การส่งผู้กระทำผิดฐานกระทำชำเราเด็กอายุไม่เกินสิบห้าปีไปตรวจจิต

Abstract

การศึกษาค้นคว้าอิสระเรื่อง การส่งผู้กระทำผิดฐานกระทำชำเราเด็กอายุไม่เกินสิบห้าปีไปตรวจจิต มีวัตถุประสงค์ 1) เพื่อศึกษาแนวคิดและทฤษฎีเกี่ยวกับการคุ้มครองเด็ก และการลงโทษผู้กระทำผิด 2) เพื่อศึกษามาตรการทางกฎหมายเกี่ยวกับการส่งผู้กระทำผิดฐานกระทำชำเรา เด็กอายุไม่เกินสิบห้าปีไปตรวจจิตตามกฎหมายไทยและกฎหมายของต่างประเทศ 3) วิเคราะห์ เปรียบเทียบกฎหมายไทยและกฎหมายของต่างประเทศเกี่ยวกับการส่งผู้กระทำผิดฐานกระทำชำเรา เด็กอายุไม่เกินสิบห้าปีไปตรวจจิต 4) เพื่อหาแนวทางที่เหมาะสมแก้ไขบทบัญญัติของกฎหมาย เกี่ยวกับการดำเนินคดีอาญาฐาน กระทำชำเราเด็กอายุไม่เกินสิบห้าปี การศึกษาค้นคว้าอิสระนี้เป็นเป็นการวิจัยเชิงคุณภาพ (Quality Research) โดยการวิจัย เอกสาร (Documentary Research) ด้วยการศึกษาค้นคว้าและรวบรวมข้อมูลจากเอกสาร ด้วยการศึกษาจากหนังสือ ตำรา วารสารทางวิชาการ ตัวบทกฎหมาย คำพิพากษาของศาล วิทยานิพนธ์ รายงานการวิจัย ข้อมูลทางสื่ออิเล็กทรอนิกส์ และเครือข่ายอินเตอร์เน็ต (Internet) ผลการศึกษาพบว่าประเทศไทย ยังไม่มีแนวทางการส่งตัวผู้กระทำความผิดไปตรวจจิตอย่างเป็นระบบ จะมีการส่งตัวผู้กระทำผิดไปตรวจจิต ในกรณีที่ผู้กระทำความผิดที่มีอาการวิกลจริตอย่างชัดเจนโดยการแสดงออก และมีการร้องขอต่อผู้เกี่ยวข้องให้ส่งไปตรวจ ส่วนผู้กระทำความผิดทางเพศที่ไม่มีการแสดงอาการทางจิตชัดเจน จะไม่ได้รับการส่งตรวจทางจิต ผลจากการศึกษาดังกล่าวจะนำไปสู่การแก้ไขบทบัญญัติของกฎหมายเกี่ยวกับการดำเนินคดีอาญาฐานกระทำชำเราเด็กอายุไม่เกินสิบห้าปีโดยมีการส่งผู้กระทำผิดไปตรวจจิตอย่างมีระบบและมีมาตรฐานต่อไป

The objectives of independent study entitled “Sending Offenders of Sexual Abuse on Children Aged not Over Fifteen Years for Mental Examination” were: 1) to study concepts and theories of child protection and punishment of offenders; 2) to study the legislative measures about sending offenders of sexual abuse on children aged not over fifteen years for mental examination under Thai laws and foreign laws; 3) to analyze and compare between Thai laws and foreign laws concerning sending offenders of sexual abuse on children aged not over fifteen years for mental examination; 4) o find an appropriate approach to amend provisions of laws relating to the criminal proceedings of an offense of sexual abuse on children aged not over fifteen years. This independent study is a qualitative research with documentary research and gathering information from aticles, studying textbooks, academic journals, legal provisions, court sentences, theses, research reports, electronic data and information from internet. The result of study found that, in Thailand, there is not an appropriate measure to send the offenders for mental examination. Sending the offenders for mental examination has been made only the case that the offenders had psychotic symptoms expressed clearly and there is a petition to concerning persons to send them for mental examination. But those who had no psychotic symptoms expressed clearly would not be sent for the mental examination. The result of this study will lead to amendment of provisions of laws relating to the criminal proceedings of an offense of sexual abuse on children aged not over fifteen years by sending the offenders for mental examination systematically.
