Abstract
การศึกษาค้นคว้าอิสระเรื่อง “บทบาทขององค์กรปกครองส่วนท้องถิ่นกับการบริหารจัดการการใช้ประโยชน์ทรัพยากรที่ดินและป่าไม้” มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิด ทฤษฎี เกี่ยวกับการจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อม และองค์กรปกครองส่วนท้องถิ่น (2) ศึกษากฎหมายเกี่ยวกับการจัดการทรัพยากรที่ดินและป่าไม้ในประเทศไทย โดยเฉพาะที่เกี่ยวข้องกับองค์กรปกครองส่วนท้องถิ่น (3) วิเคราะห์ปัญหาขององค์กรปกครองส่วนท้องถิ่นในการบริหารจัดการใช้ประโยชน์ทรัพยากรที่ดินและป่าไม้ โดยวิเคราะห์เปรียบเทียบกับกรณีศึกษาที่เกี่ยวข้อง (4) เสนอแนะมาตรการทางกฎหมายเกี่ยวกับการบริหารจัดการใช้ประโยชน์ทรัพยากรที่ดินและป่าไม้ขององค์กรปกครองส่วนท้องถิ่น การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพโดยวิธีการวิจัยทางเอกสารจากตำรากฎหมายที่เกี่ยวข้องกับแนวคิด ทฤษฎี ตัวบท คำพิพากษา กรณีศึกษา และสภาพปัญหาเกี่ยวกับเรื่องดังกล่าว ผลการศึกษาพบว่า บทบาทขององค์กรปกครองส่วนท้องถิ่นเกี่ยวกับการบริหารจัดการทรัพยากรที่ดินและป่าไม้ ที่กำหนดไว้ในรัฐธรรมนูญและกฎหมายจัดตั้งองค์กรปกครองส่วนท้องถิ่น รวมถึงกฎหมายเกี่ยวกับที่ดินและป่าไม้ยังไม่บรรลุตามเจตนารมณ์ เนื่องจากปัจจุบันมีปัญหาการบังคับใช้ที่ไม่เป็นรูปธรรม ขาดความเป็นเอกภาพหรือไม่เป็นไปในทางเดียวกัน ขาดการรับรองสิทธิอันชอบธรรมของชุมชน การทับซ้อนของกฎหมายในบางกรณี การบุกรุกที่ดินของรัฐ การขาดการมีส่วนร่วมของคนในชุมชน ดังนั้น การอยู่ร่วมกันของคนในชุมชนจึงต้องสร้างกติกาขึ้นมาใช้บังคับ เพื่อให้ใช้ทรัพยากรร่วมกันอย่างยั่งยืน ผู้ศึกษาจึงได้เสนอแนะการแก้ไขเพิ่มเติมกฎหมาย เช่น การแก้ไขเพิ่มเติมพระราชบัญญัติเทศบาล พ.ศ. 2496 ให้มีความชัดเจนมากยิ่งขึ้น เพื่อรองรับบทบาทของเทศบาลในการจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อม และให้มีการตราเทศบัญญัติที่เกี่ยวข้องขึ้นใช้บังคับภายในเขตที่รับผิดชอบขององค์กรปกครองส่วนท้องถิ่น โดยกำหนดให้มีคณะกรรมการจัดการ
ทรัพยากรธรรมชาติและสิ่งแวดล้อมของชุมชนท้องถิ่น ซึ่งได้รับการคัดเลือกโดยสมาชิกของแต่ละชุมชน ที่มีความรู้และเข้าใจในปัญหาของชุมชนของตนเอง ให้ทำหน้าที่สนับสนุนการดำเนินงาน ประสาน จัดทำ และเผยแพร่ข้อมูลข่าวสาร ประสานความร่วมมือกับบุคคล หน่วยงาน และองค์กรอื่นที่เกี่ยวข้องกับการจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อมในท้องถิ่น
The independent study on "The role of local governments to manage resources, land use and forestry" is aimed to study 4 objectives. (1) to study the theory about the management of natural resources and the environment. And local government (2) to study the law on management of land resources and forests in Thailand including relevant case studies (3) to analyze the problems of local governments to manage utilization of land resource and forests and (4) o propose legal measures to manage the utilization of land resource and forests of local governments. This independent study was qualitative research that used documentary method employing a range of documentary sources i.e. provisions of law, textbooks, case study and other relevant documents. The study found that the role of local governments on the management of land resources and forests as specified in the Constitution of the Kingdom of Thailand and the law establishing the local government including laws relating to land and forests does not meettheir objectives.This is due to a number of problems relating to the enforcement of laws, lack of unity or are not in the same way . Lack of assurance rights of the community. Conflict of laws in some cases. Land invasion of the State. The lack of participation of the community. Therefore, the coexistence of people in the community have to create rules to apply. To share resources sustainably. The study had proposed legal amendments such as amended Municipal Act, 2496, provides more clear. To support the role of municipalities in the management of natural resources and the environment. And an ordinance enacted by the relevant force within the responsibility of local governments .The management of natural resources and environment committee of the local community. Which was voted on by members of each community. With the knowledge and understanding of the problems of their communities. To support the operations coordinated preparation and dissemination of information. Collaboratively with individuals, agencies and other organizations involved in the management of natural resources and the local environment.
