Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์ เพื่อ (1) ศึกษาถึงแนวคิด ทฤษฎี และหลักกฎหมายเกี่ยวกับการยึดและคืนของกลางในคดีป่าไม้ (2) ศึกษาถึงหลักกฎหมายที่เกี่ยวกับการยึดและคืนของกลางในคดีป่าไม้ในต่างประเทศ (3) ศึกษาวิเคราะห์ถึงสภาพปัญหาและอุปสรรคของการบังคับใช้กฎหมายที่เกี่ยวข้องกับการยึดและคืนของกลางในคดีป่าไม้ (4) ศึกษาหาแนวทางในการแก้ไขปัญหาและข้อเสนอแนะเกี่ยวกับการยึดและคืนของกลางในคดีป่าไม้ การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยทางนิติศาสตร์ โดยการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร โดยมุ่งศึกษาจากตัวบทกฎหมายที่เกี่ยวข้อง ระเบียบ ข้อตกลง บทความ รายงานการศึกษาวิจัย ความเห็นของคณะกรรมการกฤษฎีกา คำพิพากษาศาลปกครองและศาลฎีกา รวมตลอดถึงเอกสารอื่นและข้อมูลทางอิเล็กทรอนิกส์ที่เกี่ยวข้อง ผลการศึกษาพบว่า (1) ตามแนวคิดการตีความถ้อยคำของตัวบทกฎหมายนั้นจะต้องพิจารณาถ้อยคำของตัวบทเป็นลำดับแรก หรือต้องค้นหาเจตนารมณ์ของกฎหมายดังกล่าวให้เจอ และตีความให้เป็นไปในทิศทางเดียวกันกับเจตนารมณ์นั้น และนำเอาทฤษฎีลำดับศักดิ์ของกฎหมายมาพิจารณาประกอบก็จะได้ความว่ากฎหมายนั้นมีหลายรูปแบบแต่ละรูปแบบก็จะมีศักดิ์ของกฎหมายนั้นแตกต่างกัน การจัดลำดับศักดิ์จะทำหน้าที่แก้ไขปัญหาความขัดแย้งแห่งกฎหมายแล้วบอกให้ทราบว่าจะต้องใช้กฎหมายฉบับใดมาบังคับใช้แก่คดี ซึ่งมีหลักการโดยสรุปคือกรณีที่กฎหมายเฉพาะเรื่องขัดแย้งกับกฎหมายทั่วไปต้องใช้บังคับกฎหมายเฉพาะเรื่อง (2) จากการศึกษากฎหมายป่าไม้ของสาธารณรัฐอินเดีย และกฎหมายป่าไม้ของสาธารณรัฐแห่งสหภาพเมียนมาร์ พบว่าทั้ง 2 ประเทศ ได้บัญญัติความรับผิดสำหรับเจ้าหน้าที่ที่ได้กระทำการโดยไม่ชอบด้วยกฎหมายไว้เพื่อลดความเสี่ยงในการอาศัยอำนาจตามกฎหมายข่มเหงรังแกประชาชนจึงเห็นควรนำมาบัญญัติเพิ่มเติมในพระราชบัญญัติป่าไม้ของประเทศไทยด้วย (3) ในทางปฏิบัติแม้ว่าพระราชบัญญัติป่าไม้ พ.ศ. 2484 กับประมวลกฎหมายวิธีพิจารณาความอาญาจะมีลำดับศักดิ์ของกฎหมายที่เท่าเทียมกัน แต่เมื่อพระราชบัญญัติป่าไม้ พ.ศ. 2484 เป็นกฎหมายเฉพาะเรื่องเมื่อขัดแย้งกับประมวลวิธีพิจารณาความอาญาซึ่งเป็นกฎหมายทั่วไป ผู้บังคับใช้กฎหมายก็จะต้องใช้กฎหมายเฉพาะเรื่องก่อน ซึ่งหากกฎหมายเฉพาะเรื่องไม่มีบัญญัติเรื่องใดเรื่องหนึ่งไว้ ก็ค่อยนำกฎหมายทั่วไปมาปรับใช้กับกรณีนั้น (4) ผู้ศึกษาจึงเสนอแนะว่าให้มีการแก้ไขและเพิ่มเติมบทบัญญัติของมาตราที่เกี่ยวข้องกับการยึดและคืนของกลางในพระราชบัญญัติป่าไม้ให้มีความชัดเจนและครอบคลุมยิ่งขึ้นเพื่อไม่ให้เกิดปัญหาในทางปฏิบัติต่อไป
This independent study aims to (1) to study the concepts theories and principles of law relating to the seizure and returned exhibits in forest cases; (2) to study the principles of law relating to the seizure and returned exhibits in forest cases of foreign countries; (3) to study and analyze the problems and obstacles of law enforcement related to the seizure and returned exhibits in forest cases; (4) to corrective guidelines and suggest relating to the seizure and return of exhibits in forest cases. This independent study is qualitative research whereas the documentary research was conducted from the articles of law, regulations, books, texts, academic articles, research, the discussion of the office of the council of state, including administrative judgments, the judgment of the Supreme Court as well as other ocuments and electronic data. Related. The finding revealed that (1) according to the concept of interpreting the wording of the law, must first consider the wording of the law and must find the spirit of the law and interpret it in the same direction as that intent. and taking into account the theory of hierarchy of law, it can be concluded that there are many forms of law, which has the following principles: in cases where specific laws conflict with general laws, specific laws must be enforced; (2) according to study of forest law of the Republic of India and the forest law of the Republic of the Union of Myanmar, it was found that both countries have provided liability for officials who act unlawfully in order to reduce the risk of using the law to abuse. Come to provide additional provisions in the Forest Act of Thailand as well; (3) in practice, although the Forest Act B.E. 2484 (1941) and the Criminal Procedure Code have the same order of law. But when the Forest Act B.E. 2484 is a specific law when it conflicts with the Criminal Procedure Code which is general law enforcement will have to apply specific laws first. Which if the specific law doesn’t prescribe any particular matter Then the general law was applied to that case; (4) the researcher, there should be Amendments to the section on Forest Act B.E. 2484 relating to the seizure and returned exhibits in forest cases be amended to be more clear and comprehensive in order to avoid further problems in practice.
