Abstract
การวิจัยนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวคิด ทฤษฎี และหลักการพื้นฐานของกฎหมายมหาชนเกี่ยวกับทางน้ำสาธารณะ (2) ศึกษาสิทธิในการใช้ประโยชน์ในทางน้ำสาธารณะ (3) ศึกษาปัญหาการบังคับใช้กฎหมายไทยเกี่ยวกับการปลูกสร้างสิ่งล่วงล้ำลำน้ำ (4) ศึกษาเปรียบเทียบและวิเคราะห์กฎหมายเกี่ยวกับสิ่งปลูกสร้างล่วงล้ำลำน้ำในประเทศไทยกับกฎหมายของสหรัฐอเมริกา สหพันธ์สาธารณรัฐเยอรมนี ราชอาณาจักรเนเธอร์แลนด์ ประเทศญี่ปุ่น และประเทศมาเลเซีย และ (5) ศึกษา วิเคราะห์และกำหนดแนวทางการแก้ปัญหาการบังคับใช้กฎหมายเกี่ยวกับการปลูกสร้างสิ่งล่วงล้ำลำน้ำ งานวิจัยนี้เป็นการวิจัยทางกฎหมายโดยการวิชัยเชิงคุณภาพ ด้วยการวิจัยทางเอกสารจากกฏหมายว่าด้วยการเดินเรือในน่านน้ำไทย บทบัญญัติรัฐธรรมนูญ บทบัญญัติแห่งกฎหมาย กฎ ระเบียบ หนังสือ ตำรา บทความทางวิชาการ งานวิจัย ตลอดจนคําพิพากษาศาลปกครอง คําพิพากษาศาลฎีกา ความเห็นของสํานักงานคณะกรรมการกฤษฎีกา อีกทั้งกฎหมายต่างประเทศที่เกี่ยวข้อง โดยผู้วิจัยทำการสังเคราะห์และวิเคราะห์ข้อมูลเชิงคุณภาพจากเนื้อหาที่ได้จากการวิจัยเอกสารและการทบทวนวรรณกรรม เพื่อนำมาเป็นแนวทางในการเสนอแนะแก้ไขปัญหาการบังคับใช้กฎหมายว่าด้วยการเดินเรือในน่านน้ำไทย ผลการศึกษาพบว่า (1) ตามแนวคิด ทฤษฎี และหลักการพื้นฐานของกฎหมายมหาชน การปลูกสร้างสิ่งล่วงล้ำลำน้ำในทางน้ำสาธารณะเป็นสิ่งต้องห้ามเนื่องจากขัดต่อหลักประโยชน์สาธารณะและหลักความเสมอภาค แต่บางกรณีเพื่อประโยชน์ที่ยิ่งกว่ารัฐอาจยกเว้นให้ได้ (2) สิทธิในทางน้ำสาธารณะมี 2 ประเภท คือ สิทธิทั่วไปของประชาชนและสิทธิพิเศษที่กฎหมายยอมให้ได้โดยมีเงื่อนไข เช่น การจ่ายค่าตอบแทนให้แก่รัฐหรือจ่ายค่าชดเชยให้แก่ผู้ได้รับผลกระทบ (3) กฎหมายไทยเกี่ยวกับสิ่งล่วงล้ำลำน้ำมีหลายฉบับซ้อนกัน และเน้นโทษทางอาญาสำหรับผู้ฝ่าฝืนค่อนข้างรุนแรง จึงไม่ค่อยได้รับความร่วมมือจากประชาชน ไม่เกิดประสิทธิผลในการบังคับใช้กฎหมาย (4) ตามกฎหมายของสหรัฐอเมริกาเป็นไปตามคําพิพากษาของศาล คอมมอนลอว์ซึ่งสามารถเบี่ยงเบนคดีให้ผู้กระทำความผิดไม่ต้องรับโทษได้หากกลับใจแก้ไขลื้อถอนสิ่งล่วงล้ำลำน้ำและกฎหมายของสหรัฐอเมริกาให้สิทธิแก่เจ้าของที่ดินริมทางน้ำสาธารณะเป็นหลักในการสร้างสิ่งล่วงล้ำนี้เป็นสําคัญ กฎหมายของประเทศญี่ปุ่นและกฎหมายของประเทศมาเลเซียมีความสอดคล้องกันเป็นระบบไม่ซ้ำซ้อนกัน กฎหมายสหพันธ์สาธารณรัฐเยอรมนีและกฎหมายของราชอาณาจักรเนเธอร์แลนด์เน้นมาตรการบังคับทางปกครองสำหรับผู้สร้างสิ่งล่วงล้ำลำน้ำโดยฝ่าฝืนกฎหมาย ซึ่งแตกต่างจากกฎหมายไทยที่มีหลายฉบับและเน้นโทษทางอาญา (5) สมควรยกเลิกกฎหมายบางฉบับให้คงเหลือกฎหมายเกี่ยวกับสิ่งล่วงล้ำลำน้ำตามกฎหมายว่าด้วยการเดินเรือในน่านน้ำไทยเพื่อให้มีกฎหมายเท่าที่จําเป็นตามหลักในรัฐธรรมนูญแห่งราชอาณาจักรไทยและควรเน้นมาตรการทางปกครองและการเบี่ยงเบนคดีอาญาเพื่อประสิทธิภาพในการบังคับใช้กฎหมาย
This thesis aimed (1) to study concepts, theories, and fundamental principles of public law on public waterways (2) to study rights of use in public waterways (3) to studying law enforcement problems related to building intrusive streams. (4) to compare and analyze the laws relating to the intrusive structures in Thailand with laws on public waterways of United States, German Confederation, Kingdom of the Netherlands, Japan and Malaysia and (5) study, analyze and formulate solutions to the law enforcement problems relating to the construction of intrusive structures. The thesis is qualitative research, gathering information from the provisions of the law on navigation in Thai waters, provision of constitutional provisions, provisions of laws, regulations, books, texts, academic articles, research, Including administrative judgments, the judgment of the supreme court and the discussion of the office of the council of state and foreign laws. The researcher synthesize and analyze qualitative data from the content obtained from research papers and literature reviews, to be used as a guideline to suggest solutions to problems relating to public waterway rights of the people under the Act on Navigation in Thai Waters. The findings revealed that (1) according to the concept, theory, and fundamental principles of public law constructing intrusive waterways in public waterways is prohibited because it is against the principles of public interest and equality. But in some cases, for the benefit of greater than the state, maybe exempt, and privileges that are permitted by law on conditions such as compensation to the state or compensation to the affected person. (3) There are several Thai laws regarding river intrusion, and emphasize the criminal penalties for violators that are quite severe. Therefore, rarely receives cooperation from the public not effective in law enforcement. (4) According to US law, by the Common Law court ruling, the court can deflect the case against the perpetrator if repentant and removes the intrusion of the waterways, and US law provides the right to landowners primarily on public waterways to create intrusive waterways. In Japan and Malaysia, the laws are systematically consistent, not duplicated. In laws of German Confederation and laws of Kingdom of the Netherlands focus on administrative measures for river intrusion in violation of the law. Therein different from Thai laws and emphasizes criminal penalties. (5) Some laws should be repealed to remain untraditional laws in Thai waters to have the law as is necessary for accordance with the principles in the Constitution and should focus on administrative measures and criminal diversion for the effectiveness of law enforcement
