Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์ เพื่อศึกษาสภาพปัญหาความไม่เป็นอิสระ ในการทำงานของพนักงานสอบสวนตามกฎหมายไทย ซึ่งหากพนักงานสอบสวนไม่มีความเป็นอิสระจะเกิดผลกระทบอย่างไร และความเป็นอิสระของพนักงานสอบสวนมีความสำคัญอย่างไร โดยวิเคราะห์เปรียบเทียบกับความเป็นอิสระของพนักงานสอบสวนต่างประเทศ ตลอดทั้งเสนอแนะแนวทางแก้ไขกฎหมายเกี่ยวกับความเป็นอิสระของพนักงานสอบสวน การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ โดยวิธีการศึกษาค้นคว้าเอกสารที่เป็นข้อมูลปฐมภูมิ ตัวบทกฎหมาย เช่น รัฐธรรมนูญแห่งราชอาญาจักรไทย พระราชบัญญัติ ประมวลกฎหมายวิธีพิจารณาความอาญาและข้อมูลทุติยภูมิ เช่น งานวิจัย วิทยานิพนธ์ บทความ ตำราวิชาการ กฎระเบียบเกี่ยวกับการสอบสวนคดีอาญา เพื่อรวบรวมประมวลเป็นข้อเสนอแนะ ผลการศึกษา พบว่า ประเทศไทยมีการแก้ไขปรับปรุงกฎหมายกำหนดให้องค์กรศาล อัยการ ซึ่งเป็นหน่วยงานในกระบวนการยุติธรรมทางอาญามีความเป็นอิสระตามกฎหมาย ปราศจากการแทรกแซงจากฝ่ายการเมืองและฝ่ายบริหาร แต่ไม่มีกฎหมายกำหนดให้พนักงานสอบสวนซึ่งเป็นหนึ่งในกระบวนการยุติธรรมทางอาญา มีความเป็นอิสระในการทำงาน อันส่งผลกระทบต่อการสอบสวน ซึ่งจะทำให้ประชาชนไม่ยอมรับและก่อความไม่สงบเรียบร้อยในสังคม
The objective of this independent study was to investigate the problem of non-independence in the work of investigating officers under Thai law. If the investigator is not independent, how will the impact? And what is the independence of the investigators? Comparative analysis and independence of foreign investigators. He also advised on amendments to the law on the independence of the investigating officers. This independent study is a qualitative research. The study of primary legal documents such as the Constitution of the Thai Criminal Court act Criminal Procedure Code and secondary information such as thesis research, articles, academic texts, regulations on criminal investigation. To compile the process into feedback. The study indicated that Thailand has amended the law requiring the judicial organization, a criminal justice agency, to have legal independence. Without political and administrative intervention. But there is no law requiring investigators to be one of the criminal justice systems. Be independent in work. The impact on the investigation. This will make people not accept and cause unrest in society.
