วิทยานิพนธ์ เรื่องปัญหาในการบังคับใช้กฎหมายเกี่ยวกับความยินยอมที่เกี่ยวข้องกับ สิทธิผู้ป่วยในการรักษาพยาบาลมีวัตถุประสงค์ (1) เพื่อให้ทราบถึงปัญหาและอุปสรรค ของการบังคับใช้กฎหมายตามคำประกาศสิทธิผู้ป่วยและพระราชบัญญัติสุขภาพแห่งชาติ พ.ศ.2550 รวมทั้งสิทธิของผู้ป่วยตามกฎหมายอื่น ที่เกี่ยวข้องกับสิทธิและความยินยอมในการรักษาพยาบาล (2) เพื่อให้มีการบัญญัติ แก้ไข เพิ่มเติมกฎหมายคำประกาศสิทธิผู้ป่วยและสิทธิของผู้ป่วยตามพระราชบัญญัติสุขภาพแห่งชาติ พ.ศ.2550 รวมทั้งสิทธิของผู้ป่วยตามกฎหมายอื่นที่เกี่ยวข้องกับความยินยอมในการรักษาพยาบาลเพื่อเป็นแนวทางให้ผู้ป่วยเข้าถึงสิทธิได้อย่างเต็มที่ (3) เพื่อให้มีการบังคับใช้กฎหมาย และเป็นแนวทางให้บุคลากรด้านสาธารณสุขหรือผู้ให้บริการทางการแพทย์ปฏิบัติต่อผู้ป่วยหรือ ผู้รับบริการให้เข้าถึงสิทธิตามคำประกาศสิทธิผู้ป่วยและสิทธิของผู้ป่วยตาม พระราชบัญญัติสุขภาพแห่งชาติ พ.ศ.2550 รวมทั้งสิทธิของผู้ป่วยตามกฎหมายอื่นที่เกี่ยวข้อง (4) เพื่อศึกษาเปรียบเทียบ กฎหมายไทยและกฎหมายต่างประเทศที่เกี่ยวข้องกับสิทธิของผู้ป่วย วิทยานิพนธ์นี้เป็นการศึกษาวิจัยเชิงคุณภาพ โดยการวิจัยทางเอกสารโดยรวบรวมข้อมูล จากกฎหมายที่เกี่ยวข้อง เอกสาร หนังสือ ตำรา บทความ วิทยานิพนธ์ วิจัย คำพิพากษาศาลฎีกา ผลการศึกษาพบว่า แม้ความยินยอมที่เกี่ยวข้องกับสิทธิผู้ป่วยในการรักษาพยาบาล จะมิได้มีการบัญญัติเกี่ยวกับความยินยอมในการรักษาพยาบาลไว้ในกฎหมายใดโดยเฉพาะก็ตาม แต่ตามคำประกาศสิทธิผู้ป่วย กฎหมายวิชาชีพ และพระราชบัญญัติสุขภาพแห่งชาติกฎหมายกำหนดให้ผู้ป่วย ทุกคนมีสิทธิขั้นพื้นฐานที่จะได้รับการบริการด้านสุขภาพ และการให้ความยินยอมในการรักษาพยาบาล ผู้ให้บริการหรือแพทย์ต้องแจ้งข้อมูลด้านสุขภาพที่เกี่ยวข้องกับการให้บริการให้ผู้รับบริการทราบอย่างเพียงพอและเข้าใจเกี่ยวกับความเจ็บป่วยของตน เพื่อที่ผู้รับบริการจะใช้ประกอบการตัดสินใจในการรับ หรือปฏิเสธไม่รับบริการใด ทำให้ผู้ให้บริการหรือแพทย์มีหน้าที่ต่อผู้ป่วยที่จะต้องรักษาพยาบาล โดยได้รับความยินยอมจากผู้ป่วย หรือโดยมีเหตุอันชอบด้วยกฎหมาย ด้วยเหตุนี้ ผู้ป่วยที่มีความสามารถตามกฎหมาย จึงมีสิทธิที่จะตัดสินใจที่จะยินยอมให้แพทย์ปฏิบัติต่อร่างกายของตน และแพทย์ก็ต้องมีหน้าที่ที่จะต้องเคารพสิทธินั้น หากผู้ให้บริการหรือแพทย์ล่วงละเมิดสิทธิหรือกระทำผิดต่อหน้าที่ อาจถูกฟ้องร้องทั้งทางแพ่งและทางอาญา ยกเว้นในกรณีฉุกเฉิน หรือภาวะที่เป็นอันตรายต่อชีวิตผู้ป่วย หรือกรณีอื่นตามที่กฎหมายกำหนด ผู้ให้บริการหรือแพทย์อาจรักษาผู้ป่วยโดยไม่ได้รับความยินยอมได้
The objectives of this thesis are: 1. To understand the problems of enforcement of the Declaration of Patient’s Rights and National Health Act, B.E. 2550, as well as the problems in practical implementation of the Law on Patient's Rights and consent to medical treatment. 2. To propose the amendment of the Declaration of patient’s rights under the National Health Act, B.E. 2550, as well as patient’s rights under other laws relating to the consent to medical treatment in order to enhance the strategies for the promotion of patients ‘rights supporting the patients to exercise their rights. 3. To strengthen law enforcement and to encourage an effective measures for health professionals, health service providers in the implementation of patients’ laws and regulations resulting in the efficiency of patients’ accessing to patients’ rights according to the Declaration of Patient’s Rights under the National Health Act, B.E. 2550 and other relevant laws. 4. To make a comparison between Thai laws and laws of other countries concerning patient’s rights. This thesis is a qualitative research based on documentary research, conducted by collecting data from various sources, laws and legislations, documents, textbooks, articles, thesis and Supreme Court judgements. The results from the studies of this thesis showed that although the consent to medical treatment relating to the patients’ rights is not particularly legislated in any law, the Declaration of Patient’s Rights, the law of professions and the National Health Act, B.E. 2550 stipulated that every patient has the basic rights to receive health services, and there is the requirement that the patient has to give consent to medical treatment. Health service providers or medical doctors are required to sufficiently inform patients of any information relating to the services in order that the patients can fully understand their medical conditions, and therefore the patients can decide whether they should receive or refuse treatment. Health service providers or medical doctors are responsible for patients’ treatment only if patients give consent to or with reasons according to the laws. On this account, competent patients have the rights to make decisions regarding consent to medical treatment, and the doctors are to respect patient’s rights. Provided that health service providers or medical doctors infringe on patients’ rights or neglect their duties, they are inclined to be sued both in civil and criminal cases. However, in case of emergency or severe conditions that may be harmful to patient’s lives or other cases according to the law, health service providers or medical doctors may be of excuse and are able to treat patients without consent.
