Abstract
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาทฤษฎีและหลักกฎหมายที่นำมาใช้ในการกำหนดความผิด และบทกำหนดโทษต่อการครอบครองสิ่งละเมิดลิขสิทธิ์ ไว้นอกเหนือจากการใช้งานเพื่อประโยชน์ส่วนบุคคลหรือภายในที่พักอาศัย ซึ่งมิได้มีวัตถุประสงค์ในทางการค้าหรือแสวงหาผลประโยชน์ในทางธุรกิจ หรือการครอบครองสิ่งละเมิดลิขสิทธิ์เกินจำนวนที่เหมาะสม (mere possession) (2) ศึกษาถึงข้อดี ข้อเสีย และผลกระทบในการกำหนดความผิด และบทกำหนดโทษต่อการครอบครองสิ่งละเมิดลิขสิทธิ์เกินจำนวนที่เหมาะสม ว่ามีความเหมาะสมกบสังคมไทยหรือไม่ (3) ศึกษาถึงปัญหาและอุปสรรคของการกำหนดโทษอาญาต่อการครอบครองสิ่งละเมิดลิขสิทธิ์เกินจำนวนที่เหมาะสม ที่มีแนวโน้มจะส่งผลกระทบต่อกระบวนการยุติธรรมของประเทศไทยในลักษณะต่างๆ (4) ศึกษาและเปรียบเทียบแนวทางในการกาหนดความผิดสำหรับผู้ครอบครองสิ่งละเมิดลิขสิทธิ์ รวมทั้งมาตรการบังคับสิทธิโดยใช้โทษอาญาต่อผู้ครอบครองสิ่งละเมิดลิขสิทธิ์ ในกฎหมายต่างประเทศ ว่ามีแนวทางและมาตรการอยางไร (5) ศึกษาหาแนวทางแกไขปัญหาที่เหมาะสม และแนวโน้มที่อาจจะเป็นไปได้ ในการนำบทกาหนดความผิดต่อการครอบครองสิ่งละเมิดลิขสิทธิ์เกินจำนวนที่เหมาะสมมาใช้ในประเทศไทย การศึกษานี้เป็นการวิจัยเอกสาร (Documentary Research) โดยทำการศึกษาวิเคราะห์ แหล่งข้อมูลจากบทความ ตำรา วิทยานิพนธ์ เวปไซต์และงานวิจัยทางวิชาการต่างๆ ที่เกี่ยวกบการกำหนด ความผิดสำหรับการครอบครองสิ่งละเมิดลิขสิทธิ์เกินจำนวนที่เหมาะสม (mere possession) ในกฎหมายต่างประเทศเช่น กฎหมายลิขสิทธิ์ มาเลเซีย ค.ศ.1987 หรือกฎหมายลิขสิทธิ์ สิงคโปร์ ค.ศ.1987 เป็นต้น หากนำมาใช้ในประเทศไทยจะส่งผลในการยกระดับความคุ้มครองลิขสิทธิ์ ให้สูงขึ้น หรือไม่อย่างไร และจะส่งผลกระทบต่อสาธารณชนในการใช้ประโยชน์จากงานอันมีลิขสิทธิ์หรือไม่ พร้อมทั้งเสนอแนวทางแก้ไข ผลจากการวิจัยสรุปว่า การกำหนดความผิดสำหรับการครอบครองสิ่งละเมิดลิขสิทธิ์ เกินจำนวนที่เหมาะสม (mere possession) จะส่งผลในการยกระดับความคุ้มครองลิขสิทธิ์ ของไทยให้สูงขึ้น ช่วยลดจำนวนสิ่งละเมิดลิขสิทธิ์ ที่เกิดจากการครอบครองเพื่อประโยชน์ส่วนบุคคล หรือภายในที่พักอาศัยลง โดยไม่เป็นการกระทบกระเทือนต่อสิทธิของสังคมที่จะใช้ประโยชน์จากงานอันมีลิขสิทธิ์ และมีความเหมาะสมที่จะนำมาบังคับใช้ในสังคมไทย
The objectives of this research are to (1) study theories and law principles used to define guilt and legal punishment to the infringement of possessing the other’s copyright for the purpose other than private or domestic use without commercial or business purpose or mere possession, (2) study advantages, disadvantages and impacts to define guilt and legal punishment of mere possession whether it is suitable for Thai society or not, (3) study problems and obstacles to define punishment for mere possession which tends to impact Thai justice process in many aspects, (4) study and compare the ways to define guilt for the person possessing copyright infringement products as well as the process and criteria to enforce the rights to use criminal punishment to possessor mala fide by using Thai laws and foreign laws, and (5) study and ascertain appropriate solutions and possible trend of using the law concerning with mere possession in Thailand. The approach for this research is the Documentary Research conducted based on sources, including academic articles, textbooks, dissertations, websites and other academic researches related to possessing copyright infringement in Thailand and those in some specific foreign laws, including the Malaysia Copyright Act 1987 (B.E. 2530) and the Singapore Copyright Act 1987 (B.E. 2530). If these laws were to be used in Thailand, would it leverage the copyright protection in Thailand or potentially impact public in term of utilizing copyright items. This research is to find possible answer as well as offer potential solutions. The result found that defining punishment of mere possession would help leverage copyright protection in Thailand and reduce possessing of copyright infringement other than private or domestic use. Also, this change would not restrict people in the society from enjoying the rights and gaining benefits from copyright items, and these were assumed to be appropriate to enforce in Thai society.
