Abstract
การศึกษาค้นคว้าอิสระ เรื่องปัญหาการบำบัดผู้ติดยาเสพติดตามพระราชบัญญัติฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ. 2545 มีวัตถุประสงค์ดังนี้ 1) เพื่อศึกษาแนวคิดและทฤษฎีการกระทำความผิดเกี่ยวกับยาเสพติด 2) เพื่อศึกษาแนวคิด ทฤษฎีการบำบัดฟื้นฟูสมรรถภาพผู้ดีดยาเสพติด 3) เพื่อศึกษาและเปรียบเทียบการบำบัดฟื้นฟู สมรรถภาพผู้ติดยาเสพติดตามกฎหมายของต่างประเทศ 4) เพื่อวิเคราะห์ปัญหาการบำบัดฟื้นฟูผู้ดิดยาเสพติด ตาม พระราชบัญญัติฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ. 2545 และ 5) เพื่อหาแนวทางที่เหมาะสมในการแก้ไขปัญหา และนำไปใช้ในการฟื้นฟูสมรรถภาพผู้ติดยาเสพติดให้มีประสิทธิภาพต่อไป
การศึกษาค้นคว้าอิสระฉบับนี้เป็นการวิจัยเชิงคุณภาพ โดยการวิจัยเอกสาร ด้วยการรวบรวมข้อมูลจาก หนังสือ ตำรา ตัวบทกฎหมาย คำพิพากษาศาลฎีกา วิทยานิพนธ์ งานวิจัย เอกสารประกอบการเรียนการสอน เอกสาร ประกอบการสัมมนา บทความ วารสาร รวมตลอดถึง ข้อมูลสารสนเทศบน internet ทั้งภาษาไทยและภาษาอังกฤษ
จากการศึกษาพบว่ากฎหมายเกี่ยวกับการบังคับบำบัดผู้ดิดเสพยาเสพติดในประเทศไทย ยังไม่สอดคล้องและไม่เป็นมาตรฐานเดียวกัน ทั้งยังขาดกระบวนการเชื่อมต่ออย่างเป็นระบบ จึงส่งผลให้ไม่สามารถบำบัดผู้เสพ ผู้ดิดยาเสพติดให้หายขาดและออกจากระบบบังคับบำบัดได้อย่างถาวร ผู้ศึกษาจึงเสนอแนวทางแก้ไข โดยควรมีมาตรการบังคับที่เป็นระบบมาตรฐานและมีกลไกรองรับเป็นทิศทางเดียวกัน ซึ่งจำเป็นต้องแก้ไขบทบัญญัติบางส่วนในพระราชบัญญ้ติฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ. 2545 รวมทั้งกฎหมายลำดับรอง ให้สอดคล้องกับสภาพปัญหาและการปฏิบัติงานของเจ้าหน้าที่ ในประเด็นสำคัญสี่ประการ คือ (1) หลักเกณฑ์ของผู้เข้ารับการบำบัดฟื้นฟู พบว่าเงื่อนไขการเข้ารับการบำบัดฟื้นฟูตามพระราชบัญญัติฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ. 2545 มีความไม่สอดคล้องกับสภาพความเป็นจริงของผู้เสพ ผู้ติดยาเสพติด จึงเสนอให้ศาลเป็นผู้ใช้ดุลพินิจสั่ง ส่งตัวผู้ต้องหาเข้ารับการบำบัดฟื้นฟู (2) ขั้นตอนการตรวจพิสูจน์การติดยาเสพติด พบว่ามีความล่าช้าเกินสมควรจึง เสนอให้โรงพยาบาลซึ่งมีความพร้อมเป็นสถานที่ตรวจพิสูจน์ (3) ขั้นตอนการบำบัดฟื้นฟูและการรายงานตัว พบว่า แผนการบำบัดไม่สอดคล้องกับระดับการติดยาเสพติดและขาดสถานบำบัดมารองรับ จึงเสนอให้ออกระเบียบ กำหนดวิธีการบำบัดฟื้นฟูตามระดับการติดยาเสพติดและเพึ่มสถานบำบัดฟืนฟู (4) ขั้นตอนการติดตามผู้ผ่านการบำบัดฟื้นฟูพบว่าขาดการติดตามช่วยเหลืออย่างจริงจังจึงเสนอให้เพิ่มขั้นตอนการติดตามไว้ในพระราชบัญญัติฟื้นฟู สมรรถภาพผู้ดิดยาเสพติดด้วย เพื่อให้การบังคับใช้กฎหมายมีประสิทธิภาพ บรรลุวัตถุประสงค์ของการแก้ไขปัญหา การเสพยาเสพติดโดยคำนึงถึงสิทธิของผู้เข้ารับการบำบัดด้วย
The purposes of the Independent Study on the Issues of Drug Rehabilitation according to Narcotic Addict Rehabilitation Act B.E. 2545 (2002) are as follows: 1) to study notion and theory of drug offence, 2) to study notion and theory of drug addict rehabilitation, 3) to study and compare with foreign drug addict rehabilitation laws and regulations, 4) to analyze the problems of drug addict rehabilitation according to the Narcotic Addict Rehabilitation Act B.E. 2545, 5) to seek for appropriate guidelines in order to remediate the problems and to lead to effective drug addict rehabilitation. This Independent Study is a quality analysis by means of documents review and information collection from many sources, namely, textbooks, legal provisions, Supreme court judgements, theses, research papers, learning documents,seminar documents, articles, journalsincluding information on the internet both Thai and English websites. The result of this study indicates that regulations related to compulsory rehabilitation in Thailand are inconsistent and do not have the same standard. Moreover, lacking of systematic linking processes is the cause of ineffective drug addiction treatment. Some corrective measures are proposed to standardize systematic enforcement measures and supportive mechanism with the same direction. Therefore, it is necessary to amend some parts of the Narcotic Addict Rehabilitation Act and bylaws to be in line with the current drug situations and officers’ execution in 4 aspects: (1) criteria of the rehabilitation admission which found that the condition of rehabilitation admission stated in the Narcotic Addict Rehabilitation Act are not corresponded with the recipients in reality so it is suggested that the judges exercise their discretion to command the accused to get rehabilitation treatment programme, (2) process to investigate drug addiction, because of unreasonable delay, it is proposed that the hospitals which are competent to be investigator facilities, (3) process to rehabilitation and reporting, it is found that rehabilitation programme is inconsistent with the drug addiction level and insufficient rehabilitation centres, the ordinances which stipulate drug treatment methods appropriate to drug abusers’ level should be regulated, moreover, increasing rehabilitation facilities are also necessary, (4) process to follow-up rehabilitated people, lacking of seriously aftercare treatment programme also found, as a result, the aftercare scheme should be added in the Narcotic Addict Rehabilitation Act B.E. 2545 (2002). Hence, this will advocate law implementation which can both attain the ultimate goal of drug addicted solution and protect drug abusers’ right.
