การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) เปรียบเทียบหลักกฎหมายไทยและหลักกฎหมายของต่างประเทศเกี่ยวกับการเรียกดอกเบี้ยเกินอัตราที่กฎหมายกำหนดเฉพาะกรณีผู้ให้กู้ที่มิใช่สถาบันการเงิน (2) วิเคราะห์ปัญหาเกี่ยวกับการเรียกดอกเบี้ยเกินอัตราที่กฎหมายกำหนดเฉพาะกรณีผู้ให้กู้ที่มิใช่สถาบันการเงินในประมวลกฎหมายแพ่งและพาณิชย์ของประเทศไทย (3) เสนอแนวทางการแก้ไขปัญหาเกี่ยวกับการเรียกดอกเบี้ยเกินอัตราที่กฎหมายกำหนด เฉพาะกรณีผู้ให้กู้ที่มิใช่สถาบันการเงินในประมวลกฎหมายแพ่งและพาณิชย์ของประเทศไทย การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพที่ใช้วิธีการศึกษาด้วยการวิจัยเอกสาร ได้แก่ ตัวบทกฎหมาย บทความ ตำราวิชาการงานวิจัยวิทยานิพนธ์ คำพิพากษาศาลฎีกาที่เกี่ยวข้อง รวมทั้ง ข้อมูลทางอิเล็กทรอนิกส์ เพื่อรวบรวมข้อมูล และศึกษาวิเคราะห์ เสนอแนะแนวทางแก้ไขปัญหาต่อไป ผลการศึกษา พบว่า (1) ประมวลกฎหมายแพ่งฝรั่งเศสได้บัญญัติว่า การตกลงเรียกดอกเบี้ยต้องชัดแจ้ง และต้องเขียนเป็นลายลักษณ์อักษร ส่วนประมวลกฎหมายแพ่งและพาณิชย์ของไทยในมาตรา 653 นั้น ไม่มีบทบัญญัติบังคับไว้ในเรื่องดังกล่าว และเรื่องการชำระหรือเรียกคืนดอกเบี้ยเกินอัตราที่กฎหมายกำหนดในประมวลกฎหมายแพ่งฝรั่งเศสและเยอรมันนั้น ผู้กู้มีสิทธิเรียกคืนหรือหักชำระหนี้ต้นเงินได้ ส่วนในประมวลกฎหมายแพ่งและพาณิชย์ของไทย มาตรา 654 และ 150 ไม่ได้บัญญัติไว้โดยเฉพาะ (2) ประมวลกฎหมายแพ่งและพาณิชย์ของประเทศไทยมาตรา 653 ไม่ได้บัญญัติครอบคลุมถึงดอกเบี้ยการกู้ยืมเงิน และมาตรา 654, 150 บัญญัติไม่สอดคล้องกับพระราชบัญญัติห้ามเรียกดอกเบี้ยเกินอัตรา พ.ศ. 2560 โดยเฉพาะในเรื่องการชำระดอกเบี้ยเกินอัตราที่กฎหมายกำหนดไปแล้วจะสามารถเรียกคืนดอกเบี้ยที่ชำระเกินอัตราได้หรือไม่ อย่างไร (3) ควรแก้ไขเพิ่มเติมประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 653 โดยระบุอัตราดอกเบี้ยไว้ให้ชัดแจ้ง และต้องมีหลักฐานเป็นหนังสืออย่างใดอย่างหนึ่ง ลงลายมือชื่อผู้ยืมเป็นสำคัญ ส่วนมาตรา 654 และ 150 ควรปรับปรุงให้สอดคล้องกับพระราชบัญญัติห้ามเรียกดอกเบี้ยเกินอัตรา พ.ศ.2560 ได้แก่ การห้ามมิให้คิดดอกเบี้ยเกินร้อยละสิบห้าต่อปี หากในสัญญากำหนดดอกเบี้ยเกินกว่านั้นก็ให้ลดลงมาเป็นร้อยละสิบห้าต่อปีหรือหักชำระหนี้ต้นเงินได้ โดยให้มีผลบังคับใช้ได้จริง
The objective of this independent study is (1) to compare Thai and foreign jurisprudences on usury in the particular case of the non-financial corporation lenders;(2) to analyze the problems relating to usury in the particular case of the non-financial corporation lenders in Thai Civil and Commercial Code, and (3) to suggest a problem solving guideline on usury in particular case of the non-financial corporation lenders in Thai Civil and Commercial Code. This independent study is a qualitative research using the documentary research method from articles of law, articles, academic textbooks, researches, dissertations, the Supreme Court’s related judgments, as well as electronic data are studied for the data collection, study, analysis, and suggestion of the problem solving guideline accordingly. The finding of the studying result indicated that (1) French Civil Code enacts that an agreement on charge of interest must be explicit in writing. In part of section 653 under Thai Civil and Commercial Code enacts none of any legal provisions for enforcement in such respect. In addition, regarding the payment or recall of an excessive interest rate in French and German Civil Code, the lender is entitled to recall or deduct for the principal repayment. None of the specific legal provisions in such respect is enacted in Section 654 and 150 of Thai Civil and Commercial Code; (2) the enactment of Section 653 of Thai Civil and Commercial Code covers none of the loan interest, and the enactment of Section 654 and 150 is inconsistent with the Excessive Interest Rate Prohibition Act B.E. 2560 (2017) particularly whether and how the excessive interest rate payment can be recalled; and (3) the Section 653 of Civil and Commercial Code should be amended specifying an explicit interest rate, whereas any of the written evidence shall be available and mainly affixed with the borrower’s signature. In part of Section 654 and 150, a revision, for instance, a prohibition to charge an interest rate of more than fifteen percent per annum, should be made to be consistent with the Excessive Interest Rate Prohibition Act, B.E. 2560 (2017). If an excessive interest rate is defined in the contract, it shall be reduced to be fifteen percent per annum or deducted for the principal repayment, and actually effective.
