Abstract
การศึกษาค้นคว้าอิสระ เรื่องนี้มีวัตถุประสงค์ เพื่อศึกษาแนวคิดทฤษฎีความเป็นมาของการปฏิรูปที่ดินในประเทศไทย หลักเกณฑ์การอนุญาตให้ใช้ที่ดินเพื่อกิจการอื่นที่เป็นการสนับสนุนหรือเกี่ยวเนื่องกับการปฏิรูปที่ดิน แนวคิดทฤษฎีเกี่ยวกับการเพิกถอนคำสั่งทางปกครองที่ไม่ชอบด้วยกฎหมาย และหลักการคุ้มครองความเชื่อ โดยสุจริตในความคงอยู่ของคำสั่งทางปกครองกฎหมายของต่างประเทศและของไทย การวิเคราะห์ปัญหากรณีอำนาจของคณะกรรมการฯ ในการพิจารณาอนุญาตให้ใช้ที่ดินเพื่อกิจการอื่นที่เป็นการสนับสนุนหรือเกี่ยวเนื่องกับการปฏิรูปที่ดิน (กิจการพลังงานลม) และแนวทางในการปรับปรุงแก้ไขกฎหมายว่าด้วยการปฏิรูปที่ดินเพื่อเกษตรกรรม เพื่อรองรับการใช้ประโยชน์ที่ดินที่ ส.ป.ก. ได้มาเพื่อประโยชน์ในการดำเนินการปฏิรูปที่ดินให้เกิดประโยชน์สูงสุดแก่เกษตรกรและประโยชน์สาธารณะของประเทศ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยเอกสารโดยรวบรวมข้อมูลจากเอกสารต่าง ๆ ที่เกี่ยวข้องทั้งหมด ไม่ว่าจะเป็นตัวบทกฎหมายของประเทศไทยและต่างประเทศ ตำรา บทความ วิทยานิพนธ์ สารนิพนธ์ งานวิจัย และข้อมูลอิเล็กทรอนิกส์ต่าง ๆ ทั้งภาษาไทยและภาษาต่างประเทศ ผลการศึกษาพบว่า การอนุญาตให้ใช้ที่ดินของ ส.ป.ก. เพื่อกิจการอื่นที่เป็นการสนับสนุนหรือเกี่ยวเนื่องกับการปฏิรูปที่ดิน ยังมีปัญหาการตีความตัวบทกฎหมายตามพระราชบัญญัติการปฏิรูปที่ดินเพื่อเกษตรกรรม พ.ศ. 2518 ที่ยังไม่ชัดเจน ซึ่งผู้ได้รับความเดือดร้อนเสียหาย จากการอนุญาตให้ใช้ที่ดินเพื่อกิจการกังหันลมผลิตกระแสไฟฟ้า ได้ยื่นฟ้องคดีต่อศาลปกครอง โดยศาลปกครองสูงสุดพิจารณาแล้วเห็นว่ากิจการดังกล่าว เป็นไปเพื่อผลิตกระแสไฟฟ้าจำหน่ายให้แก่การไฟฟ้าฝ่ายผลิตแห่งประเทศไทยอันเป็นกิจการที่มีวัตถุประสงค์ในการแสวงหากำไร มิใช่กิจการที่เป็นการบริการหรือเกี่ยวข้องกับความเป็นอยู่ของเกษตรกรในด้านเศรษฐกิจและสังคมในเขตดำเนินการปฏิรูปที่ดิน จึงมีคำพิพากษาให้เพิกถอนมติคณะกรรมการที่อนุญาตให้ใช้ที่ดินกิจการดังกล่าว ซึ่งกรณีการเพิกถอนการอนุญาตนั้น ถือเป็นการเพิกถอนคำสั่งทางปกครองซึ่งเป็นการให้ประโยชน์แก่ผู้รับคำสั่งทางปกครอง ส.ป.ก. ในฐานะผู้ออกคำสั่งทางปกครองต้องคำนึงถึงหลักการคุ้มครองความเชื่อโดยสุจริตของผู้รับประโยชน์ในความคงอยู่ของคำสั่งทางปกครองกับประโยชน์สาธารณะประกอบกัน เพื่อป้องกันความเสียหายและผลกระทบจากการเพิกถอนคำสั่งทางปกครอง
This independent study had the objective to study the theoretical concept of the history of land reformation in Thailand, the criteria of allowing to use the land for other business that supports or relates to land reformation, theoretical concept on revoking unlawful administrative order and the protection principle of the honest belief in existence of the administrative order overseas and in Thailand, to analyze the problem relevant to the power of the committee in granting permission to use the land or other business that supports or relates to land reformation (wind power business), and to propose guidelines in improving the law on land reformation for agriculture to support the land utilization of Sor.Por.Kor. to the utmost interest of agriculturists and public interest of the country. This independent research was qualitative and documentary research by gathering data from various related documents whether legal provisions of Thailand or foreign countries, textbooks, articles, theses, dissertations, research and various electronic information both Thai and English. From the study result it was found that the permission to use the land of Sor.Por.Kor. for other business that supports or relates to land reformation still had problems on legal interpretation according to the Land Reformation For Agriculture Act B.E. 2518 that was not clear which people who were faced with trouble from the permission to use the land for wind power electricity generator business had submitted the case to the Administrative Court. The Supreme Administrative Court considered that the said business was for producing electricity for selling to the Electricity Generating Authority of Thailand which was the business that had the objective in seeking profit. It was not the business for providing services or relating to well-being of agriculturists regarding economics and society in the area of land reformation so there was a court judgment to revoke the committee resolution to allow the use of the said land. This was the case of revoking administrative orders which provided the benefit to the administrative order receiver so that the Agricultural Land Reform Office as the administrative order issuer should consider principle of protecting honest belief of the benefit receiver of the existence of the administrative order together with the public interest in order to prevent damage and impact from revoking administrative order.
