สิทธิเสรีภาพในการพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะ ศึกษาเปรียบเทียบกฎหมายไทยและสหรัฐอเมริกา

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์ (1) ศึกษาแนวคิด ทฤษฎี ที่เกี่ยวข้องกับสิทธิเสรีภาพในการป้องกันตัวตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 (2) ศึกษากฎหมายเกี่ยวกับสิทธิเสรีภาพในการพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะ ตามพระราชบัญญัติอาวุธปืน เครื่องกระสุนปืน วัตถุระเบิด และดอกไม้เพลิง พ.ศ. 2490 และกฎหมายของประเทศสหรัฐอเมริกา (3) วิเคราะห์ปัญหาเกี่ยวกับสิทธิเสรีภาพของประชาชนในการพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะของประเทศไทย (4) ศึกษาถึงแนวทางในการแก้ไขกฎหมายในการพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยทางนิติศาสตร์ โดยการวิจัยเชิงคุณภาพ โดยใช้วิธีการค้นคว้าและวิจัยเชิงเอกสาร โดยทำการศึกษาจากตัวบทกฎหมาย ตำรากฎหมาย ความเห็นทางกฎหมาย ตลอดจนคำสั่ง คำพิพากษาของศาล บทความวิชาการ วารสารทางวิชาการ วิทยานิพนธ์ งานวิจัย รวมทั้งฐานข้อมูลทางอิเล็กทรอนิกส์ต่างๆ และทำการศึกษาเปรียบเทียบ และนำเสนอผลการศึกษาในเชิงพรรณนา ผลการศึกษาพบว่า (1) การป้องกันตัวของประชาชนเป็นสิทธิเสรีภาพตามรัฐธรรมนูญ แห่งราชอาณาจักรไทย พุทธศักราช 2560 (2) ในประเทศไทย การพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะ จะต้องขอใบอนุญาตพกพาอาวุธปืนติดตัว ตามพระราชบัญญัติอาวุธปืน เครื่องกระสุนปืน วัตถุระเบิด และดอกไม้เพลิง พ.ศ. 2490 และสำหรับสหรัฐอเมริกา ในมลรัฐนิวยอร์ก จะต้องขอใบอนุญาตพกพาอาวุธปืนตามกฎหมายแห่งมลรัฐเช่นเดียวกัน (3) มีปัญหาเกี่ยวกับการให้ดุลพินิจของเจ้าพนักงานในการจำกัดสิทธิเสรีภาพในการพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะ และปัญหาหลักเกณฑ์การออกใบอนุญาตพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะ (4) เสนอแนวทางแก้ไขกฎหมายโดยการมีบทบัญญัติเป็นการเพิ่มสิทธิเสรีภาพของประชาชนในการพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะ และเพิ่มเติมบทบัญญัติของกฎหมายเกี่ยวกับหลักเกณฑ์การออกใบอนุญาตพกพาอาวุธปืนเพื่อป้องกันตัวในที่สาธารณะ

This independent study has the objectives to (1) examine concepts and theories relating to rights and freedoms of self-defense as enshrined in the Constitution of the Kingdom of Thailand, B.E. 2560; (2) examine laws concerning rights and freedoms of carrying firearms for self-defense in public in accordance with the Firearms, Ammunition, Explosives, Fireworks and. Imitation Firearms Act, B.E. 2490, and the relevant laws of the Law of United States; (3) analyze issues related to the rights and freedoms of citizens in carrying firearms for self-defense in public in Thailand; and (4) propose solutions for amending laws on carrying firearms for self-defense in public. This independent research employed a qualitative methodology, utilizing documentary research, to conduct a legal study. It involved the analysis of legal provisions, case law, scholarly articles, and electronic databases, presenting findings in a descriptive, comparative format. The findings showed that (1) self-defense is regarded as a rights and freedom under the Constitution of the Kingdom of Thailand, B.E. 2560; (2) carrying firearms in public in Thailand requires a permit in accordance with the Firearms, Ammunition, Explosives, Fireworks and. Imitation Firearms Act, B.E. 2490, similar to the requirements in New York, United States, which also mandates a firearm carry permit under state law; (3) there are issues related to the discretion given to official in limiting the right to carry firearms for self-defense in public, as well as issues with the criteria for such permit; and (4) it is recommended that the law bes amended to the rights of citizens to carry firearms for self-defense in public and to clarify the criteria for issuing firearm carry permits.
