Abstract
วิทยานิพนธ์เรื่องนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดเกี่ยวกับหลักกฎหมายทั่วไป ( 2) ศึกษาแนวคิดเกี่ยวกับการใช้หลักกฎหมายทั่วไปของต่างประเทศ (3 )ศึกษาการใช้หลักกฎหมายทั่วไปของศาลไทย ในการพิจารณาคดีปกครองและคดีแพ่ง (4) วิเคราะห์เปรียบเทียบการใช้หลักกฎหมายทั่วไปในการพิจารณาคดี ปกครองและคดีแพ่ง (5) เสนอแนะแนวทางการใช้หลักกฎหมายทั่วไปในคดีปกครอง วิธีดําเนินการวิจัยเป็นการวิจัยจากเอกสาร (Documentary Research) ผู้วิจัยได้ทําการศึกษาค้นคว้า ข้อมูลจากทั้งภาษาไทยและภาษาต่างประเทศ จากหนังสือ ตํารา บทความ งานวิจัย วิทยานิพนธ์ กฎหมายและ ระเบียบที่เกี่ยวข้อง คําพิพากษาของศาลปกครองสูงสุด และคําพิพากษาของศาลฎีกา แหล่งที่มาของข้อมูลใน การศึกษาค้นคว้าได้จากเอกสารโดยตรงและข้อมูลในระบบออนไลน์ การวิจัยเป็นการศึกษาในเชิงเปรียบเทียบการใช้หลักกฎหมายทั่วไประหว่างคดีปกครองและคดีแพ่ง ในส่วนของการศึกษาการใช้หลักกฎหมายทั่วไปของ ต่างประเทศ ผู้วิจัยได้นําเสนอบริบทเกี่ยวกับการใช้หลักกฎหมายทั่วไปของประเทศฝรั่งเศส และเยอรมัน สรุปผลการวิจัย (1) หลักกฎหมายทั่วไปเป็นหลักที่ยืนอยู่ เบื้องหลังกฎหมายลายลักษณ์อักษร มีสภาพบังคับทางกฎหมายโดยผ่านการวินิจฉัยของศาล ในกฎหมายเอกชนหลักกฎหมายทั่วไปมุ่งคุ้มครองสิทธิ ระหวางบุคคล ส่วนในกฎหมายมหาชนหลักกฎหมายทั่วไปมุ่งคุ้มครองสิทธิเสรีภาพของประชาชนจากการกระทําของรัฐ (2) ฝรั่งเศสและเยอรมันต่างก็มีการใช้หลักกฎหมายทั่วไปในการวินิจฉัยคดีและมีหลักกฎหมายร่วมที่เป็นพื้นฐานในกลุ่มสหภาพยุโรป (3) หลักกฎหมายทั่วไปในคดีปกครองมาจากการใช้เหตุผลของตุลาการและรัฐธรรมนูญ หลักกฎหมายทั่วไปในคดีแพ่งมาจากการพิจารณาข้อเท็จจริงภายใต้ขอบเขตกฎหมายในเรื่องนั้น (4) หลักพื้นฐานในการวินิจฉัยคดีปกครอง มุ่งคุ้มครองมิให้ผู้ใช้อํานาจทางปกครองละเมิดสิทธิผู้อยู่ใต้อํานาจปกครอง หลักพื้นฐานในการวินิจฉัยคดีแพ่งจะมุ่งคุ้มครองสิทธิระหว่างบุคคลต่อบุคคล (5) ผู้วิจัยเสนอแนะให้ บัญญัตินิยามความหมายของหลักกฎหมายทั่วไปและบัญญัติให้การใช้หลักกฎหมายทั่วไปครอบคลุมการวินิจฉัย คดีที่ต้องใช้กฎหมายเฉพาะในระเบียบของที่ประชุมใหญ่ตุลาการในศาลปกครองสูงสุดว่าด้วยวิธีพิจารณาคดี ปกครอง พ.ศ.2543
The objectives of this thesis are: 1) to study the concept of general principles of laws; 2) to study the concept of application of general principles of laws in other countries; 3) to study application of general principles of laws in administrative and civil consideration of Thai court; 4) to analyze and compare application of general principles of laws in administrative and civil consideration; and 5) to recommend the concept of application of general principles of laws in administrative cases.The method of the research is documentary research. The researcher studied both Thai and foreign language data gathered from books, textbooks, articles, researches, thesis, legal provisions, related regulations, decisions of the supreme administrative court, and decisions of the Supreme Court. The resources of this thesis are paper documents and online data. The research is a comparison between administrative and civil cases. Regarding the study of application of general principles of laws of foreign countries, the researcher presented applying them in French and German contexts. The summary of the research is as follows. 1) Written laws shall be based on general principles of laws and enforced through consideration in court. In private laws, general principles of laws aim at protecting rights among people whereas in public laws, general principles of laws aim at protecting rights and freedom of citizens against administrative acts. (2) Both French and German administrative laws take general principles of laws into consideration when judging cases and apply common principles in the European Union (EU). (3) General principles of laws in administrative cases are based on reasoning of judge and the Constitution. General principles of laws in civil cases are based on consideration of facts within the scope of relevant laws. (4) Basic principles of administrative consideration aim to prevent administrators from violating right of people under their administration. General principles of laws in judging civil cases aim to protect the rights of citizens. (5) The researcher recommends that definitions of general principles of laws and application of general principles of laws be more thorough so they cover judgments of cases requiring specific laws in the General Assembly of the Supreme Administrative Court on Administrative Court Procedure B.E. 2543.
