Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์ของการศึกษาเพื่อศึกษาแนวคิด ทฤษฎี ประวัติ วิวัฒนาการและวัตถุประสงค์เกี่ยวกับการลงโทษประหารชีวิต การบังคับโทษประหารชีวิต ของประเทศไทยและของต่างประเทศ แนวทางในการยกเลิกการใช้โทษประหารชีวิตของต่างประเทศรวมถึงปัญหาการลงโทษประหารชีวิตในประเทศไทย การวิจัยเป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร โดยใช้วิธีการศึกษาจาก เอกสาร ประกอบด้วยเอกสารที่เกี่ยวข้องทางวิชาการ ตำรา บทความ รายงานการวิจัย รายงานวิชาการต่าง ๆ สื่ออิเล็กทรอนิกส์ บทบัญญัติของกฎหมายที่เกี่ยวข้องไม่ว่าจะเป็นตัวบทกฎหมายของประเทศไทยและต่างประเทศ เพื่อนำมาวิเคราะห์สังเคราะห์ข้อมูลเพื่อนำไปสู่ผลการวิจัย ผลการศึกษาพบว่า ปัจจุบันหลายประเทศทั่วโลกได้ยกเลิกบทลงโทษประหารชีวิตทั้งในทางกฎหมายและในทางปฏิบัติเนื่องด้วยโทษประหารชีวิตเป็นวิธีการที่รุนแรง ป่าเถื่อน และไร้ ซึ่งมนุษยธรรม และใช้โทษประหารชีวิตเฉพาะคดีที่ร้ายแรงเท่านั้น ทั้งนี้ให้เป็นไปตามหลักการสิทธิมนุษยชนประเทศไทยยังคงเป็นประเทศที่ยังคงไว้ซึ่งบทลงโทษประหารชีวิตจึงอาจทำให้ถูกมองว่าเป็นประเทศที่ไม่เคารพถึงหลักการทางด้านสิทธิมนุษยชนโดยประเทศไทยได้เข้าร่วมลงนามปฏิญญาสากลวาด้วยเรื่องสิทธิมนุษยชน ดังนั้น ควรมีการแก้ไขบทบัญญัติกฎหมายที่เกี่ยวข้องกับโทษประหารชีวิตในทุกฐานความผิดแต่ยังคงใช้บังคับกับคดีอุกฉกรรจ์คือการกระทำผิดที่แสดงให้เห็นว่ามีเจตนาในการฆาตกรรมโดยผลของการกระทำทำให้ผู้อื่นเสียชีวิต เพื่อให้สอดคล้องกับหลักการว่าด้วยสิทธิมนุษยชนรัฐควรเตรียมความพร้อมในเรื่องงบประมาณและค่าใช้จ่ายในกรณีมีการยกเลิกการใช้โทษประหารชีวิตนำมาตรการทางอาญาอื่น ๆ มาบังคับใช้แทนการลงโทษประหาร ชีวิต เช่น การจำคุกระยะเวลายาวนาน
The purpose of the independent study of the criminal penalty: a case study of the appropriateness of the death penalty in Thailand is to study about the concepts, theories, histories, the evolution and the objectives relating to the death penalty, the death penalty sanction in Thailand and in foreign countries, the guideline to abolish the death penalty in foreign countries including the death penalty issues in Thailand. This independent study is the qualitative research by means of the documentary research and goes through the research from the documents, consisting of the academic documents, textbooks, the articles, the research reports, the academic researches, the electronic media and the relevant provisions of law whether in Thai language or foreign language in order to analyze and synthesize the data sought for the conclusions of the research results. Result of the research: presently, many countries around the world have abolished the death penalty both in laws and in practices due to the fact that such death penalty is severe, savage and inhumane. They only punish the death penalty in the serious offences for the purpose of the accordance with the human rights principle. Thailand still is the country with the death penalty. Therefore, it might be considered as the country which does not respect the human rights principle that Thailand has joined in signing the Declaration of Human Rights. In this way, the author suggests to revise the provisions of law regarding the death penalty in all of offences, yet to apply in the serious offences which are the offenses showing the intent to murder with the result of death of other person in order to the consistency with the human rights principle. The state shall prepare for the budgetary and expenditure matters in case the abolition of the death penalty and adopt the criminal penalty instead of the death penalty such as the long imprisonment et cetera.
