมนี และสาธารณรัฐฝรั่งเศส และ (4) เสนอแนะแนวทางในการแก้ไขกฎหมายว่าด้วยการให้คำนิยามให้สอดคล้องกับสภาพการณ์ของปัญหาที่เกิดขึ้นในปัจจุบัน การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยจากเอกสาร ผู้ศึกษาได้ทำการรวบรวมข้อมูลทั้งหมดที่เกี่ยวข้อง รวมถึงหนังสือ บทความ วารสาร เอกสารทางวิชาการ งานวิจัย วิทยานิพนธ์ และข้อมูลจากเครือข่ายอินเทอร์เน็ตทั้งในภาษาไทยและภาษาอังกฤษ ในส่วนของการวิเคราะห์ข้อมูล ผู้วิจัยได้วิเคราะห์ข้อมูลเชิงคุณภาพ โดยวิเคราะห์จากข้อมูลที่ได้จากการวิจัยเอกสารข้างต้น เพื่อจัดทำข้อเสนอแนะต่อไป ผลการศึกษาพบว่า (1) ความผิดเกี่ยวกับเพศในส่วนความสัมพันธ์ของบุคคลที่มีผลให้ผู้กระทำความผิดต้องรับโทษหนักขึ้นของกฎหมายไทย มิได้ให้คำจำกัดความที่มีลักษณะเฉพาะเจาะจงในกรณีผู้กระทำความผิดที่อยู่ในสถานะบิดาเลี้ยงหรือมารดาเลี้ยง ทั้งที่เป็นลักษณะกรณีผู้ใกล้ชิดลำดับแรก และเป็นกรณีที่มักมีเหตุปรากฏเป็นบ่อยครั้ง (2) บทบัญญัติของประมวลกฎหมายอาญาไทยตามมาตรา 285 เมื่อเปรียบเทียบกฎหมายระหว่างประเทศ และกฎหมายต่างประเทศ อาทิ ประเทศอังกฤษ สหรัฐอเมริกา สหพันธ์สาธารณรัฐเยอรมนี และสาธารณรัฐฝรั่งเศสแล้ว มิได้ให้คำนิยามครอบคลุมลักษณะของผู้ก่อเหตุที่มีลักษณะใกล้ชิดโดยอาศัยความสัมพันธ์พิเศษในการก่อเหตุทางเพศให้ได้รับโทษหนักขึ้น (3) มาตรการทางกฎหมายอาญาของประเทศไทยตามมาตรา 285 ควรทำการแก้ไขเพิ่มเติมโดยการกำหนดสถานะของผู้ปกครองที่จะต้องรับโทษหนักขึ้นทั้งโดยกฎหมายและตามความเป็นจริง (4) บทบัญญัติตามประมวลกฎหมายอาญาของประเทศไทยตามมาตรา 285 สมควรอย่างยิ่งในการเพิ่มเติมประมวลกฎหมายอาญาในมาตรา 1 ในการให้หมายความหรือคำอธิบายเพิ่มเติมสำหรับกรณีเหตุความผิดทางเพศที่ก่อโดยผู้ที่มีความสัมพันธ์ใกล้ชิด
The objectives of this independent study were (1) to investigate the background, concepts, and theories about sexual offenses in a relationship of individuals that are the causes that increase the degree of liability or culpability, from Thai law International law and the law of the United Kingdom, the United States of America, the Federal Republic of Germany and the French Republic (2) to study legal measures and the proportionality of punishment imposed on relevant individuals, and definition and stipulation of legal punishment under Thai law and international law, (3) to make a comparative study and analyze legal measures associated with definition and stipulation of legal punishment under Thai law and international law and (4) to offer a guideline for law amendment to the definition to be compliant with current status of problems. The study was conducted on the basis of a qualitative documentary research. Relevant data were collected from books, articles, journals, academic documents, research studies, theses, and information on the internet in Thai and English. Qualitative data analysis was conducted based on the data obtained from the documentary research mentioned earlier so as to prepare suggestions accordingly. The study results revealed that (1) the provisions of the law did not contain a definition that covers characteristics of a sex offender having intimate relationship and using that special relationship to commit a sexual offense, (2) the provisions of the law did not contain a specific definition in case a sex offender is a stepfather or stepmother as it is a characteristic of a case caused by an intimate person and occurs several times, (3) the provision under Thai Penal Code Article 285 should be amended by determining the status of parents who shall be imposed a higher degree of punishment by law and the actual situation, (4) the provision under Thai Penal Code Article 1 should be amended by providing additional definition or explanation for a sex offense committed by an intimate person.
