Abstract
การศึกษาค้นคว้าอิสระ เรื่อง แนวทางการคุ้มครองภาพรวมร้านค้าในฐานะเครื่องหมายการค้า มีวัตถุประสงค์ในการศึกษา แนวคิดเกี่ยวกับการคุ้มครองภาพรวมของร้านค้า ตลอดจนองค์ประกอบทางกฎหมายของภาพรวมร้านค้าในฐานะเครื่องหมายการค้า โดยเปรียบเทียบการคุ้มครองภาพรวมของร้านค้าตามกฎหมายเครื่องหมายการค้า (The Lanham Act) ของประเทศสหรัฐอเมริกา และหลักเรื่องลวงขายของประเทศอังกฤษเปรียบเทียบกับกฎหมายของประเทศไทยเพื่อวิเคราะห์หาข้อสรุปและข้อเสนอแนะเกี่ยวกับการให้คุ้มครองภาพรวมร้านค้าตามกฎหมายไทยการศึกษาค้นคว้าอิสระนี้
เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสารตัวบทกฎหมาย ตำรา การวิจัย วิทยานิพนธ์ บทความทางวิชาการ เอกสารประกอบการสัมมนา ข้อมูลจากเว็บไซต์ทางอินเตอร์เน็ต ตลอดจนเอกสารต่างๆ ที่เกี่ยวข้องผลการศึกษาพบว่า The Lanham Act ของประเทศสหรัฐอเมริกาให้การคุ้มครองภาพรวมร้านค้าในฐานะเครื่องหมายการค้า และสามารถจดทะเบียนภาพรวมร้านค้าเป็นเครื่องหมายบริการได้ ส่วนประเทศอังกฤษได้รับความคุ้มครองตามหลักการลวงขายของประเทศอังกฤษซึ่งให้ความคุ้มครองภาพรวมร้านค้าตามหลักการลวงขาย ในขณะที่กฎหมายเครื่องหมายการค้าของประเทศไทยไม่ได้จัดประเภทภาพรวมร้านค้าเป็นประเภทหนึ่งของเครื่องหมาย ดังนั้น ภาพรวมร้านค้าจึงไม่ได้รับความคุ้มครองตามพระราชบัญญัติเครื่องหมายการค้า พ.ศ. 2534 ผู้วิจัยเสนอให้มี การแก้ไขพระราชบัญญัติเครื่องหมายการค้า พ.ศ. 2534 แก้ไขเพิ่มเติม (ฉบับที่ 2) พ.ศ. 2543 เพื่อให้ ความคุ้มครองครอบคลุมไปถึงภาพรวมร้านค้า เพื่อให้เกิดความชัดเจนในการให้ความคุ้มครอง ภาพรวมร้านค้าซึ่งจะส่งผลให้เจ้าของสิทธิได้รับความคุ้มครองภาพรวมร้านค้าในฐานะเครื่องหมาย การค้า และได้รับความคุ้มครองในกรณีของการลวงขายอีกด้วย
The objectives of this research aim at studying the concepts, Guideline on Protection of Trade Dress of the Retail Store as Trademark as Trademark the legal elements of trade dress of the retail store protected as trademark under the Lanham Act of the United States of America and the passing off principle of the United Kingdom, in comparison with Thai Trademark law in order to analyze and make a conclusion to analysis of the conclusions and recommendations regarding of how to protect trade dress of the retail store under Thai law. This independent study is a qualitative research study. The research has been conducted via the documents, legislation, textbooks, research, thesis, academic articles, seminar documents, information from websites on the internet including relevant documents. The results of the study showed that the Lanham Act of the United State give the protection of the retail store as one kind of trademark which can be registrable as the service mark, while the United Kingdom give the protection
