Abstract
การศึกษาค้นคว้าอิสระเรื่องมาตรการทางกฎหมายเกี่ยวกับการจำหน่ายสินค้าบนถนนและในที่สาธารณะมีวัตถุประสงค์เพื่อ 1) ศึกษาความเป็นมา แนวคิด ทฤษฎี ที่เกี่ยวข้องกับการจำหน่ายสินค้าบนถนนและในที่สาธารณะ 2) ศึกษามาตรการทางกฎหมายเกี่ยวกับการจำหน่ายสินค้าบนถนนและในที่สาธารณะในประเทศไทยและต่างประเทศ 3) เปรียบเทียบมาตรการทางกฎหมายเกี่ยวกับการจำหน่ายสินค้าบนถนนและที่สาธารณะของประเทศไทยเปรียบเทียบกับต่างประเทศ 4) เสนอแนะมาตรการและวิธีการที่เหมาะสมมาใช้เป็นแนวทางในการพัฒนาปรับปรุงกฎหมายของประเทศไทยให้มีความเหมาะสมสอดคล้องกับสถานการณ์ปัจจุบัน การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร โดยศึกษาและวิเคราะห์มาตรการทางกฎหมายเกี่ยวกับการจำหน่ายสินค้าบนถนนและในที่สาธารณะของประเทศไทย ประเทศอินเดีย และประเทศสหรัฐอเมริกา พบว่า ในประเทศไทยนั้นการดำเนินการจัดระเบียบการจำหน่ายสินค้าบนถนนหรือในที่สาธารณะ ซึ่งเป็นการจัดระเบียบภายใต้อำนาจพระราชบัญญัติรักษาความสะอาดและความเป็นระเบียบเรียบร้อยของบ้านเมือง พ.ศ. 2535 ซึ่งไม่เพียงพอในการควบคุมและแก้ไขปัญหาในเรื่องการจำหน่ายสินค้าบนถนนและในที่สาธารณะได้ทั้งหมด จึงมีความจำเป็นที่จะต้องศึกษาถึงมาตรการทางกฎหมายเกี่ยวกับการจำหน่ายสินค้าบนถนนและในที่สาธารณะทั้งของประเทศไทยและของต่างประเทศ สำหรับประเทศอินเดียและประเทศสหรัฐอเมริกา มีการบัญญัติกฎหมายเกี่ยวกับการจำหน่ายสินค้าบนถนนขึ้นมาเป็นการเฉพาะ ซึ่งมีเนื้อหาครอบคลุมสิทธิและหน้าที่ของผู้จำหน่ายสินค้าบนถนนและการกำกับดูแลการจำหน่ายสินค้าบนถนน ผลการศึกษา พบว่า ประเทศอินเดียมีระบบการบริหารจัดการการจำหน่ายสินค้าบนถนน โดยคำนึงถึงสิทธิและหน้าที่ของผู้จำหน่ายสินค้าบนถนน ส่วนประเทศสหรัฐอเมริกา จะเป็นการนำเสนอกฎหมายของเมืองพอร์ตแลนด์ รัฐออริกอน (The city of Portland , Oregon) มาทำการศึกษาเปรียบเทียบซึ่งในบทบัญญัติของกฎหมายได้คำนึงถึงสิทธิของในการประกอบอาชีพของผู้จำหน่ายสินค้าบนถนนและสิทธิของประชาชนในการใช้ทางเท้าสัญจรได้อย่างปลอดภัย ดังนั้น ผู้วิจัยจึงเสนอมาตรการจำหน่ายสินค้าบนถนนหรือในสถานสาธารณะของประเทศไทย คือ การพัฒนากฎหมายการจำหน่ายสินค้าบนถนนหรือในสถานสาธารณะโดยการตราเป็นพระราชบัญญัติขึ้นเป็นการเฉพาะ การกำหนดให้มีหน่วยงานหรือคณะกรรมการมาทำหน้าที่ดูแลการจำหน่ายสินค้าบนถนนและในที่สาธารณะ การเสนอให้มีการจัดระเบียบพื้นที่ประกอบการค้า รัฐต้องมีการส่งเสริมให้ผู้จำหน่ายสินค้าบนถนนมีการรวมกลุ่มกัน รวมไปถึงการจัดระเบียบการจำหน่ายสินค้าในตลาดนํ้า
The purposes of this independence study are to: (1) studies history, conceptual, and theory in the Sales of Goods on streets and public areas of Thailand; (2) analyze the legal measures of Thailand, India and the United States regarding with the Sales of Goods on streets and public areas; (3) scrutinizes and compares these legal measures and contents; and (4) recommends the useful and appropriate legal measures to implement the process on Thai legal reformation in accordance with the current situation. This independence study is a documentary research analyzing the above legal measures in Thailand, India, and the United States. Then we found that Thai regulation under the authority of Cleanness and Urban Regulation Act, BE 2535, was inadequate to manipulate and resolve all problems. Thus, it is necessary for additional analysis the Thai regulations. For India and the United States, there are the particular legislations, which their contents cover rights and duties of vendors and control the sales of goods on the streets. The study indicated that, India has the management system by considering the rights and duties of vendors to legislate the Sale of Goods on streets Acts. For the United States, it shows the City of Portland, Oregon Act, which considers the rights of vendors and people in using footpath safely. Hence, we recommend Thai legal measures on the sales of goods on streets and public areas, which is the development by enacting the particular legislation, determining to have government sectors and boards to perform the carefulness to the sales of goods on streets and public areas, and recommend the reorganization in the sales of goods on the streets and public areas. The government must be encouraged the vendors are grouped together as well as organizing the goods distribution in floating market.
