Abstract
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษา (1) การปฏิบัติต่อผู้ต้องขังตามข้อกำหนดสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขังในทัณฑสถานเปิดบ้านเนินสูง จังหวัดปราจีนบุรี (2) สาเหตุของปัญหาการปฏิบัติต่อผู้ต้องขังตามข้อกำหนดสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขังในทัณฑสถานเปิดบ้านเนินสูง จังหวัดปราจีนบุรี (3) แนวทางในการแก้ปัญหาการปฏิบัติต่อผู้ต้องขังตามข้อกำหนดสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขังในทัณฑสถานเปิดบ้านเนินสูง จังหวัดปราจีนบุรี การวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ ประชากร 3 กลุ่ม เลือกกลุ่มตัวอย่างเฉพาะเจาะจง ผู้ให้ข้อมูลหลักจำนวน 9 คน ได้แก่ ผู้บริหารเรือนจำ จำนวน 3 คน เจ้าหน้าที่เรือนจำ จำนวน 3 คน และผู้ต้องขัง จำนวน 3 คน เครื่องมือที่ใช้ในการวิจัย ได้แก่ แบบสัมภาษณ์ แบบสังเกตแบบมีส่วนร่วม วิเคราะห์ข้อมูลเชิงพรรณนา ผลการวิจัยพบว่า ศึกษา (1) การปฏิบัติต่อผู้ต้องขังตามข้อกำหนดสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขังในทัณฑสถานเปิดบ้านเนินสูงพบปัญหาที่ไม่สามารถปฏิบัติได้ตามหลักปฏิบัติต่อผู้ต้องขังตามข้อกำหนดสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขังได้แก่ การดูแลสุขภาพ และด้านเจ้าหน้าที่เรือนจำและที่สามารถปฏิบัติได้ตามหลักปฏิบัติต่อผู้ต้องขังตามข้อกำหนดสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขังได้แก่ หลักการพื้นฐานของการปฏิบัติ การปกป้องคุ้มครอง สภาพทางกายภาพของการจำคุก ความมั่นคงปลอดภัย การรักษาระเบียบและวินัย และระบอบเรือนจำ (2) สาเหตุของปัญหาการปฏิบัติต่อผู้ต้องขังตามข้อกำหนดสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขังในทัณฑสถานเปิดบ้านเนินสูง จังหวัดปราจีนบุรี คือ ความไม่เพียงพอของงบประมาณของทัณฑสถานเปิดบ้านเนินสูง จังหวัดปราจีนบุรี และเจ้าหน้าที่ขาดความรู้ความเข้าใจเกี่ยวการปฏิบัติต่อผู้ต้องขังตามหลักสิทธิมนุษยชนและมาตรฐานขั้นต่ำแห่งองค์การสหประชาชาติ (3) แนวทางในการแก้ปัญหาการปฏิบัติต่อผู้ต้องขังตามข้อกำหนดสหประชาชาติว่าด้วยการปฏิบัติต่อผู้ต้องขังในทัณฑสถานเปิดบ้านเนินสูง จังหวัดปราจีนบุรี ในส่วนของด้านงบประมาณควรมีการเขียนโครงการที่เกี่ยวกับการดูแลสุขภาพอนามัยของผู้ต้องขังเพื่อขอเงินสนับสนุนจากกรมราชทัณฑ์ ควรมีการสร้างความตระหนักรู้ของเจ้าหน้าที่เกี่ยวกับหลักสิทธิมนุษยชนและมาตรฐานขั้นต่ำแห่งองค์การสหประชาชาติ โดยการเชิญวิทยากรผู้เชี่ยวชาญมาอบรมให้ความรู้ความเข้าใจ สร้างความตระหนักให้แก่เจ้าหน้าที่ในการปฏิบัติต่อผู้ต้องขังทุกคน และการทำข้อตกลงความร่วมมือกับสาธารณสุขจังหวัดหลายๆ ด้านที่เกี่ยวข้อง
The objectives of this study were 1) to investigate the treatment of inmates in accordance with the United Nations (UN) rules for treating of inmates at the Bannoensong Open Correctional Institution in Prachinburi province, 2) to identify the cause of problems on the treatment of inmates in accordance with the UN rules for treating of inmates at the Bannoensong Open Correctional Institution in Prachinburi province and 3) to propose solutions for the treatment of inmates in accordance with the UN rules for treating of inmates at the Bannoensong Open Correctional Institution in Prachinburi province. This study was qualitative research. There were 3 purposive sampling groups (9 key informants) consisting of 3 prison executives, 3 correction officers, and 3 inmates. The research tools were interviews, participant observation, and descriptive analysis. This study found that (1) the treatment of inmates at the Bannoensong Open Correctional Institution could not comply with the UN rules, such as health care of inmates. The correction officers could comply with the UN rule for treating of inmates including basic principles of conduct, protection, physical conditions of imprisonment, security, discipline, and the prison regime. (2) The cause of the problems was the insufficiency of the budget in the Bannoensong Open Correctional Institution in Prachinburi Province, and correction officers lacked knowledge and understanding about how to treat inmates in line with human rights principles and the UN's minimum standards. (3) The solutions were the following: the projects related to the health care of inmates should be written to request budgets from the Department of Corrections. Raising awareness among correction officers should be implemented based on human rights principles and the UN's minimum standards by inviting expert speakers for training. Moreover, correction officers should be raised awareness about treating inmates and establish cooperation agreements with relevant provincial health authorities.
