Abstract
การวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดและทฤษฎีทั่วไปเกี่ยวกับสิทธิในทางน้ำสาธารณะ และกฎหมายมหาชนที่เกี่ยวกับสิทธิในทางน้ำสาธารณะ (2) ศึกษาตัวบทกฎหมายว่าด้วยการเดินเรือในน่านน้ำไทย และกฎหมายอื่น ๆ ที่เกี่ยวข้อง (3) ศึกษากฎหมายต่างประเทศ ได้แก่ กฎหมายของราชอาณาจักรเนเธอร์แลนด์ ประเทศญี่ปุ่น สาธารณรัฐสิงคโปร์ ประเทศสหรัฐอเมริกา และสหราชอาณาจักร ที่เกี่ยวกับสิทธิในทางน้ำสาธารณะของประชาชน (4) ศึกษาเปรียบเทียบกฎหมายของประเทศไทยกับกฎหมายของราชอาณาจักรเนเธอร์แลนด์ ประเทศญี่ปุ่น สาธารณรัฐสิงคโปร์ ประเทศสหรัฐอเมริกา และสหราชอาณาจักรที่เกี่ยวกับสิทธิในทางน้ำสาธารณะ และ (3) เสนอแนะแนวทางแก้ไขปัญหาเกี่ยวกับสิทธิในทางสาธารณะของประชาชน งานวิจัยนี้เป็นการวิจัยทางกฎหมายโดยการวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสารกฎหมายว่าด้วยการเดินเรือในน่านน้ำไทย รัฐธรรมนูญแห่งราชอาณาจักรไทย บทบัญญัติแห่งกฎหมาย กฎ ระเบียบ ตำรา บทความทางวิชาการ งานวิจัย ความเห็นของสํานักงานคณะกรรมการกฤษฎีกา คําพิพากษาศาลปกครองสูงสุดและศาลฎีกา และกฎหมายต่างประเทศ โดยผู้วิจัยจะทำการสังเคราะห์และวิเคราะห์ข้อมูลเชิงคุณภาพจากเนื้อหาที่ได้จากการวิจัยเอกสารและการทบทวนเพื่อนำมาเป็นแนวทางในการเสนอแนะแก้ไขปัญหาเกี่ยวกับสิทธิในทางน้ำสาธารณะของประชาชนวรรณกรรม ผลการศึกษาพบว่า (1) ตามแนวคิดและทฤษฎีทั่วไป กฎหมายยอมรับสิทธิทั่วไปของประชาชนในทางน้ำสาธารณะ เช่น สิทธิในการใช้ทางน้ำสาธารณะเพื่อการสัญจร เพื่อการท่องเที่ยว การสันทนาการ และการประมง เป็นต้น ตามหลักกฎหมายมหาชน ทางน้ำสาธารณะเป็นสาธารณะสมบัติของแผ่นดินซึ่งกฎหมายไม่ยินยอมให้บุคคลใดมีสิทธิพิเศษเนื่องจากกระทบต่อประโยชน์สาธารณะและขัดต่อหลักความเสมอภาค เว้นแต่มีเหตุผลเพื่อประโยชน์ที่ยิ่งกว่า เช่น การอำนวยความสะดวกให้ประชาชน (2) กฎหมายไทยมีบทบัญญัติเกี่ยวกับสิทธิในทางน้ำสาธารณะหลายฉบับ ได้แก่ กฎหมายการเดินเรือ ในน่านน้ำไทย ประมวลกฎหมายแพ่งและพาณิชย์ ประมวลกฎหมายกฎหมายที่ดิน เป็นต้น สิทธิในทางน้ำสาธารณะจึงมีความไม่ชัดเจนเป็นเหตุให้การบังคับใช้กฎหมาย การทับซ้อนกัน (3) สิทธิในทางน้ำสาธารณะของประชาชนตามกฎหมายของต่างประเทศที่มีความชัดเจน ได้แก่ ตามรัฐธรรมนูญของประเทศสหรัฐอเมริกาได้รับรองสิทธิของประชาชนในการสัญจรทางน้ำ การสันทนาการ และการจับสัตว์น้ำ กฎหมายของสาธารณรัฐสิงคโปร์และกฎหมายของ สหราชอาณาจักร ได้บัญญัติให้ประชาชนที่ประสงค์จะมีสิทธิพิเศษนอกเหนือจากสิทธิทั่วไปต้องขออนุญาตจากรัฐ และกฎหมายการวางแผนเชิงพื้นที่ของราชอาณาจักรเนเธอร์แลนด์และกฎหมายพื้นฐานสําหรับที่ดินของประเทศญี่ปุ่นต้องให้ประชาชนที่ถูกกระทบสิทธิ์มีส่วนร่วมในการจัดทำแผนการใช้ที่ดินและการอนุญาตให้ใช้ที่ดินที่เป็นทางน้ำสาธารณะด้วย (4) ตามกฎหมายไทยและกฎหมายสาธารณรัฐสิงคโปร์และกฎหมายของสหราชอาณาจักรอนุญาตให้ประชาชนมีสิทธิพิเศษในทางน้ำสาธารณะยิ่งกว่าประชาชนทั่วไปได้แต่ต้องจ่ายค่าตอบแทนให้แก่รัฐตามหลักความเสมอภาค กฎหมายของประเทศสหรัฐอเมริกาได้ระบุประเภทของสิทธิพื้นฐานในทางน้ำสาธารณะไว้ กฎหมายของประเทศญี่ปุ่นเน้นการมีส่วนร่วมของประชาชนที่ถูกกระทบสิทธิและการอนุญาตทําได้เท่าที่จำเป็นตามหลักความได้สัดส่วนตามที่ประชาชนเห็นสมควร ในขณะที่กฎหมายไทยไม่มีความชัดเจนในเรื่องดังกล่าว (5) สมควรแก้ไขกฎหมายการเดินเรือในน่านน้ำไทยเพื่อรับรองสิทธิในทางน้ำสาธารณะของประชาชนให้ชัดเจนโดยนําหลักการของสิทธิในทางน้ำสาธารณะตามกฎหมายต่าง ๆ มาบัญญัติไว้ในกฎหมายเพียงฉบับเดียว และควรกำหนดการมีส่วนร่วมของประชาชนและวิธีการบังคับใช้กฎหมายให้เป็นไปตามสิทธิในทางน้ำสาธารณะของประชาชน และเพื่อประสิทธิภาพในการบังคับใช้กฎหมาย
This thesis aimed (1) to study general concepts and theories of public water rights, (2) to study public law conceptsand theories of public water rights, (3) to study the law on navigation in Thai waters, (4) to study foreign law on public water rights of the people, (5) tostudyand compare the laws of Thailand with laws on public water rights of Kingdom of the Netherlands, Japan, Republic of Singapore, United States and United Kingdomand (6) to find out about problems related to public water rights, public water rights of the people and propose a solution to the problem. The thesis is qualitative research, gathering information from the provisions of the law on navigation in Thai waters,as provision of constitutional provisions, provisions of laws, regulations, books, texts, academic articles, research, the discussion of the office of the council of state, including administrative judgments, the judgment of the supreme court and foreign laws.The researcher will synthesize and analyze qualitative data from the content obtained from research papers and literature reviews, to be used as a guideline to suggest solutions to problems related to public water rights of the people. The findings revealed that (1) according to general concepts and theoriesof law, people can have rights to the public waterways with their consent and nowadays, the law recognizes the general rights of the people in public waterways such as the right to use public waterways for traveling, tourism, sport, agriculture and fisheries, etc. (2) As public law concepts and theories, public waterways are domainepublic of state, which the law does not permit any person to have the privilege of public waterways due to their impact on the public interest and contrary to the principle of equality, unless there are reasons for the greater public interest, such as facilitating the people. (3) Under Thai law, there are multiple provisions relating to public water rights, namely the law on navigation in Thai waters and its amendments, civil and commercial law, land law, etc. The rights of public waterways in Thai law are not clear, causing overlap of law enforcement. (4) Public water rights of the people under foreign law are explicit, namely, the Constitution of the United Statesrecognizes the commonrights in public waterways of people, including the right to water access, recreation and catch.The Maritime and Port Authority ofSingapore Act,1996and the Country and Rights of Way of EnglandAct, 2000,require people who wish to have privileges beyond common rightsmust seek permission from the state. The Spatial Planning Act of Netherlands, 2008 and theBasic Act for Land of Japanese, 1989also grants affected people the right to participate in developing land use plans and land use permits.(5) According to law of Thailand and law onRepublic of Singapore,the state may allow people to have more privileges in public waterways than the general public but must pay remuneration to the state based on equality principle. US law are certain types of fundamental rights in public waterways. Japanese law emphasizes the participation of people affected by their rights,thus the permission is granted as necessary by the principle of proportionality under the public deems appropriate, while the Thai law is unclear in this regard.(6) It is therefore expedient to amend the law on navigation in Thai waters in order to ensure the public water rights of the people clearly by bringing the principles of public water rights under various laws to be enacted in just one law, by determining the participation of people and establishlaw enforcement procedures in accordance with the aforementioned rights for efficiency in law enforcement.
