การศึกษาค้นคว้าอิสระเรื่อง การนำกระบวนการยุติธรรมเชิงสมานฉันท์มาใช้สำหรับคดีอาญา : ศึกษากรณีความผิดฐานพรากผู้เยาว์มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎีเกี่ยวกับการลงโทษ ความเป็นมาแนวคิด รูปแบบ และขั้นตอนของกระบวนการยุติธรรมเชิงสมานฉันท์ ตลอดจนข้อเด่น ข้อด้อย ในการนำกระบวนการยุติธรรมเชิงสมานฉันท์มาปรับใช้ในการลงโทษ ผู้กระทำความผิดฐานพรากผู้เยาว์ตามประมวลกฎหมายอาญา มาตรา 317, 318, 319 ควบคู่กับกระบวนการยุติธรรมกระแสหลัก เพื่อหาแนวทางในการพัฒนารูปแบบที่เหมาะสมมาใช้กับความผิดฐานพรากผู้เยาว์อันนำไปสู่การพัฒนาให้คดีความผิดอาญาต่อแผ่นดินในบางฐานความผิด สามารถระงับได้โดยวิธีการอื่น นอกเหนือจากการนำตัวผู้กระทำผิดมาลงโทษแต่เพียงอย่างเดียว การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยจากเอกสาร ซึ่งทำการรวบรวมเอกสารทั้งจากตำราหนังสือบทความงานวิจัยวิทยานิพนธ์ผลงานทางวิชาการอื่นๆ ตัวบท กฎหมาย คำพิพากษาศาลฎีกา รวมตลอดถึงข้อมูลทางสื่ออิเล็กทรอนิกส์ที่เกี่ยวข้อง ผลการศึกษาพบว่า การดำเนินการตามกระบวนการยุติธรรมกระแสหลักในความผิดฐานพรากผู้เยาว์ตามประมวลกฎหมายอาญา มาตรา 317, 318, 319 นั้น มุ่งเน้นแต่เพียงการลงโทษ ผู้กระทำความผิดเป็นสำคัญแม้ว่าคดีประเภทนี้หลังเกิดเหตุฝ่ายจำเลยและผู้เสียหายจะตกลงกันได้ ด้วยการประนอมข้อพิพาทเชิงสมานฉันท์โดยไม่ประสงค์ให้จำเลยต้องรับโทษ หรือตกลงให้จำเลยกับผู้เสียหายสมรสอยู่กินฉันสามีภรรยาต่อไปก็ตามแต่จำเลยก็อาจจะต้องรับโทษทางอาญา เนื่องจากความผิดฐานพรากผู้เยาว์นั้นกฎหมายมิได้บัญญัติให้เป็นความผิดอันยอมความได้จึงต้อง ดำเนินคดีต่อผู้กระทำผิดให้ถึงที่สุดต่อไป ซึ่งถือว่าเป็นการขัดต่อเจตนารมณ์ของผู้เสียหาย ดังนั้นผู้ศึกษาจึงมีความเห็นว่าควรมีการปรับปรุงแก้ไขบทบัญญัติแห่งกฎหมายที่เกี่ยวข้องกับกรณีดังกล่าวข้างต้น รวมทั้งหามาตรการอย่างอื่นมาบังคับใช้เพื่อให้เกิดประโยชน์ที่ดีต่อสังคมส่วนรวมต่อไป
This Independent Study Application of the Restorative Justice to the Criminal Case: Case Study of Minor Abduction has the objective for studying the idea, theories relating to punishment, background, form and process of the Restorative Justice including its Pros &Cons, in applying such the Restorative Justice to the punishment against the offender of the Offence of Minor Abduction in accordance with the Section 317,318,319 of the Penal Code together with the Conventional Criminal Justice in order to seek for the guideline in developing appropriate form for applying to the Offence of Minor Abduction. As a result, certain offences may be settled by other measure other than the punishment against the offender only. This study is the Qualitative Research by researching from the documents. Such documents have been collected from textbooks, books, articles, research papers, theses, other academic works, legal provisions, judgement of Supreme Court including relevant electronic medias. Based upon the Study, it is found that the taking of proceeding according to the Conventional Criminal Justice in the Offence of Minor Abduction in accordance with the Section 317,318,319 of the Penal Code mainly focus on the punishment against the offender. Although both Accused and the injured person can subsequently compromise on such offence by mean of the restorative dispute settlement and does not intend to further punish the Accused, or the Accused and the Injured Person can mutually agree to marry with each other and they have become a spouse but the Accused may be punished by the criminal offence because the Offence of Minor Abduction is stipulated by law as the non-compoundable offence. Therefore, the legal proceeding must be taken against the offender until the proceeding has been finalized. Accordingly, such action is deemed to be against the intention of the Injured Person. Thus, I have the opinion that there should be the amendment of law provision relating to the above-mentioned case including other measure should be enforced for the public good order and benefit.
