มาตราการกำหนดโทษปรับในคดีสิ่งแวดล้อม

Abstract

การศึกษาค้นคว้าอิสระเรื่อง มาตรการกำหนดโทษปรับในคดีสิ่งแวดล้อมมีวัตถุประสงค์ เพื่อศึกษาถึงลักษณะคดีสิ่งแวดล้อม ความเป็นมาของโทษปรับ แนวคิดการกำหนดโทษปรับตามวันและรายได้การวิเคราะห์ การกำหนดโทษปรับตามวันและรายได้ที่บังคับใช้ในประเทศฟินแลนด์ ประเทศสวีเดน ประเทศสหรัฐอเมริกา ปัญหาอุปสรรคที่เกี่ยวกับการนำโทษปรับตามวันและรายได้มาใช้ในคดีสิ่งแวดล้อมของประเทศไทย เพื่อเสนอแนะแนวทางในการพัฒนาและแก้ไขกฎหมาย โดยกำาหนดแนวทางและตัวบทกฎหมายในการนำโทษปรับตามวัน และรายได้มาใช้กับคดีสิงแวดล้อมของประเทศไทยให้เหมาะสมต่อไป การศึกษาในครั้งนี้เป็นการศึกษาเชิงคุณภาพ โดยการวิจัยเอกสาร แนวคำพิพากษาฎีกา บทบัญญัติ ทางกฎหมาย ตำราวิชาการ บทความ วิทยานิพนธ์ และเอกสารอื่น ๆ ทั้งภาษาไทยและภาษาต่างประเทศ โดยนำรวบรวม วิเคราะห์ เปรียบเทียบและนำเสนออย่างเป็นระบบ เสนอแนะแนวทางเกี่ยวข้องกับมาตรการ ในการนำโทษปรับตามวันและรายได้มาใช้กับคดีสิ่งแวดล้อมของประเทศไทย ผลการศึกษาพบว่า ลักษณะคดีสิ่งแวดล้อมมีความพิเศษแตกต่างจากคดีทั่วไปโดยเฉพาะอย่างยิ่ง ในลักษณะของมูลคดีและผลที่เกิดขึ้นก่อให้เกิดความเสียหายต่อสิ่งแวดล้อมทรัพยากรธรรมชาติและผลกระทบ ต่อประชาชนส่วนรวม จึงเป็นความผิดที่มีความร้ายแรงเป็นอย่างยิ่ง การลงโทษจึงต้องเหมาะสมและได้สัดส่วน กับความร้ายแรงของความผิด แต่โทษปรับในคดีสิ่งแวดล้อมของประเทศไทยเป็นโทษปรับแบบตายตัวไม่มี ความยืดหยุ่นทำให้โทษปรับไม่เกิดผลสัมฤทธิ์ ซึ่งในประเทศ ฟินแลนด์ ประเทศสวีเดน และประเทศสหรัฐอเมริกา มีการนำโทษปรับตามวันและรายได้มาบังคับใช้ในคดีสิ่งแวดล้อม ทำให้มีความยืดหยุ่นและเหมาะสมกับความร้ายแรงของความผิด ส่งผลให้โทษปรับในคดีสิ่งแวดล้อมของทั้ง 3 ประเทศ มีประสิทธิภาพและเกิดผลสัมฤทธิ์ โดยการ กำหนดโทษปรับตามวันและรายได้เป็นการกำาหนดโทษปรับให้เหมาะสมกับความร้ายแรงของความผิดและสถานภาพทางเศรษฐกิจของผู้กระทำความผิด ประกอบไปด้วยองค์ประกอบสำคัญ 3 องค์ประกอบ ได้แก่ จำนวนวันปรับ, จำนวนรายได้ต่อหนึ่งวันปรับและจำนวนเงินค่าปรับทั้งหมดที่ต้องชำระ จึงทำให้มีความยืดหยุ่นและเหมาะสมกับผู้กระทำความผิดในแต่ละราย เนื่องจากมีการนำรายได้ของผู้กระทำผิดมาพิจารณาควบคู่กับการกำหนดโทษปรับ ส่งผลให้โทษปรับตามวันและรายได้มีประสิทธิภาพและเกิดผลสัมฤทธิ์มากกว่าโทษปรับแบบตายตัวที่พิจารณาความร้ายแรงของความผิดเพียงอย่างเดียว ดังนี้น หากนำโทษปรับตามวันและรายได้มาบังคับใช้กับคดีสิ่งแวดล้อมของประเทศไทยแทนโทษปรับแบบตายตัวที่บังคับใช้อยูในปัจจุบัน การบังคับใช้โทษปรับในคดีสิ่งแวดล้อม ยอมมีประสิทธิภาพและเกิดผลสัมฤทธิ์อย่างเต็มที่

The independent study on the standard of punishment in environmental case has the objective to study on the characteristic of the background of the punishment in environment case, concept of the punishment based on day-fine and income, the analysis of the determination of day-fine and income enforced in Finland, Sweden, and USA as well as problems and obstacles related to the day-fine and income to be applied in the environmental case of Thailand appropriately in the future. This study is the qualitative research by using researching documents, Judgment of the Supreme Court guidelines, legal provisions, academic texts, articles, theses, and other documents from both Thai and English versions. These documents were collected, analyzed, compared, and presented systematically to present the guideline related to the standard of day-fine rate and income to be applied in the environmental case of Thailand. From the result of the study, it was found that the characteristic of the environment case is different from the general cases, especially on the ground of action. The results from such action caused the damages to the environment and natural resources, and it also provided effects towards common population; therefore, it is the severe offense. The punishment, in this case, shall have suitability and meet proportion of the severity of the offense. However, the punishment in environment case in Thailand is in fixed rate and it is not flexible, so the accomplishment cannot be seen; whereas, in Finland, Sweden, and USA, the day-fine and income are enforced in the environment case, so it is flexible and suitable for the severity of the offense, resulting that the punishment in the environment case of the three countries are effective and accomplished. The determination of punishment under day-fine and income is to determine in order to adjusted it suitably with the severity of the offense and economic status of the offender. It was consisted of three key elements: the number of day-fine, the amount of income per day-fine, and the amount of all fines that have to be paid. Thus, it was flexible and suitable for each offender because the income of the offender had been considered along with the penalty determination. Hence, day-find and income had efficiency and achievement rather than fixed rate of penalty fine which was considered by the severity of the offense only. Hence, if the day-fine and income is applied to the environmental case of Thailand instead of having fixed fine rate that are currently effective, the punishment in environmental cases shall be effective and fully achieved
